Order of July 22, 2011 approving professional bodies for the execution of public statistical investigations in the industry

Having regard to Council Regulation (EEC) No. 3924/91 of 19 December 1991 on the establishment of a Community Survey on Industrial Production (ProDCOM Regulation);
Having regard to Council Regulation (EC) No 322/97 of 17 February 1997 amended on Community Statistics;
Having regard to Council Regulation (EC) No. 1165/98 of 19 May 1998 amended on economic statistics;
Vu le Heritage Codein particular chapter 3 of his book II;
Vu le Trade codeincluding articles L. 123-1 and A. 123-81 to A. 123-96;
Vu la Act No. 51-711 of 7 June 1951 amended on the obligation, coordination and secrecy of statistics, including Article 4;
Vu le Decree No. 57-178 of 15 February 1957 modified to reorganize agricultural statistics;
Vu le Decree No. 2007-1888 of 26 December 2007 approving the nomenclatures of French activities and products;
Vu le Decree No. 2008-636 of 30 June 2008 Amending the organization of the central administration of the Ministry of Agriculture, Food and Fisheries;
Vu le Decree No. 2009-318 of 20 March 2009 the National Statistical Information Council and the Statistical Secret Committee;
Vu le Decree No. 2010-1447 of 25 November 2010 relating to the powers of the Minister of Economy, Finance and Industry;
Vu le Decree No. 2010-1453 of 25 November 2010 relating to the powers of the Minister of Agriculture, Food, Fisheries, Rurality and Land Management;
Considering the amended decision of 4 October 2006 on the organization and responsibilities of agricultural statistical services to the Ministry of Agriculture;
Having regard to the decision of 30 June 2008 approving the nomenclature of French products,

I. ― Implementation of the Act No. 51-711 of 7 June 1951 referred to above, the professional organizations known as the National Union of the Animal Nutrition Industry (SNIA), Coop de France, animal nutrition section and Professional Association of Manufacturers of Supplements for Animal Food (AFCA-CIAL) are jointly approved for the execution of public statistical surveys in the codated production branch:
10.91Z - Manufacture of farm animal feeds,
in reference to the nomenclatures approved by the decree of December 26, 2007 and the decree of June 30, 2008 referred to above.
II. ― Authorized organizations are registered in the national directory of companies and their institutions mentioned in theArticle A. 123-81 of the Commercial Code under the numbers:
SIREN 784 312 589 for the National Union of the Animal Nutrition Industry (SNIA);
SIREN 784 179 665 for Coop de France, animal nutrition section;
SIREN 784 311 730 for the Professional Association of Supplement Manufacturers for Animal Feeding (AFCA-CIAL).

Article 2


Public statistical surveys for which this approval is issued are listed on the list of the program set annually by order of the Minister responsible for the economy.
The competent public investigator for the investigations under which this approval is issued is the Department of Statistics and Forward-looking (SSP) of the Ministry of Agriculture.

I. ― The approval provided for in section 1 shall be valid in respect of all undertakings adhering or not to the approved bodies carrying on an activity of the industry referred to in section 1.
II. ∙ The right of option providedArticle 4 of the Act of 7 June 1951 referred to above shall be open to any company interviewed in connection with the approval granted by this Order.
Companies receiving a questionnaire sent by accredited bodies and wishing to respond directly to the public investigator service must exercise their right of option by sending a registered letter with a request for a notice of receipt stating their intention.
The option can be exercised during the year, to take effect the following calendar year.
III. ― The list of units interviewed is, for each of the surveys concerned, set by reference to the national directory of companies and their establishments mentioned in theArticle A. 123-81 of the Commercial Code.
IV. ― All exchanges of information between the public investigator service and the approved organizations relating to the companies or institutions interviewed use the SIREN and SIRET identification numbers of the units concerned.

Article 4


The main purpose of the public statistical surveys carried out under this Decree is to measure industrial production. They may include:
- productions;
– deliveries in physical quantities and billings;
- stocks.
The periodicity of investigations, which may be annual or infra-annual, is determined by the public investigator service after consultation with accredited bodies.
The surveys are carried out in accordance with a specifications prepared by the investigating public service and describing the provisions to ensure the production of quality statistical results.

Article 5


As part of the annual programme of public statistical surveys, the questionnaires of the surveys provided for in this Order are prepared jointly by the accredited bodies and the public investigator service and arrested by the latter. These questionnaires are validated by the Minister's INSEE visa. Their impression is at the expense of accredited bodies.

A complete list of the units interviewed, jointly developed by the accredited bodies and the public investigator service and arrested by the latter, is addressed to the public investigator service at least once a year at the time of the first investigation of each periodicity. Any changes to this list during the year must be made in accordance with the public investigator service.

Article 7


Authorized bodies must perform the necessary treatments for the production of consistent statistical results. The description of these treatments is provided at the request of the investigating public service.
These results are provided to the investigating public service within a maximum period of time, after the end of the survey reference period, determined in accordance with the investigating public service and in accordance with the above-mentioned European regulations.
The results are accompanied by the number of units that have either been answered or estimated, for each line of interrogation and for each level corresponding to the official nomenclatures. The elements useful to the application of the rules of statistical secrecy are also transmitted.
The individual information for each of the units interviewed is provided upon request to the public investigator service.

Article 8


Public results are available from accredited bodies or public investigators. Public results mean those who respect the rules of statistical secrecy and the protection of personal freedoms.
In the event that approved bodies publish the results of the investigation, they must mention the name of the public investigator service.

Article 9


In the event that the application of the rules of statistical secrecy to the basic sections of the questionnaire prevents the dissemination by the European Union of the data provided by the above-mentioned regulations, this dissemination must be consistent with the same rules of statistical secrecy, the public investigator service, after consultation with the accredited bodies concerned, sets the publication rules.

For application of theArticle 7 of the Act of 7 June 1951 referred to above, and after sending letters of layoff, and then finding no answer, the approved bodies shall send to the public investigator service, within the time limits set by the latter, the list of companies that have not responded within the specified time limit.

The questionnaires are retained by the accredited bodies until they are archived in accordance with Book II of the Heritage Code.

Article 12


Authorized bodies may not use the individual information derived from the investigations under this Order for purposes other than public statistics.

Article 13


Authorized bodies may only be released from work that they have accepted to be carried out after at least six months' notice to the investigating public service.
In any event, accredited bodies are completing the current year's program of investigations.

If the professional bodies known as the National Union of the Animal Nutrition Industry (SNIA), Coop de France, animal nutrition section and Professional Association of Manufacturers of Supplements for Animal Feeding (AFCA-CIAL) ceased to be approved either pursuant to article 13 above, or as a result of a withdrawal of approval, they must hand over to the public service surveyor all the questionnaires they collected, in accordance with article 13 Act of 7 June 1951 referred to above, and which would not have been paid to the archives under section 11 of this Order.

Article 15


The Order of 14 February 1992 approving the National Union of Animal Nutrition Industries (SNIA), the National Federation of Animal Production and Food Cooperatives (SYNCOPAC) and the Association of Animal Food Supplement Manufacturers (AFCA) is repealed.

Article 16


The Director General of the National Institute of Statistics and Economic Studies and the Secretary General of the Ministry of Agriculture, Food, Fisheries, Rurality and Land Management are responsible, each with regard to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
