Order of May 4, 2011 amending the Order of May 31, 2010 setting the titles, diplomas, certificates, certificates or equivalent qualifications attesting to the proficiency in the languages of higher education and computer and internet required of candidates who have successfully undergone the examinations for the recruitment of first and second degree teachers and education personnel under the Minister responsible for national education

Minister of National Education, Youth and Associative Life,
Considering the education code, including chapter IV of title I of book IX;
Vu le Decree No. 70-738 of 12 August 1970 amended on the special status of primary education advisers;
Vu le Decree No. 72-580 of 4 July 1972 amended relating to the particular status of Associate Professors of Second Degree Teaching;
Vu le Decree No. 72-581 of 4 July 1972 amended on the special status of certified teachers;
Vu le Decree No. 80-627 of 4 August 1980 amended on the special status of teachers of physical and sport education;
Vu le Decree No. 90-680 of 1 August 1990 amended on the special status of school teachers;
Vu le Decree No. 92-1189 of 6 November 1992 modified on the special status of professional high school teachers;
Having regard to the amended decision of 22 May 2000 on the Certificate of Competence in Languages of Higher Education;
Having regard to the decision of May 12, 2010 defining the skills to be acquired by the professors, documentists and senior education advisers for the exercise of their profession;
Having regard to the decision of 31 May 2010 establishing the equivalent titles, diplomas, certificates, certificates or qualifications that attest to the language skills of higher education and computer and internet required of candidates who successfully completed the examinations of the first and second degree teacher recruitment examinations and education staff of the Minister responsible for national education;
In view of the decree of 14 December 2010 concerning the computer and internet certificate of higher education level 2 "teacher";
Considering the decision of 10 January 2011 on the terms and conditions for the creation of the computer certificate and internet of the higher education level 2 "teacher",

The title of the above-mentioned decision of May 31, 2010 is supplemented by the words: "and corresponding examinations for the recruitment of masters of private educational institutions under contract".

In article 1 of the same order, a last paragraph is added:
"To the competitive examinations of the masters of private educational institutions under contract corresponding to the competitions of public education mentioned in the preceding paragraphs. »

Section 2 of the same order is amended to read:
(a) In the first paragraph, after the words: "contests" are inserted the words: "of public education" and after the words: "of article 3" are inserted the words: "of this decree";
(b) In the second sentence of the first paragraph of 1° , after the words: "European Economic Area" are added the words: "by an administration or by a public or private institution or agency, in particular as a result of a standardised examination or test,"
(c) The last paragraph of 1° is deleted and replaced by the following three paragraphs:
" ― laureates justifying the degree of the general, technological or professional baccalaureate with the indication "European section", "Eastern language section" or "international option" or justifying the simultaneous issuance of the diploma of the general baccalaureate and a diploma of completion of foreign secondary education, provided for in Article D. 334-23 of the Code of Education, or a diploma of completion of secondary education of a foreign State whose examinations
– the winners of a Member State of the European Union or a party to the agreement on the European Economic Area other than France, where French is neither their mother tongue nor the official language or one of the official languages of the State concerned, and who justify having carried out all or part of their compulsory education in institutions teaching in the language or in one of the languages of their country of origin other than French;
― laureates justifying further certification in the disciplinary sector " foreign language education in a non-language discipline", issued pursuant to the amended decision of December 23, 2003, relating to the conditions of granting to teachers of the first and second levels of public education, under the authority of the Minister for Education, and to contracted and certified masters of private educational institutions under contract. » ;
(d) The following paragraphs are added after the second paragraph of 2°:
"One of the certifications mentioned in the preceding two paragraphs is exempted from the winners of the competition sections for which the information and communication technologies for teaching are included in the curriculum of the tests or for which at least one test includes a pedagogical presentation with the use of the CTBT; the list of these sections is set by the Minister responsible for education.
The provisions of 1° and 2° are applicable to candidates who have successfully undergone the examinations of the corresponding examinations for the recruitment of masters of private educational institutions under contract, in accordance with the provisions of II and III of Article R. 914-19-2 and III of Article R. 914-19-3 of the Code of Education for the recruitment of teachers of schools of the first degree under contract and articles R. 914-32, R. »

Article 3 of the same order adds a last paragraph to read as follows:
"In order to obtain a contract or interim approval and to perform the internship and to obtain a final contract or approval, these certifications are required of candidates who have successfully undergone the examinations of the examinations of the masters of private educational institutions under contract according to the same rules as those set out in this article, respectively, for the appointment as an interns officer and for the titularization of the winners of the public education contests. »

It is inserted after article 3 of the same order an article 3 bis as follows:
"Art. 3 bis.-S shall be deemed to meet the conditions referred to in Articles 2 and 3 of this Order:
― laureates having or having had the quality of teacher or full education staff;
― laureates having or having had the status of a contractual or definitively approved master of private educational institutions under contract, regardless of the scale of pay;
― laureates who have the status of non-public or private educational institutions under an association contract or that of non-permanent staff performing educational functions in the same institutions, and who have an indefinite contract;
― the winners of the public education contests listed in Article 1 of this Order, having or having had the quality of an employee or a quality assimilated by reference to provisions of Article 10 of Decree No. 2010-311 of 22 March 2010 relating to the modalities of recruitment and reception of nationals of the Member States of the European Union or of another State Party to the agreement on the European Economic Area in a body, employment framework or employment of the French public service, and which justify a title or diploma that qualifies them to teach or to perform functions of education in a Member State of the European Union or in another State Party to the European Agreement on Other »
