Publics concerned: people conducting energy performance diagnostics (EDDs), their clients and their certifying bodies as well as software publishers for the development of EPRs.
Subject: modification of the decree of 3 May 2007 concerning the diagnosis of energy performance for existing buildings for main use of housing proposed for rent in Metropolitan France.
Entry into force: these provisions should be implemented by 1 January 2013.

In view of the decree of 15 September 2006 concerning the diagnosis of energy performance for existing buildings proposed for sale in Metropolitan France;
Having regard to the decision of 15 September 2006 on methods and procedures for the diagnosis of energy performance for existing buildings proposed for sale in Metropolitan France;
In view of the decision of October 16, 2006, setting out the criteria for certification of the skills of natural persons performing the energy performance diagnosis and certification criteria for certification bodies;
In view of the decree of 3 May 2007 concerning the diagnosis of energy performance for existing buildings for main use of housing proposed for rent in Metropolitan France,

Sections 1 to 12 and 14 to 16 of the above-mentioned decision of 3 May 2007 are replaced by the following provisions:
"Art. 1-The provisions of this Order shall be taken for the purposes of the provisions of Articles R. 134-1 to R. 134-5 of the Construction and Housing Code, with the exception of overseas departments, with respect to the rental of existing buildings for main use of dwelling. Any energy performance diagnosis is the subject of a visit to the building by the certified person who develops it.
"For the purpose of this Order:
"—the lots considered are the premises for which energy is used to regulate the internal temperature for human occupation;
" – by "renewable energy produced by permanently installed equipment" means the provision of renewable energy by equipment located in the building, on the plot or in the immediate vicinity;
“– for cooling, greenhouse gas emissions considered do not take into account emissions of refrigerant fluids;
"We mean by conventional method any method satisfying the provisions of the September 15, 2006 Order relating to methods and procedures applicable to the diagnosis of energy performance for existing buildings proposed for sale in Metropolitan France.
"Art. 2.-The provisions of this chapter apply to the overall rental of an individual house comprising not more than two overlayed dwellings or with a single entrance door.
"Art. 3.-The energy performance diagnosis includes:
“1. The identification of the house and its living space, established according to annexes 1 and 2;
“2. A description of the thermal and geometric characteristics of the house and its energy equipment, including the equipment installed permanently using or producing renewable energy; this description is prepared in accordance with Appendix 1.1;
“3. a By type of energy, the annual amounts of final energy required for heating, the production of sanitary hot water and cooling, calculated according to a standardized use of the house, expressed in kilowatt hours; the calculation is done using a conventional method.
"By an annual amount of final energy required for heating, the energy needs related to thermal depletion by the building's envelopment, the loss of thermal systems, the thermal depletion by air-renewal, diminished the internal intakes of the house and solar intakes.
"For individual homes built before 1 January 1948, the annual final energy quantities required for heating and cooling referred to in the first paragraph are equal to the average of actual consumption over the last three years prior to the diagnosis or, if not, on the effective duration of the supply of heating, cooling or hot water for the three years preceding the diagnosis or, if not, on the basis of the last year preceding the diagnosis;
“3. b Annual amounts of primary energy by type of use resulting from the quantities referred to in 3. a, calculated according to the provisions of Annex 3.2;
“3. c An assessment in euros of the annual amounts of the consumption costs inherent in the final energy quantities mentioned in 3. a, calculated according to the provisions of Annex 5, accompanied by the date indicated in 9;
“3. d A classification of the total amount of primary energy mentioned in 3. b, diminished of the quantity of primary electric energy produced at home, according to a reference scale noted from A to G, as set out in Annex 3.2, based on the value of the ratio of this quantity to the habitable surface of the house;
“4. a The annual indicative amount of greenhouse gases emitted into the atmosphere due to the final amount of energy for heating, sanitary hot water and cooling of the premises, expressed in equivalent amount of carbon dioxide, calculated according to the conventions referred to in Annex 4.1;
“4. b A classification of the amount of greenhouse gases mentioned in 4. a de la maison selon une scale de référence notée de A à G, indiqué en annexe 4.2, selon la valeur du rapport de cette quantity à la surface habitable de la maison;
« 5. The share of the amount of renewable primary energy produced by permanently installed equipment, where this quantity can be estimated or measured;
« 6. For each boiler, the last inspection or maintenance report mentioned at the h of section R. 134-2 of the Construction and Housing Code, if required;
« 7. Recommendations for work and improvement of the thermal management of the property and its equipment to reduce energy consumption;
“8. In the case where the calculation is made using a conventional method, the reference to the calculation method used and its version, the personalized explanations on the elements that can lead to differences between the estimated consumption and the actual consumption, as well as the technical sheet defined in Annex 8; otherwise mention of the period of consumer surveys;
“9. In the event that the calculation is made using a conventional method, the date of the order in force on the day of the development of the diagnosis that sets the energy prices in the table of the energy tariffs mentioned in Appendix 5;
“10.” In exceptional circumstances, for individual houses built before January 1, 1948, in the justified absence of consumer surveys, the elements required for 3. a, 3. b, 3. c, 3. d, 4. a, 4. b and 5 must remain virgins.
"Art. 4.-The energy performance diagnosis is based on the choices made, according to model 6. A (conventional method) or model 6. B (consumption reported in Annex 6.
"Art. 5.-The provisions of sections 5 to 7 apply to the private parts of the lot assigned to the housing and located in a main-use housing building with a common mode of heating or production of sanitary hot water and for which no energy performance diagnosis was made at the building.
"The dwellings with individual counting systems for heating and production of sanitary hot water are treated in chapter III.
"Art. 6.-I. ― For the purpose of conducting a diagnostic of energy performance of the lot the owner of common heating equipment, sanitary hot water of the premises, its agent or the syndicate of co-owners, provides to any owner conducting an energy performance diagnosis the following:
“1. The indication of the energy used and a description of the common heating, sanitary hot water systems of the premises, including equipment using or producing renewable energies produced by the equipment installed at home; This document is prepared in accordance with Annexes 1.1 and 1.2;
“2. By type of energy, the annual average of the final energy consumed by the common heating system, the production of sanitary hot water of the premises and the production of renewable energy for the whole building; these quantities are calculated on the basis of the average of the last three years prior to the diagnosis or on the average of the last three approved exercises or, if not, on the effective time of supply of sanitary heating or hot water to the building concerned and the production of renewable energy during the three years preceding the diagnosis or, if not, on the basis of the last year preceding the diagnosis. The information on energy quantities is in the energy unit that presided over their purchase;
“3. The coefficients of distribution of heating and hot water charges applied to the lot.
"II.-In the case where the owner of the building is unique, the building gathers the information mentioned in I to determine the diagnosis.
"III.-The energy performance diagnosis includes:
“1. Identification of the building, lot and the living area of the building, as set out in annexes 1 and 2;
“2. A description of the thermal and geometric characteristics of the private part of the lot as well as the description of the common heating, sanitary hot water production systems of the premises, including equipment installed permanently using or producing renewable energy; this description is prepared in accordance with Appendix 1.1;
“3. a By type of energy, for common installations without individual counting, the annual average of the final amounts of energy required for heating and the sanitary hot water supply of the property, calculated from the elements referred to in 2 and 3 of this article. These quantities are expressed in the energy unit that presided over their purchase.
"By type of energy, for individual or common installations with an individual counting, the annual final energy required for heating, the production of sanitary hot water and cooling, calculated according to a standardized use of the property, expressed in kilowatt hours; the calculation is done using a conventional method.
"By an annual amount of final energy required for heating, the energy needs related to thermal depletion by the building envelope, the loss of thermal systems, the thermal depletion by air-renewal, diminished the internal intakes of the good and solar intakes.
"For buildings constructed before 1 January 1948, the annual final energy quantities required for heating and cooling referred to in the second paragraph are equal to the average of actual consumption over the last three years preceding the diagnosis or, if not, on the effective duration of heating and cooling during the three years preceding the diagnosis or, if not, the last year preceding the diagnosis. The conversion factors in kilowatt hours of the energy recorded are defined in Annex 3.1.
"When there is a fixed individual energy equipment ensuring a heating, hot water or cooling of the well-determined object, giving rise to a particular count, the corresponding final energy quantity, established on the basis of the average of the last three years preceding the diagnosis, or, if not, on the effective time of supply of heating, hot water or cooling to the building concerned for the three years prior to the diagnosis or, if not, on the last year The conversion factors in kilowatt hours of the energy recorded are defined in Annex 3.1;
“3. b By type of energy, the annual amounts of final energy resulting from the quantities mentioned in 3. a, expressed in kilowatt hours;
“3. c Annual amounts of primary energy resulting from the quantities mentioned in 3. b calculated according to the provisions of Appendix 3.2;
“3. d An assessment in euros of the annual amount of consumption costs inherent in the final energy quantities mentioned in 3. b, calculated according to the provisions of Annex 5, accompanied by the date indicated in 9;
“3. e A classification of the total amount of primary energy mentioned in 3. c, diminished of the amount of primary electric energy produced to remain calculated from the elements referred to in 3 of I of this article, according to a notated reference scale of A to G, as shown in Annex 3.3, based on the value of the ratio of this quantity to the habitable surface of the private part of the lot;
“4. a The annual indicative amount of greenhouse gases emitted into the atmosphere due to the final amount of energy for heating, sanitary hot water and cooling of the premises, expressed in equivalent amount of carbon dioxide, according to the conventions referred to in Annex 4.1;
“4. b Classification of the amount of greenhouse gases mentioned in 4. a lot according to a notated reference scale of A to G, as shown in annex 4.2, depending on the value of the ratio of this quantity to the habitable surface of the private part of the lot.
« 5. The share of the amount of renewable primary energy produced by permanently installed equipment, where this quantity can be estimated or measured;
« 6. For each boiler, the last inspection or maintenance report mentioned at the h of section R. 134-2 of the Construction and Housing Code, if required;
« 7. Recommendations for work and improvement of the thermal management of the private part of the lot and the equipment installed therein to reduce its energy consumption;
“8. The reference to the period of consumer surveys considered and, in the event that part of the calculation is performed using a conventional method, the mention of the method used and its version, personalized explanations of the elements that may lead to differences between estimated consumption and actual consumption, as well as the technical sheet defined in Annex 8;
“9. In the event that the calculation is made using a conventional method, the date of the order in force on the day of the development of the diagnosis that sets the energy prices in the table of the energy tariffs mentioned in Appendix 5;
“10.” In exceptional circumstances, for buildings constructed before 1 January 1948 or for which the totality of the heating is provided by a common equipment, in the justified absence of consumer surveys, the elements required in 3. a, 3. b, 3. c, 3. d, 3. e, 4. a, 4. b and 5 must remain virgins.
"IV.-In the event of an impossibility to distinguish the amount of energy consumed for heating and for the production of sanitary hot water, the information referred to in 3 and 5 of the III is provided for the total of the corresponding consumption.
"Art. 7.-The energy performance diagnosis is based on the model shown in Annex 6. B (high consumption).
"Art. 8.-The provisions of this chapter apply to the private parts of the lot assigned to the housing provided with individual heating and production systems of sanitary hot water or collective devices equipped with individual counting systems, and located in a collective building for main use of housing for which there is no diagnosis of energy performance in the building.
"Art. 9.-I. ― If necessary, the owner of common heating equipment, sanitary hot water of the premises, its agent or the union of co-owners, shall provide to any owner conducting an energy performance diagnosis the following:
“1. The indication of the energy used and a description of the common heating, sanitary hot water production facilities of the premises, and equipment installed permanently using or producing renewable energies; This document is prepared in accordance with Annexes 1.1 and 1.2;
“2. The total living space of the building.
"II.-The energy performance diagnosis includes:
“1. Identification of the building, lot and the living area of the building, as set out in annexes 1 and 2;
“2. A description of the thermal and geometric characteristics of the housing and its energy equipment, including the equipment installed permanently using or producing renewable energies; this description is prepared in accordance with Appendix 1;
“3. a By type of energy, the annual amounts of final energy required for heating, the production of sanitary hot water and the cooling, if any, of the private part of the lot and calculated according to a standardized use of the property, expressed in kilowatt hours; the calculation is carried out using a conventional method;
"By the amount of final energy required for heating, energy consumption related to thermal depletion by the building's envelope, the loss of thermal systems, the thermal depletion by air and ventilation, diminished the internal inputs of the house and solar intakes.
"For dwellings located in buildings constructed before January 1, 1948, the annual final energy required for heating and cooling referred to in the first paragraph is equal to the average of actual consumption over the last three years of the diagnosis or, if not, the effective duration of heating or cooling during the three years preceding the diagnosis or, if not, on the basis of the last year preceding the diagnosis. The conversion factors in kilowatt hours of the energy recorded are defined in Annex 3.1;
“3. b Primary energy quantities by type of use resulting from the final energy quantities mentioned in 3. a, calculated according to the provisions of Annex 3.2;
“3. c An assessment in euros of the annual amounts of the consumption costs inherent in the final energy ratios mentioned in 3. a, calculated according to the provisions of Annex 5, accompanied by the date indicated in 9;
“3. d A classification of the ratio of the total amount of primary energy referred to in 3. b, diminished of the amount of primary electric energy produced to remain calculated from the elements referred to in 3 of I of this article, on the habitable surface of the private part of the lot according to a reference scale noted from A to G, as shown in Annex 3.3;
“4. a The annual indicative amount of greenhouse gas emitted into the atmosphere due to the final energy ratios mentioned in 3. a, expressed in equivalent amount of carbon dioxide, in accordance with the conventions referred to in Annex 4.1;
“4. b A classification of the annual greenhouse gas quantity mentioned in 4. a according to a notated reference scale of A to G, as shown in annex 4.2, depending on the value of the ratio of this quantity to the habitable surface of the private part of the lot;
« 5. The share of the amount of renewable primary energy produced by permanently installed equipment, where this quantity can be estimated or measured;
« 6. For each boiler, the last inspection or maintenance report mentioned at the h of section R. 134-2 of the Construction and Housing Code, if required;
« 7. Recommendations for work and improvement of the thermal management of the private part of the lot;
“8. In the event that the calculation is made using a conventional method, the reference to the method used and its version, personalized explanations on the elements that may lead to differences between the estimated consumption and the actual consumption, as well as the technical sheet defined in Annex 8; otherwise mention of the period of consumer surveys;
“9. In the event that the calculation is carried out using a conventional method, the date of the order in force on the day of the development of the diagnosis that sets the energy prices in the table of the energy prices mentioned in Schedule 5.
“10.” On an exceptional basis, for dwellings located in buildings built before 1 January 1948, in the absence of consumer surveys, the elements required in 3. a, 3. b, 3. c, 3. d, 4. a, 4. b and 5 must remain virgins.
"III.-In the event of an impossibility to distinguish the amount of energy consumed for heating and for the production of sanitary hot water, the information referred to in 3 and 5 of I is provided for the total of the corresponding consumption.
"Art. 10.-The energy performance diagnosis is based on the choices made, according to model 6. A (conventional method) or model 6. B (consumption reported in Annex 6.
"Art. 11.-The provisions of this chapter apply to collective buildings for primary use of housing, whether they are equipped with a collective or individual heating mode, and for which an energy performance diagnosis has not been established for the whole building.
"Art. 12.-The energy performance diagnosis for a whole building includes the following:
“1. The identification of the building and its living space, as set out in annexes 1 and 2;
“2. A description of the thermal and geometric characteristics of the building and its energy equipment, including the equipment installed on a permanent basis using or producing renewable energies; this description is prepared in accordance with Appendix 1;
“3. a By type of energy, the annual amounts of final energy required for heating, the production of sanitary hot water and cooling, calculated according to a standardized use of the building, expressed in kilowatt hours; the calculation is done using a conventional method.
"By the amount of final energy required for heating, the energy needs related to thermal depletion by the building's envelopment, the loss of thermal systems, the thermal depletion by air-renewal, reduced internal intakes and solar intakes.
"For buildings constructed before 1 January 1948, the annual final energy quantities required for heating and cooling referred to in the first paragraph are equal to the average of actual consumption over the last three years prior to the diagnosis or, if not, on the effective duration of heating or cooling during the three years preceding the diagnosis or, if not, on the basis of the last year preceding the diagnosis. For these buildings, where there is a fixed individual energy equipment ensuring a heating, hot water or cooling of the object of the diagnosis, giving rise to a particular count, the corresponding final energy quantity, established on the basis of the average of the last three years prior to the diagnosis, or failing on the effective time of supply of heating, hot water or cooling to the building concerned for the three years prior to the diagnosis or, if not, The conversion factors in kilowatt hours of the energy recorded are defined in Annex 3.1;
“3. b By energy type, the annual final energy quantities referred to in 3. expressed in kilowatt hours; the conversion factors in kilowatt hours of the energy recorded are defined in Annex 3.1;
“3. c Annual amounts of primary energy resulting from the quantities mentioned in 3. b, calculated according to the provisions of Annex 3.2;
“3. d An assessment in euros of the annual amounts of the consumption costs inherent in the final energy quantities mentioned in 3. b, calculated according to the provisions of Annex 5, together with the date mentioned in 9;
“3. e A classification of the total amount of primary energy mentioned in 3. c, diminished of the amount of primary electricity produced at home, according to a reference scale noted from A to G in Annex 3.3, depending on the value of the ratio of this quantity to the living space of the building;
“4. a The annual indicative amount of greenhouse gases emitted in the atmosphere due to the final energy quantities mentioned in 3. a, expressed in equivalent amount of carbon dioxide, in accordance with the conventions referred to in Annex 4.1;
“4. b A classification of the annual greenhouse gas quantity mentioned in 4. a according to a notated reference scale of A to G as set out in Annex 4.2 depending on the value of the ratio of this quantity to the living space of the building;
« 5. The share of the amount of renewable primary energy produced by permanently installed equipment, where this quantity can be estimated or measured;
« 6. For each boiler, the last inspection or maintenance report mentioned at the h of section R. 134-2 of the Construction and Housing Code, if required;
« 7. Recommendations for work and improvement of the building's thermal management to reduce energy consumption;
“8. In the event that the calculation is made using a conventional method, the reference to the method used and its version, personalized explanations on the elements that may lead to differences between the estimated consumption and the actual consumption, as well as the technical sheet defined in Annex 8; otherwise mention of the period of consumer surveys;
“9. In the event that the calculation is made using a conventional method, the date of the order in force on the day of the development of the diagnosis that sets the energy prices in the table of the energy tariffs mentioned in Appendix 5;
“10.” In exceptional circumstances, for buildings constructed before January 1, 1948, in the justified absence of consumer surveys, the elements required for 3. a, 3. b, 3. c, 3. d, 3. e, 4. a, 4. b and 5 must remain virgins. »
"Art. 14.-The provisions of this chapter apply to the private parts of the lot assigned to the housing and located in a collective building for primary use of housing, whether it is provided with a collective or individual heating mode, and for which an energy performance diagnosis has been established for the whole building under the conditions set out in sections 11 to 13.
"Art. 15.-The energy performance diagnosis of the lot in question includes the following:
“1. Identification of the building, lot and the living area of the building, as set out in annexes 1 and 2;
“2. A description of the thermal and geometric characteristics of the housing and its energy equipment, including the equipment installed permanently using or producing renewable energies; this description is set out in Appendix 1.
"In the event that the energy consumption of the building is provided by common heating or hot water production equipment, the description of these equipment is included.
“3. a By type of energy, the amount of final energy required for heating, the production of sanitary hot water and the cooling of the property, calculated from the annual final energy ratios required for heating, the production of sanitary hot water and the cooling resulting from the diagnosis of energy performance established for the whole building;
“3. b Primary energy quantities per consumption type resulting from the final energy quantities mentioned in 3. a, calculated according to the provisions of Appendix 3.2.
“3. c An assessment in euros of the annual amounts of the consumption costs inherent in the final energy ratios mentioned in 3. a, calculated according to the provisions of Annex 5, accompanied by the date indicated in 9;
“3. d A classification of the amount of primary energy mentioned in 3. b, diminished of the ratio of the quantity of primary electric energy produced to remain on the living surface of the building, according to a reference scale noted from A to G indicated in Annex 3.3, depending on the value of the ratio of this quantity to the living surface of the building;
“4. a The annual indicative amount of greenhouse gas emitted into the atmosphere due to the final energy ratios mentioned in 3. a, expressed in equivalent amount of carbon dioxide, in accordance with the conventions referred to in Annex 4.1;
“4. b A classification of the annual greenhouse gas quantity mentioned in 4. a according to a notated reference scale of A to G as set out in Annex 4.2 depending on the value of the ratio of this quantity to the living space of the building;
« 5. The share of the amount of renewable primary energy produced by permanently installed equipment, where this quantity can be estimated or measured;
« 6. For each boiler, the last inspection or maintenance report mentioned at the h of section R. 134-2 of the Construction and Housing Code, if required;
« 7. Recommendations for work and improvement of the thermal management of the private part of the lot;
“8. In the event that the calculation is made using a conventional method, the reference to the method used and its version, personalized explanations on the elements that may lead to differences between the estimated consumption and the actual consumption, as well as the technical sheet defined in Annex 8; otherwise mention of the period of consumer surveys;

"Art. 16.-The energy performance diagnosis is based on the choices made, according to model 6. A (conventional method) or model 6. B (consumption reported in Annex 6. »

Annexes 6 and 7 to the above-mentioned decision of 3 May 2007 are replaced by the provisions of the annexes to this Order.

1° As a transitional measure, the energy performance diagnosis may, by 31 December 2012, be established according to the provisions of the 3 May 2007 order referred to in its version prior to its amendment by this Order.
2° For valid certifications, whose effective date is prior to March 30, 2008, the expiry date of the certification, resulting from the application of 3.2.2 of Schedule 1 to the above-mentioned decision of October 16, 2006, may be extended without it being after March 30, 2013, to allow, inter alia, the inclusion of this Order in the competency assessment at the recertification.
