Decree No. 2012-143 of 30 January 2012 on the nutritional quality of meals served as part of the health facilities restoration services

Publics concerned: managers of health facility restoration services.
Purpose: Nutritional quality of meals served as part of health facilities restoration services.
Effective July 1, 2013.
Notice: the decree sets out the principles to be followed by health-care facilities to ensure sufficient nutritional quality of meals and refers to an interdepartmental order to specify these requirements.

This decree is taken for the application of Article L. 230-5 of the Rural Code and the Maritime Fishing, from theArticle 1 of Act No. 2010-874 of 27 July 2010 modernization of agriculture and fisheries.
The Prime Minister,
On the report of the Minister of Agriculture, Food, Fisheries, Rurality and Land Management and the Minister of Labour, Employment and Health,
In view of the rural code and maritime fisheries, including its article L. 230-5;
Vu le Public Health Codeincluding article L. 6111-3;
In light of the opinion of the Local Finance Committee (the Standards Assessment Advisory Board) of 5 January 2012,
Decrete:

Section 3 of the preliminary chapter of Book II title III of the Rural Code and Maritime Fisheries Act is amended as follows:
1° Article D. 230-27 becomes Article D. 230-30.
2° The section is supplemented by the following:
"Art. D. 230-27. - In order to achieve the objective of nutritional balance of the meals served by the health care services, are required in accordance with Article L. 230-5:
" — respecting minimum requirements for variety of dishes served;
“– four or five dishes offered at each lunch or dinner;
"– the adaptation of the dishes offered to the tastes, and to the health of the patients;
"– Respecting requirements for size of portions and frequency of meals.
"The provisions of this Article, which do not fall within the scope of the social and mediocial services and facilities established and managed under theArticle L. 6111-3 of the Public Health Code, are specified by a joint decree of ministers responsible for food, health, consumption, defence, overseas and local authorities. »
