Communications Regulatory Authority Electronic and postal services,
In view of Directive 2002/21/EC of the European Parliament and of the Council of 7 March 2002 on a common regulatory framework for electronic communications networks and services;
In view of the Directive 2002 /20/EC of the European Parliament and of the Council of 7 March 2002, as amended on the authorisation of electronic communications networks and services;
Given the postal code and electronic communications, and in particular Articles L. 36-7 (6 °), L. 42-1 and D. 406-14;
In light of the amended Order of 14 June 1996 authorizing the Société France Caribbean Mobile to establish a radio network open to the public in the West Indies for the operation of a pan-European digital service GSM DOM 2;
In view of Decision No. 2008-1213 of the Communications Regulatory Authority Electronic and postal services of 20 November 2008 laying down the conditions for the renewal of the authorisation to use frequencies in the 900 MHz and 1 800 MHz bands of the Orange Caribbean company;
In view of Decision No 2010-1388 of the Authority of Regulation of electronic communications and posts of 16 December 2010 authorizing Orange Caribbean society to use frequencies in the 900 MHz and 1 800 MHz bands to establish and operate a radio network open to the public in overseas departments and communities;
Due to public consultation on the Renewal of the GSM licences of Digicel AFG, the Société réunionnaise du radiotéléphone (SRR) and Orange Caribbean launched in July 2008 by the ARCEP;
Due to the synthesis of contributions received in the public consultation on the renewal of the GSM authorisations from Digicel AFG, SRR and Orange Caribbean, published on 14 October 2008;
Due to the request of the Orange Caribbean company as of 30 November 2010 concerning the renewal of its authorisation to use frequencies at 900 and 1 800 MHz;
In view of the request by the Orange Caribbean company to the Regulatory Authority Electronic communications and positions as of July 18, 2011;
After deliberation on July 26, 2011;
On the following grounds:
Société France Caribbean Mobile, subsequently renamed Orange Caribbean, was authorized by an order of 14 June 1996 to establish and operate a radio network open to the public to the GSM standard in the 900 and 1 800 MHz bands in the Departments of Martinique, Guadeloupe, Guyana and the communities of Saint-Martin and Saint-Barthélemy. This authorisation has expired on 14 June 2011.
By its decision No. 2010-1388 above, the Authority has carried out a renewal of the authorisation to use frequencies of the Orange Caribbean company, after having conducted a consultation Notify the operator of the conditions of renewal in Decision No. 2008-1213 referred to above by the Authority.
By letter dated 18 July 2011, Orange Caribbean asked the Authority for the allocation of channel 62 in the band 900 MHz in the Department of French Guiana, which was initially the channel of the Orange Caribbean company in its previous authorisation.
The purpose of this decision is to respond favourably to the request of the Orange Caribbean company and to amend Decision No 2010-1388 to this effect,
Decides:

Article 1


The provisions of Article 2 of the ARCEP Decision 2010-1388 of 16 December 2010 are deleted and replaced by the provisions Following:

The Director of Spectrum and Relations With the equipment manufacturers of the Electronic Communications and Postal Regulatory Authority responsible for the execution of this decision, which will be notified to the company Orange Caribbean and published in the Official Journal of the Republic French.
