Order of June 3, 2011 identifying categories of marine protected areas within the jurisdiction of the Marine Protected Areas Agency

Minister of Ecology, Sustainable Development, Transport and Housing,
Considering the Convention on Wetlands of International Importance, particularly as habitats for waterbirds signed at Ramsar on 2 February 1971, published by the Decrees No. 87-126 of 20 February 1987 and 95-143 of 6 February 1995, together with its protocol and amendments;
Considering the Convention for the Protection of the World, Cultural and Natural Heritage, adopted by the 17th General Conference of the United Nations Educational, Scientific and Cultural Organization on 16 November 1972, published by the Decree No. 76-160 of 10 February 1976 ;
Considering the convention on the conservation of the marine fauna and flora of Antarctica, signed in Canberra on 20 May 1980, published by the Decree No. 82-975 of 15 November 1982together the Annex to this Convention;
In view of the protocol on protected areas, wildlife and wildlife in the eastern African region signed in Nairobi on 21 June 1985, published by the Decree No. 2000-982 of 2 October 2000together the annexes to this protocol;
Considering the protocol on specially protected areas and wildlife in the Caribbean region, signed in Kingston on 18 January 1990, published by the Decree No. 2002-969 of 4 July 2002 ;
Considering the protocol to the Antarctic Treaty on Environmental Protection, Protection and Management of Areas, signed in Madrid on 4 October 1991, published by the Decree No. 98-861 of 18 September 1998together Annex V, adopted in Bonn on 18 October 1991, published by the Decree No. 2005-1075 of 23 August 2005 ;
Considering the protocol on specially protected areas and biodiversity in the Mediterranean signed in Barcelona on 10 June 1995, published by the Decree No. 2002-1454 of 9 December 2002together the annexes to this protocol;
In light of Annex V to the North-East Atlantic Marine Environment Protection Convention on the Protection and Conservation of Ecosystems and Biological Diversity of the Maritime Area and Appendix 3, signed at Sintra on 23 July 1998, published by the Decree No. 2005-145 of 14 February 2005together the appendix to this annex;
In view of resolution 28C/24 adopted by the 28th General Conference of the United Nations Educational, Scientific and Cultural Organization on 14 November 1995, approving the Seville Strategy for Biosphere Reserves and adopting the statutory framework of the global network of biosphere reserves;
Considering the environmental code, including articles L. 120-1, L. 334-1 and R. 334-2;
Considering the advice of the Board of Directors of the Marine Protected Areas Agency dated 4 November 2009;
Considering the opinion of the National Council for the Protection of Nature of 5 May 2010,

Within the jurisdiction of the Marine Protected Areas Agency, within the meaning of section R. 334-2 of the Environmental Code, categories of marine protected areas consisting of areas delimited under the following international instruments:



1° Global instruments


(a) The Convention on Wetlands of International Importance of February 2, 1971 referred to above.
(b) The Convention for the Protection of the World, Cultural and Natural Heritage of 16 November 1972 referred to above.
(c) The resolution endorsed the Seville Strategy for Biosphere Reserves and adopted the statutory framework for the aforementioned global network of biosphere reserves of 14 November 1995.


2° Regional instruments


(a) For the Mediterranean, the protocol on specially protected areas and biodiversity of 10 June 1995 referred to above.
(b) For the North-East Atlantic Ocean, Appendix V on the protection and conservation of ecosystems and biodiversity of 23 July 1998 referred to above.
(c) For the Atlantic Ocean, Caribbean region, the protocol on specially protected areas and wildlife of 18 January 1990.
(d) For the Indian Ocean, the protocol on protected areas and wildlife in the eastern African region of June 21, 1985 referred to above.
(e) For Antarctica, Appendix V to the Protocol on Environmental Protection, Protection and Management of the Areas of 18 October 1991 referred to above.

Also falls within the scope of the Marine Protected Areas Agency's jurisdiction the category of marine protected areas comprised of national hunting reserves with a maritime portion, established by the Minister responsible for hunting pursuant to sections L. 422-27 and R. 422-93 of the same environmental code.

The Director of Water and Biodiversity is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
