The 3 ° of Article L. 5-2 of the postal code and electronic communications provides that the Communications Regulatory Authority Electronic and postal services " [...] shall be informed by La Poste, before their entry into force, of the rates of the universal service. Within one month of the transmission of such tariffs, the Commission shall issue a public notice. "
Article R. 1-1-13 of the CPCE specifies that" The Post Office shall provide the Regulatory Authority for electronic communications and posts at least one month before the entry into force of any relevant information on the rates of non-reserved services under the universal
". Of these provisions, La Poste submitted to the Regulatory Authority for Electronic Communications and Postal Services (the Authority), on 7 March 2011, a project to amend the tariffs of its shipments " Gears " In accordance with the 3 ° of Article L. 5-2 of the CPCE.
The benefits in question consist of the consignments " Postage stamp " ("TP") And those freed by other means, in particular the postage-paid machines, known as " Non-postage stamp " ("non-TP"). For each of these categories, they include the letter, the economic fold or " Ecopli " And the recommended shipment. The details of the offers and prices in question are set out in Annex 1.
According to the La Poste project, the new pricing will take effect on 1 July 2011 for both shipments. TP " For those freed by other means, in particular postage-paid machines, known as " Outside the TP ".
1. Increases in the tariff item
La Poste intends to increase the rates of the mail from 1 July 2011. These increases relate to the priority letter, the ecopli, the recommended letter and the stated value, for the range " TP " That " Outside TP ".
For the first weight range, the increase will be 2 euro cents for the priority letter. The gap with the non-TP letter, with a tariff of 58 euro cents, rises from 1 to 2 euro cents.

2. Economic Analysis
Tariff increases improve cover for letter and ecopli costs " TP ", which nevertheless remains unprofitable, maintaining the strong contribution observed on shipments" ", so that the range of items, as a whole, has a positive contribution. Historical disparity in margin rates between products " TP " Negative margin and products " Non-TP " In
with the decision of Authority No. 2008-1286, the tariffs of La Poste are subject to a multi-annual framework for the " Basket " Of universal service, so that the price of this basket does not increase more in annual average than CPI + 0.3 % where CPI is the evolution of the consumer price index. The same decision also provides for stricter supervision, equal to the IPC, on a " Subbasket " Composed of products cleared by postage meter, known as "range" Outside TP ".
Calculation of global basket price developments
In accordance with article R. 1-1-10 of the CPCE, La Poste has informed the Authority, by letter dated 22 September 2010, of the change in the scope of the service Universal. As of 1 July 2011, the industrial offers of advertising mail (Full Destinéo and Integral Catalogue), representing a turnover of just over EUR 1 billion, or 10 % of the universal service, will indeed Exit from the universal service catalogue.
The 2011 tariff increases over 2010 are calculated on the limited scope of the universal service, excluding commercial offers of advertising mail, as it will be later than July 1, 2011. Tariff increases in previous years are appreciated on the extended perimeter (including industrial mail-outs). Alternatively, these increases can be assessed retrospectively on the limited scope of the universal service (excluding commercial mail-outs). The estimates according to this second method are shown in brackets below.
In view of the inflation forecast of 1.5 %, made by the Finance Law for 2011, the average price increase is 2.04 % on the To 1 January 2011 (1.70 % by considering the limited scope of the universal service over the period 2009-2011). The increases in the number of packages for metropolis and international packages as at 1 March 2011 represent 0.07 % (0.08 %) of consumption, bringing the level available to date to 1.97 % (1.62 %).
In 2011, increases in the Present tariff record represents 0.64 % of consumption of price cap. Thus, the available balance is 1.33 % (0.99 %).
Shipments " TP " Contribute 0.36 % to this increase and all shipments " Non-TP " Contribute 0.28 %.
The top three products " Non-TP " -the non-TP letter, the non-TP screen and the recommended non-TP letter-are subject to a specific tariff framework (1) analysed below.
Calculation of the price developments of the gear sub-basket " Non-TP "
The proposed rate movements correspond to an increase in year full of + 1.80 % for the priority letter, + 1.82 % for the ecopli and-0.05 % for the recommended letter, an increase of + 1.44 % for All the products of the sub-basket, and to an additional revenue of [SDA] million for La Poste in full year.
The increase in half year, the consumption of the corresponding price cap is 0.72 %, while the price cap Available is 0.46 %, an exceedance of 0.27 point over the period (2009-2011).
Nevertheless, this Overflow can be allowed:

This evolution must be assessed over the long term beyond a circumscribed period that may be affected by range or timing effects; In this respect, La Poste has indicated that it Would not increase on the products " Non-TP " In 2012.
3. Conclusion
The Electronic Communications and Postal Regulatory Authority, in the light of the information provided by La Poste and the foregoing analysis, makes a favourable opinion on the implementation of the tariff changes of the Services of domestic mail-outs of the universal postal service.
The Director General of the Authority is responsible for notifying this notice to La Poste.
It will be made public, subject to the secrets protected by law, and published on the site Internet of the Authority and the Official Journal of the French Republic.
