Notice: the decree, specific to the Council of State and the National Court of the Right of Asylum, follows the institution by the Decree No. 2011-1026 of 26 August 2011 of technical committees to the Vice President of the Council of State, the Secretary General of the Council of State and the President of the National Court of the Right of Asylum. He established a committee on hygiene, security and working conditions for the services of the State Council and a committee on hygiene, security and working conditions of the services of the National Court of the Right of Asylum. These two committees replace the special hygiene and security committees established by the Order of May 26, 2009. With regard to the powers of the two committees of hygiene, security and special working conditions thus created, the decree refers to provisions of title IV of Decree No. 82-453 of 28 May 1982 amended to address occupational health and safety as well as medical prevention in the public service.

Vu le Decree No. 82-453 of 28 May 1982 amended on occupational health and safety and on medical prevention in the public service;
Vu le Decree No. 2011-184 of 15 February 2011 relating to technical committees in government departments and public institutions of the State;
Vu le Decree No. 2011-1026 of 26 August 2011 establishing technical committees with the Vice-President of the Council of State, the Secretary General of the Council of State and the President of the National Court of Asylum Law;
Considering the advice of the technical committee placed with the Vice-President of the Council of State of 16 December 2011;

Decrete:
It is established with the Secretary General of the Council of State, who chairs it, a committee of hygiene, security and working conditions of the services of the Council of State which, subject to the provisions of this decree, is governed by the Title IV of the decree of 28 May 1982 referred to above.
The Committee on Hygiene, Safety and Working Conditions of the Services of the Council of State shall assist the special technical committee referred to in thearticle 4 of the decree of 26 August 2011 referred to above.
The Committee on Hygiene, Safety and Working Conditions of the Services of the Council of State shall include, in addition to the Secretary General of the Council of State, the Director of Human Resources and five representatives of the incumbent staff and five representatives of the alternate staff, as specified in the conditions provided for in the Title IV of the decree of 28 May 1982 referred to above.
It is established with the President of the National Court of Asylum Law, who chairs it, a committee of hygiene, security and working conditions of the services of the National Court of Asylum Law, which, subject to the provisions of this decree, is governed by the provisions of this Decree. provisions of title IV of the decree of 28 May 1982 referred to above.
The Committee on Hygiene, Safety and Working Conditions of the Services of the National Court of Asylum Law is assisting the special technical committee referred to in thearticle 5 of the decree of 26 August 2011 referred to above.
The Committee on Hygiene, Safety and Working Conditions of the Services of the National Court of Asylum Law includes, in addition to the President of the National Court of Asylum Law, the Secretary General and five representatives of the incumbent staff and five representatives of the alternate staff, designated under the conditions provided for in the Title IV of the decree of 28 May 1982 referred to above.
The Order of May 26, 2009 on the Joint Technical Committees and the Hygiene and Safety Committees of the State Council and the National Court of Asylum Law is repealed as it concerns the hygiene and security committees.
The guard of the seals, Minister of Justice and Freedoms, and the Minister of Public Service are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
