Considering the application submitted on 17 December 2009 by the National Agency for the Management of Radioactive Waste and the file accompanying this application;
Considering the opinion of the Environmental Authority of 22 July 2010;
Considering the findings of the public inquiry conducted from 26 October to 30 November 2010;
Considering the opinions of the Champagne-Ardenne Regional Council and the General Councils of the departments of the Meuse and the Haute-Marne;

Taking into account the administrative conference of 12 October 2010;
Considering the advice of the prefect of the department of the Meuse, coordinator of the public inquiry, dated 7 February 2011;
Considering the results of the consultation of the local information and monitoring committee of the Bure underground research laboratory;

Decrete:
The National Agency for the Management of Radioactive Waste is authorized to operate in the territory of the commune of Bure (Department of the Meuse) an underground laboratory to conduct research on deep geological formations where radioactive waste could be stored, under the conditions defined by the application of 17 December 2009 referred to above and in the file attached to the latter.
The National Agency for the Management of Radioactive Waste, as an operator of the underground laboratory, complies with the requirements of sections R. 542-20 to R. 542-24 of the Environmental Code as well as those of this decree and the attached specifications.
The underground laboratory authorized by this Order consists of a set of works and equipment including:
- surface installations;
- the wells between the surface and the underground installations;
- underground installations.
The exclusive legal perimeter provided for in Article L. 542-8 of the Environmental Code is indicated on the plan at 1/5000 annexed to this Order. The operator is authorized to undertake underground work and dispose of the materials extracted during this work within this scope.
The owners of the land located within this perimeter are compensated under the conditions set out in the specifications annexed to this Order.
The protection perimeter provided for in Article L. 542-9 of the Environmental Code shall be constituted, in accordance with the plan of the 1/25,000 annexed to this Order, by a polygon whose summits are defined as follows:

The purpose of the investigation, testing and testing in the underground laboratory is to gather the data necessary for the operation of a possible storage of deep geological radioactive waste, in accordance with the safety requirements and the principle of reversibility applicable to this facility. They will include:
― deepening the knowledge of physico-chemical, mechanical and thermal phenomena within storage;
― continue the study of the expansion of storage disturbances, assess the behavior of disrupted argilites and the behaviour of materials to interfaces;
― confirm the results of the study of the containment capabilities of the so-called "callovo-oxfordian" geological formation and characterize the existing argilites;
• Evaluate the conditions of transfer by observing the hydro-geological context in the duration;
― to develop, optimize and develop methods for the construction and operation of storage;
― developing methods for sealing works and shaking galleries;
― develop and develop observation and monitoring methods, including for the reversible management of storage;
― acquire the experience necessary for the construction and operation of a storage.
The operator defines and implements a controlled set of planned and systematic actions, based on written and archived procedures, which:
― covers all aspects related to the design, construction and operation of the laboratory as well as those related to the acquisition and analysis of data collected during the investigations, experiments, research and testing;
― ensures an appropriate level of quality for investigations, experiments, research and testing as well as the analysis of data useful to the demonstration of safety of any storage;
― ensures the collection of the return of design, construction and operation experience as well as events that may be of interest in the design, construction and operation of a potential storage.
In particular, the operator exercises monitoring and control of the actions of manufacturers, designers, suppliers and other subcontractors in the design, production and operation of wells, galleries and equipment of the laboratory as well as in the associated experiments and tests.
The operator shall report annually on the status of the work planned for the operation of the laboratory to the Ministers responsible for nuclear safety and to the National Evaluation Commission referred to in Article L. 542-3 of the Environmental Code. It sends a copy of this report to the Nuclear Safety Authority.
The installation is operated in such a way that its use may not be at the origin of odors, noises or vibrations that may constitute an obstacle to the tranquility of the neighborhood.
The supervision of the facility referred to in section 1 is exercised under the authority of the prefect of the Meuse.
This monitoring concerns compliance with the general technical regulations applicable to the laboratory, the provisions contained in this decree and the annexed specifications and the requirements imposed on the operator pursuant to this decree.
This authorization is granted until December 31, 2030.
In the event of a final termination of activity on the site, the operator will have to put it in a state compatible with the future use determined jointly with the mayor of the municipality on the territory of which the facility is located, or the president of the competent public intercommunal cooperation institution in urban planning and, if it is not the operator, the owner of the land on which the facility is located or, if not, the terms described in the notice
The provisions of this Decree come into force on 1 January 2012.
The Minister of Ecology, Sustainable Development, Transport and Housing, the Minister of Economy, Finance and Industry, the Minister of Higher Education and Research and the Minister to the Minister of Economy, Finance and Industry, responsible for the industry, energy and the digital economy, are responsible, each with respect to it, for the execution of this Official Gazette, which will be published in the French Republic.
