Judgment of 9 February 2012 on the National Observatory of the Slaughterhouses

The purpose of this Order is to define the composition, missions and mode of operation of the observatory of the slaughter establishments provided for in Article D. 654-8 of the Rural and Maritime Fisheries Code, named "National Observatory of Slaughterhouses".

The National Slaughterhouse Observatory is a forum for reflection, analysis and proposal. It can provide advice and policy guidance in the economic, health, technical, social and societal fields.
Its specific tasks include:
― monitoring of the slaughter activity in France by means of relevant indicators, analysis of developments and their consequences;
- proposals for strategic directions in economic, health and technical matters;
information and discussion of regulatory developments and analysis of their consequences;
- monitoring audits;
– expertise on social, societal and ethical issues related to slaughter activity;
― developing advisory opinions in working groups.

The field of the National Observatory of Slaughterhouses is that of slaughtering butchery animals as well as poultry and rabbits. The slaughter rooms on the farm are not part of the scope of competence of the National Slaughter Centre.

The National Slaughterhouse Observatory has a steering committee and a secretariat as well as a database of all useful technical-economic information by abattoir.

The chair of the steering committee of the National Slaughterhouse Observatory is appointed by order of the Minister for Agriculture and the Minister for Territorial Communities for a period of three years renewable.

In addition to its chair, the steering committee includes:
1° Nine representatives of the public authorities:
– the Director General of Agricultural, Agri-Food and Territories Policy at the Ministry of Agriculture or its representative;
– the Chief Food Officer at the Ministry of Agriculture or his representative;
– the Director General of Local Authorities at the Ministry of Territorial Communities or its representative;
– the Director General of FranceAgriMer or his representative;
- the head of the Statistics and Forward-looking Service to the General Secretariat of the Ministry of Agriculture or its representative;
– the Director General of Risk Prevention at the Ministry of Ecology, Sustainable Development, Transport and Housing or his representative;
– the Director General of Public Finance at the Ministry of Budget, Public Accounts and State Reform or his representative;
a representative of the grouping of the regional branches of food, agriculture and forest (DRAAF);
– a representative of the grouping of departmental directorates of social cohesion and population protection (DDCSPP).
2° Sixteen representatives of the agricultural and agri-food sectors:
five representatives of agricultural production;
- two representatives of the marketing sector;
– five representatives of the meat industry;
two representatives of trade and distribution;
two representatives of the interprofessionals.
3° Three other members:
– a representative of local communities that own slaughterhouses;
a representative of public and private slaughterhouse workers;
a representative of national consumer associations.
4° Designated personalities because of their particular skills or functions as required.
The members of the steering committee of the National Observatory for Slaughterhouses, other than those mentioned in the 1°, are appointed for a renewable period of three years by order of the Minister for Agriculture and the Minister for Territorial Communities. Except for personalities provided at 4°, an alternate is appointed for each member under the same conditions.
The replacement of the members is done under the conditions defined by theArticle 4 of Decree No. 2006-672 of 8 June 2006 on the establishment, composition and functioning of consultative administrative commissions.
The member's function does not open any remuneration or reimbursement of travel expenses.

The Steering Committee of the Observatory of the Slaughterhouses meets twice a year under the conditions defined by theArticle 5 of Decree No. 2006-672 of 8 June 2006 on the establishment, composition and functioning of consultative administrative commissions. Working groups can be established to deal with issues on certain topics. External experts can be associated as necessary. The meetings are not public.
It shall establish a rules of procedure in which the provisions of this order are recalled and may be specified. Each year, an activity report is produced in which will include the analysis of the evolution of the selected indicators and a work programme for the next year.
The steering committee may decide to proceed with the hearing of any outside person under the conditions defined by theArticle 6 of Decree No. 2006-672 of 8 June 2006 on the establishment, composition and functioning of consultative administrative commissions.
The members of the steering committee shall be held in professional secrecy for the facts, acts and information that they may have known because of their duties.

The Secretariat of the National Observatory for Slaughterhouses is provided by the public institution FranceAgriMer defined in article L. 621-1 of the Rural and Maritime Fisheries Code and also in charge of the constitution and updating of the database.
The access conditions to the database will be defined by the rules of procedure.

The Director General of Agricultural, Agri-Food and Territorial Policies at the Ministry of Agriculture, Food, Fisheries, Rurality and Land Management and the Director General of Local Authorities at the Ministry of Territorial Communities are responsible, each with regard to the execution of this Order, which will be published in the Official Journal of the French Republic.
