Communications Regulatory Authority Electronic and postal services,
Having regard to Directive 1999 /5/EC of the European Parliament and of the Council of 9 March 1999 Concerning radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity (R&TTE Directive), and in particular Articles 3, 10 and 11 thereof and its annexes II, III, IV, V and VI;
Given the code Electronic posts and communications, in particular Articles L. 34-9, L. 36-7, R. 20-10 and R. 20-14;
In view of Decision No 2007-0331 of the Authority of 5 April 2007 on the procedure for designating notified bodies Intervening in the assessment of the conformity of microwave equipment and equipment Electronic communications terminals;
Due to the certification of accreditation and its technical annex issued and notified on 8 June 2010 by the French Accreditation Committee (hereinafter COFRAC) to the company Central Industries Laboratory Electrical (hereinafter LCIE);
In view of the request of LCIE by a letter dated 7 April 2011, for designation as a notified body involved in the conformity assessment of certain microwave equipment;
Vu The certification repository passed by LCIE;
After you have Deliberated on May 12, 2011,



Context


LCIE submitted an application for its Designation as notified body in accordance with Decision No. 2007-0331 referred to above, which establishes the procedure for designating notified bodies involved in the assessment of the conformity of microwave equipment and terminal equipment Of electronic communications.
From the analysis of this file, it appears that the Company has accreditation according to the European standard EN 45011 applicable to organisations conducting the certification of products specified in a certification repository, for technical fields explicitly covered by Directive No. 1999 /5/EC of the European Parliament and of the Council of 9 March 1999 concerning microwave equipment and telecommunications terminal equipment and the mutual recognition of their conformity. This accreditation was issued by the COFRAC as confirmed by the certificate notified on 8 June 2010 to the company LCIE and attached to the file forwarded to the ARCEP.
In the light of this qualification, LCIE fulfils the conditions for Be designated as the notified body involved in the assessment of the conformity of certain equipment

Item 1


LCIE is designated as a notified body to intervene in the assessment of compliance with the essential requirements Of electrical safety, electromagnetic compatibility (EMC) and radio equipment of the equipment mentioned in the certification repository, annexed to this Decision. This designation enables it to carry out the tasks defined in paragraphs a, b and c of Annex 3 to Decision No 2007-0331 referred to above.

Article 2


The Director General of the Authority shall be responsible for the implementation of this Decision, which shall be published in the Official Journal of the French Republic and transmitted to the Minister responsible for electronic communications with a view to his notification to the European Commission.
