Purpose: One-year reduction in the duration of certain apprenticeship contracts as part of the open reorientation to apprentices engaged in the preparation of a professional bachelor's degree, following the first year of their apprenticeship contract.
Entry into force: the decree is applicable to anniors to apprenticeship contracts entered into pursuant to Article L. 6222-22-1 of the Labour Code signed as of July 28, 2011.
Notice: theArticle L. 6222-22-1 of the Labour Code opens to apprentices preparing a professional bachelor's degree the opportunity to redirect, at the end of their first year, to the preparation of a certificate of professional fitness, a certificate of professional agricultural fitness, a professional agricultural patent, by entering the apprenticeship contract, with the possibility of a reduction of one year of the duration of the contract if the diploma is in the same professional domain. The decision to reduce the duration of the apprenticeship contract by one year is taken by the rector or by the Regional Director of Food, Agriculture and Forestry or by the Regional Director of Youth, Sports and Social Cohesion, after the advice of the Director of the Learning Centre. In addition, with respect to their remuneration, these apprentices are considered to have already completed a first year of learning and are therefore paid as second year apprentices. Finally, the rules applicable to the registration of the apprenticeship contract also apply to anniors to apprenticeship contracts entered into under section L. 6222-22-1.

On the report of the Minister of Labour, Employment and Health and the Minister of National Education, Youth and Associative Life,

Considering the opinion of the National Council for Vocational Training throughout the life of 19 September 2011;
Having regard to the opinion of the Higher Education Council dated 4 November 2011;
Considering the opinion of the National Council for Agricultural Education of 7 November 2011;
The State Council (Social Section) heard,
Decrete:
It is inserted in subsection 3 of chapter II, section 1, title II of Book II of the sixth regulatory part of the Labour Code, an article R. 6222-16-1, as follows:
"Art. R. 6222-16-1.-For apprentices engaged in the preparation of a professional bachelor's degree, the duration of the apprenticeship contract, which is the subject of an order entered into under the provisions of the second paragraph of Article L. 6222-22-1, may be reduced by one year under the conditions provided for in Article R. 6222-17. »
I. ― In article R. 6222-17 of the Labour Code, after the words "article R. 6222-16", the words "or article R. 6222-16-1" are inserted.
II. ― In article R. 6222-18 of the same code, the words "and at 1° and 2° of article R. 6222-16" are replaced by the words "at 1° and 2° of article R. 6222-16 and R. 6222-16-1".
III. ― Article R. 6224-1 of the same code is supplemented by a paragraph as follows:
"The provisions of this section shall apply to anniors to apprenticeship contracts entered into under section L. 6222-22-1. »
IV. ― In the first and third paragraphs of Article R. 6224-4 and in the first paragraph of Article R. 6224-6 of the same Code, after the word "contract" are added the words: "or to the contract entered into on the basis of Article L. 6222-22-1".
V. ― At the 6th of Article R. 6224-6 of the same code, after the words: "learning contract" are added the words: "or from the person to the contract entered into on the basis of Article L. 6222-22-1".
This Order is applicable to amendments to be taken on the basis of Article L. 6222-22-1 of the Labour Code for apprenticeship contracts entered into on 28 July 2011.
The Minister of Labour, Employment and Health, the Minister of National Education, Youth and Associative Life, the Minister of Agriculture, Food, Fisheries, Rurality and Land Management, and the Minister to the Minister of Labour, Employment and Health, responsible for learning and vocational training, are responsible, each in respect of the official decree, for the execution of this Journal.
