Key Benefits:
Publics concerned: agricultural producers and their customers when they are subject to an obligation to contract under Article L. 631-24 of the Rural Code and Maritime Fisheries.
Purpose: implementation of mediation of agricultural contracts.

Notice: the Act No. 2010-874 of 27 July 2010 the modernization of agriculture and fisheries allows inter-professional organizations to define a contractual framework, by product or product group, impinging itself to trade relations between different links in a sector.
The law also provides for the possibility for the co-contractors to refer a mediator to any dispute arising in connection with the conclusion or execution of a contract under the aforementioned provisions.
The decree defines the conditions for the appointment of this ombudsman of agricultural contracts and the missions entrusted to him.

On the report of the Minister of Economy, Finance and Industry and the Minister of Agriculture, Food, Fisheries, Rurality and Land Management,
In view of the rural and maritime fisheries code, including article L. 631-24,
Decrete:
It is created in chapter I of title III of Book VI of the Rural Code and Maritime Fisheries a section 1 as follows:
“Section 1
“General provisions
"Art.D. 631-1.-The mediator referred to in section L. 631-24 is appointed by joint order of the Minister for Agriculture and the Minister for Economics.
"Art.D. 631-2.-The ombudsman may take any initiatives to promote the conciliation of the positions of the parties to the contracts referred to in Article L. 631-24. It may issue recommendations on changes in regulations, which it transmits to the Minister for Agriculture and to the Minister responsible for the economy. »
