Decree No. 2011-1140 of 21 September 2011 on the special status of the body of specialized librarians

Public officials involved: officials from the library assistants and the specialized assistant librarians.
Subject: merging of the body of library assistants and the body of specialized assistant librarians within a new body of specialized assistant librarians.
Effective October 1, 2011.
Notice: The purpose of the decree is to implement the fusion of the body of library assistants and the body of specialized assistant librarians within a new body of specialized assistant librarians. It defines the missions that will be devolved to the specialized assistant librarians by distinguishing the upper class and the exceptional class, which require a higher level of expertise in line with the diplomas or professional experience required for access to these two grades. It also provides some additional information on how to recruit and reclassify the body of specialized assistant librarians. Finally, the new body of specialized assistant librarians, category B body, is integrated into the new statutory space governed by the Decree No. 2009-1388 of 11 November 2009 bringing statutory provisions common to various bodies of civil servants in category B of the public service of the State.

Vu le Decree No. 82-451 of 28 May 1982 amended on parity administrative commissions;
Vu le Decree No. 88-646 of 6 May 1988 amended with respect to the statutory provisions applicable to library store bodies;
Vu le Decree No. 92-29 of 9 January 1992 amended with special status of the body of librarians;
Vu le Decree No. 94-1016 of 18 November 1994 Amending the common statutory provisions applicable to various staff in category B;
Vu le Decree No. 2005-1191 of 21 September 2005 amended on the evaluation and appraisal of some officials of the Ministry of National Education, Higher Education and Research;
Vu le Decree No. 2007-196 of 13 February 2007 amended on the qualification equivalencies required to compete in public service access competitions and employment frameworks;
Vu le Decree No. 2007-1780 of 17 December 2007 relating to the management of library staff under the Minister for Higher Education;
Vu le Decree No. 2009-1388 of 11 November 2009 amended with common statutory provisions applicable to various bodies of officials of category B of the public service of the State;
Vu le Decree No. 2010-1743 of 30 December 2010 relating to the extension and reduction of the term of office of members of certain representative bodies of the public service staff of the State;
Considering the advice of the Departmental Joint Technical Committee of the Ministry of Higher Education and Research dated February 11, 2011;

    The body of specialized assistant librarians, classified in category B under section 29 of the above-mentioned Act of 11 January 1984, is governed by the provisions of the decree of 11 November 2009 referred to above and this decree.
    It is an interdepartmental body under the responsibility of the minister responsible for higher education.

    The body of specialized assistant librarians includes three grades so called:
    1° Bibliothecaires assistants of normal class;
    2° Competent librarians of higher class;
    3° Extraordinary specialised librarians.
    These grades are assimilated to the first, second and third grades mentioned by the decree of 11 November 2009 referred to above.

    I. ― Specialized assistant librarians carry out specialized tasks in the field of the processing and conservation of collections of all kinds and in their documentary management. They make documentary resources available to the public. They welcome, inform and inform users.
    They may also be responsible for the management of stores, places accessible to the public and materials, including access to information materials. They are designed to supervise the shopkeepers. They may be assigned security functions, premises and collections.
    II. ― Higher-class assistant librarians and special-class assistant librarians are designed to perform specialized tasks requiring special professional qualification.
    They can include reporting and indexing documents, conducting bibliographical and documentary research, coordinating current technical work. They participate in the reception of users, their training and professional training in their area of competence, as well as in tasks related to cultural action and the valorization of funds. They participate in the public reception.

    Specialized assistant librarians are recruited, appointed and managed by the Minister for Higher Education.
    They mainly carry out their duties in public libraries, services or institutions under the Ministry of Higher Education and, where applicable, in other departmental departments or public institutions.

  • Chapter II: Recruitment
    • Section 1: Recruitment provisions in the grade of regular-class assistant librarian Article 5 Learn more about this article...


      I. ― Assistant librarians of normal grade are recruited:
      1° Through external competitions on trials:
      This competition is open to candidates with a bachelor's degree or a degree or a degree classified at least level IV, or a qualification recognized as equivalent to one of these titles or diplomas under the conditions fixed by the decree of 13 February 2007 referred to above ;
      2° Internal competitions on trials:
      This competition is open to officials and agents of the State, territorial authorities and public institutions that depend on it, including those mentioned in theArticle 2 of Act No. 86-33 of 9 January 1986 bringing statutory provisions relating to the hospital public service, the military and the incumbents in an intergovernmental international organization on the closing date of registration with at least four years of public service as of 1 January of the year for which the competition is held.
      This competition is also open to candidates justifying four years of service to an administration, agency or institution referred to in the third paragraph of the second paragraph of Article 19 of the Law of 11 January 1984 referred to above, under the conditions laid down in that paragraph;
      3° A choice after registration on a fitness list established after notice of the parity administrative commission:
      Can be listed on this aptitude list for library stores governed by the decree of 6 May 1988 referred to above and justifying at least nine years of public services.
      II. ― provisions of articles 5 and 8 of the decree of 11 November 2009 referred to above are applicable to competitions mentioned in 1° and 2° of I.

      The number of seats offered at one of the competitions cannot be less than 40% of the total number of seats offered at both competitions.

      Places offered to contests that would not have been filled by the nomination of candidates for one of these contests may be awarded to the other contest. This postponement may result in the fact that the number of places offered to one of the contests is greater than two thirds of the number of places offered to the two contests.

      Candidates received at the contests mentioned in 1° and 2° of I of Article 5 shall be appointed and titularized according to the terms provided for in the I, III, IV and V of Article 11 of the decree of 11 November 2009 referred to above.

      I. ― Assistant librarians at the senior level are recruited:
      1° Through external competitions on trials:
      This competition is open to candidates with a title or degree classified at least level III, in the field of the book, libraries, documentation, scientific and technical information, or to candidates with a recognized qualification equivalent to one of these titles or diplomas, under the conditions fixed by the decree of 13 February 2007 referred to above ;
      2° Internal competitions on trials:
      This competition is open to officials and agents of the State, territorial authorities and public institutions that depend on it, including those mentioned in theArticle 2 of Act No. 86-33 of 9 January 1986 bringing statutory provisions relating to the hospital public service, the military and the incumbents in an intergovernmental international organization on the closing date of registration with at least four years of public service as of 1 January of the year for which the competition is held.
      This competition is also open to candidates for four years of service to an administration, agency or institution referred to in the third paragraph of the 2nd paragraph of the law of 11 January 1984 referred to above, subject to the conditions laid down in that paragraph;
      3° Through a professional examination accessible to library shoppers governed by the decree of 6 May 1988 referred to above and justifying, as of January 1 of the year in which appointments take place, eleven years of public service.
      II. ― provisions of articles 7 and 8 of the decree of 11 November 2009 referred to above are applicable to competitions mentioned in 1° and 2° of I.

      The number of places offered to the internal competition cannot exceed 50 per cent of the total number of places offered to both competitions.

      Places offered to contests that would not have been filled by the nomination of candidates for one of these contests may be awarded to the other contest, within 20% of all places offered to both contests.

      Candidates received at the contests mentioned in 1° and 2° of I of Article 9 shall be appointed and titularized according to the terms provided for in the III, IV and V of Article 11 of the decree of 11 November 2009 referred to above.

      The officers recruited pursuant to 1° and 2° of I of Article 5 and 1° and 2° of I of Article 9 of this Order shall be appointed by order of the Minister responsible for higher education as a trainee.
      They perform a one-year internship during which they receive training.
      The organization of the internship period is determined by order of the Minister for Higher Education and the Minister for Public Service.

      Staff recruited pursuant to 3° of Article 5 and 3° of Article 9 shall be held in accordance with provisions of article 12 of the decree of 11 November 2009 referred to above.

      The total number of appointments that may be pronounced under 3° of Article 5 and 3° of Article 9 of this Decree shall not exceed two fifths of the total number of appointments made pursuant to 1° and 2° of Article 5 and 1° and 2° of Article 9 of this Decree, long-term detachments and direct integrations.

    I. ― The specialized assistant librarians recruited under Article 5 of this Decree shall be classified in accordance with the provisions of Articles 13 to 20 and 23 of the decree of 11 November 2009 referred to above.
    II. ― The specialized assistant librarians recruited pursuant to Article 9 of this Decree shall be classified in accordance with the provisions of Articles 21 to 23 of the decree of November 11, 2009.

    I. ― Civil civil servants belonging to a body or framework of employment classified in category B or equivalent level may be detached, then, if any, integrated, or directly incorporated into the body of specialized assistant librarians in accordance with provisions of articles 28 to 30 of the decree of 11 November 2009 referred to above.
    Integrated officials directly or seconded can benefit from an adaptive training cycle to their new functions.
    Direct integration or integration after a detachment is pronounced by order of the minister responsible for higher education.
    II. ― During their detachment, detached officials assist, for the advancement of rank and level, with officials of the specialized librarian corps.
    III. ― Services performed in the body, employment framework or employment of origin are considered to be services performed in the body of specialized assistant librarians.

    I. ― On the date of entry into force of this decree, the specialized assistant librarians governed by the Decree No. 92-30 of 9 January 1992 Amended with special status of the body of specialized assistant librarians are integrated and reclassified into the body of specialized assistant librarians, in accordance with the following correspondence table:

    I. ― Officials detached from the body of library assistants or in the body of specialized assistant librarians are placed, at the date of entry into force of this decree, in a detachment position in the body of specialized assistant librarians, for the duration of their detachment remaining to run. They are classified in this body in accordance with the provisions of articles 21 and 22 of this decree.
    II. ― Interested persons retain the reductions and increases of seniority granted and not used for a level advancement in their former body.
    III. ― The services performed by the concerned in the position of detachment in the body of library assistants or in the body of specialized assistant librarians as well as in the ranks of these bodies are assimilated to services performed in the position of detachment in the body of specialized assistant librarians as well as in the ranks of this body.

    Specialized assistant librarians and assistants of interns libraries continue their training in the specialized assistant librarians, as assistant librarians specialized interns.

    I. ― Access to the body of library assistants whose opening order was issued before the date of entry into force of this decree continues until their end.
    The winners of these contests, whose appointment has not been made in the body to which the contest gives access before the date of entry into force of this decree, are appointed as a trainee in the rank of assistant librarian of normal class.
    Complementary lists prepared by the jury of the above-mentioned contests may be used to fill vacancies in the rank of regular-class assistant librarian.
    II. ― Access to the body of the specialized assistant librarians whose opening order was issued before the date of entry into force of this decree continues until their end.
    The winners of these contests, whose appointment has not been made in the body to which the contest gives access before the date of entry into force of this decree, are appointed as a trainee in the body of the specialized assistant librarians taking into account the situation that would have been theirs if they had been previously appointed to the body of the assistant librarians specialized in accordance with the provisions of the Decree No. 92-30 of 9 January 1992 having a special status of the body of the specialized assistant librarians in force on the date of publication of this decree and then classified on the date of their appointment in accordance with the provisions of Article 21 of this Decree.
    Complementary lists prepared by the jury of the above-mentioned contests can be used to fill vacancies in the body of specialized assistant librarians.

    I. ― Libraries stores governed by the provisions of the decree of 6 May 1988 referred to above Registered on a fitness list established under 2011 for access to the body of library assistants, pursuant to section 26 of the above-mentioned Act of 11 January 1984, may be appointed to the rank of regular-class assistant librarian.
    II. ― Assistants of registered normal-class libraries, before the date of entry into force of this decree, on a fitness list established under 2011 for access to the body of specialized assistant librarians, pursuant to section 26 of the above-mentioned Act of 11 January 1984, may be appointed as a Senior Assistant Librarian.
    Assistants to the higher-class libraries and assistants to the registered exceptional-class libraries, before the date of entry into force of this decree, on a list of aptitudes for access to the body of the specialized assistant librarians, pursuant to section 26 of the above-mentioned Act of 11 January 1984, may be appointed as an assistant librarian of exceptional class.
    III. ― Agents referred to in II are appointed to the body of the specialized assistant librarians taking into account the situation that would have been theirs if they had been previously appointed to the body of the assistant librarians specialized under the provisions of the Decree No. 92-30 of 9 January 1992 having a special status of the body of the specialized assistant librarians in force on the date of publication of this decree and then classified on the date of their appointment in accordance with the provisions of Article 21 of this Decree.

    Contractual officers recruited pursuant to section 27 of the above-mentioned Act of 11 January 1984, whose purpose is to be titularized either in the body of specialized assistant librarians or in the body of library assistants, are held in office and are intended to be held in the body of specialized assistant librarians.

    I. ― The progress tables for the year 2011 for access to the ranks of Associate Specialized Librarian of 1st Class and Assistant Senior Specialized Librarian remain valid for the body of specialized Assistant Librarians until December 31, 2011.
    The agents promulgated pursuant to the first paragraph after the date of entry into force of this decree shall be classified in the rank of the specialised librarian of an exceptional class, taking into account the situation which would have been theirs if they had not ceased to belong to their former bodies until the date of their promotion, and then promulgated in the ranks of advancement of that body in accordance with the provisions of Articles 14 and 15
    II. ― The progress tables established under 2011 for access to the grades of assistants of the higher-class libraries and assistants of the exceptional-class libraries remain valid for the body of the specialized assistant librarians until December 31, 2011.
    Agents promulgated pursuant to the third paragraph after the date of entry into force of this decree are classified in the ranks of advancement of the body of the specialized assistant librarians taking into account the situation that would have been theirs if they had not ceased to belong to their former body until the date of their promotion, then promoted in the ranks of advancement of this body in accordance with the provisions of Article 11 of the Decree of 18 November 1994 referred to aboveand, finally, reclassified to the date of their promotion, in accordance with the correspondence table in section 22 above.

    Until the establishment of the national parity administrative commission of the body of specialized assistant librarians who will intervene by derogation from provisions of the first and second paragraphs of Article 1 of the Decree of 30 December 2010 referred to above no later than eighteen months from the date of entry into force of this decree, the representatives of the parity administrative commissions of the corps of the specialized assistant librarians and the body of the assistants of the libraries are held in office and sit in joint training.

    The Schedule to the above-mentioned Order of September 21, 2005 is amended as follows:
    1° At 26°, the words: "Specialized Assistant Libraries, governed by the Decree No. 92-30 of 9 January 1992 modified with special status of specialized assistant librarians are replaced by the words: "Specialized assistant librarians";
    2° The 27th is repealed.
