Order of February 20, 2012 amending the order of November 12, 2009 relating to the recognition of qualification prior to registration in the table of the order of expert geometers

Considering Directive 2005/36/EC of the European Parliament and the Council of 7 September 2005 on recognition of professional qualifications;
Vu la Act No. 46-942 of 7 May 1946 Amending the order of the expert geometers, including 4° (b) of Article 3;
Vu le Decree No. 96-478 of 31 May 1996 amended to regulate the profession of expert geometer and code of professional duties, including articles 7 to 15;
Vu le Decree No. 2010-1406 of 12 November 2010 relating to the Government ' s degree of land expert, including article 9;
In view of the decision of 12 November 2009 on recognition of qualification prior to registration in the table of the order of the expert geometers;
In the light of the opinion of the Conseil supérieur de l'ordre des géomètres experts dated 12 October 2011,

Article 1 of the 12 November 2009 decision on recognition of qualification prior to registration in the table of the order of the expert geometers is as follows:
"The national of a Member State of the European Union or a party to the Agreement on the European Economic Area, or the natural person exercising or empowering to practise this profession in the territory of a State or an infra-state entity whose competent authorities have concluded an agreement of mutual recognition of professional qualifications with the order of the expert geometers, who wishes to be recognized as qualified in application of the provisions of articles 7 to 15 of the decree of 31 May 1996 referred to above the request to the Minister responsible for urban planning. This application is accompanied by a duplicate file containing the following documents:
1° A civil registration form and a certificate of nationality or any document justifying identity and nationality issued by the competent authority of the State of origin of the applicant. These parts must not have more than three months of date during their production;
2° A copy of the diplomas, certificates or titles attesting to the training received with a description of the content of the studies and the courses carried out during the training with the number of hours corresponding;
3° Where applicable, a statement of knowledge acquired by the applicant during his or her professional experience;
4° Depending on the case:
- the indication that the certificate of competence or the title of training are those that a State, a member of the European Union or a party to the agreement on the European Economic Area and other than France or a State or an infra-state entity whose competent authorities have concluded an agreement of mutual recognition of professional qualifications with the order of the expert geometers prescribed to access the profession of expert geometer in its territory or for the
- the justification that the applicant has legally exercised full-time for two years in the last ten years the profession of expert geometer in a Member State of the European Union or a party to the agreement on the European Economic Area that does not regulate this profession;
- the indication that the applicant's training is regulated.
The application is in French. The documents mentioned in the 2nd to 4th are accompanied, as necessary, of their translation into the French language prepared by a translator registered on the national list of judicial experts or on one of the lists of judicial experts drawn up by the appeal courses or by a translator authorized to intervene with the judicial or administrative authorities of another Member State of the European Union or party to the agreement on the European Economic Area or a competent entity or »

Article 5 of the 12 November 2009 decision on recognition of qualification prior to registration in the table of the order of the expert geometers is as follows:
"The aptitude test provided for in Articles 7-1 (III), 11 to 13 and 15 of the decree of 31 May 1996 referred to above is the presentation and discussion of a file that may, if any, support the candidate's professional experience and the skills required for the exercise of the activities described in 1st of Article 1 of Law No. 46-942 of 7 May 1946 modified as well as those related to the evolution of the profession. The file is given to the interested party one hour before the presentation and discussion before the jury. During the discussion of the file, the jury, in particular, ensures the knowledge of the ethics applicable to the expert geometer profession.
The Jury of the suitability test came from the jury of the trial of the defense of the memory to the certificate of land expert geometer issued by the Government of the current session at the time of the suitability test and scheduled for the trialArticle 9 of Decree No. 2010-1406 of 12 November 2010.
The jury made the results of the suitability test known to the Minister responsible for urban planning. »
