Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu la Act No. 2001-616 of 11 July 2001 amended on Mayotte, including articles 64-1 and 65;
Vu le Decree No. 66-874 of 21 November 1966 amended with respect to the special status of officials of the deconcentrated services of the prison administration;
Vu le Decree No. 82-451 of 28 May 1982 amended on parity administrative commissions;
Vu le Decree No. 2005-143 of 17 February 2005 relating to the status of the body of the state prison guards for the administration of Mayotte and fixing the conditions for the integration of the incumbent agents and the titularization of the non-members of the departmental community of Mayotte made available to the prison services in the public service of the State;
Vu le Decree No. 2006-441 of 14 April 2006 amended to include the special status of the corrections officers, including its title I;
Having regard to the advice of the Mayotte General Council of 22 November 2010;
Having regard to the advice of the Department of Justice and Freedoms Technical Committee dated 30 November 2010;
The State Council (Section of Administration) heard,
Decrete:
In article 2 of the aforementioned decree of 17 February 2005, the word "ten" is replaced by the word "six".
Article 5 of the same decree is replaced by the following provisions:
"Art. 5.-Maybe to be promoted to the rank of first prison supervisors who have reached the 3rd level of their rank and are listed in the advance table prepared after the advice of the parity administrative commission.
Prison supervisors are classified in the rank of first superintendent in accordance with the following table:

Article 7 of the same decree is replaced by the following provisions:
"Art. 7.-The prison guards of the State for the administration of Mayotte who justify one year in the last step of their rank are immediately integrated into the supervision and application of the surveillance personnel of the prison administration governed by the Decree No. 2006-441 of 14 April 2006 having a special status of the corps of the prison supervisors. This integration is carried out in the rank of senior supervisor and supervisor, at the 3rd step, without seniority.
The first prison guards of the State for the administration of Mayotte who reach the last stage of their rank are immediately integrated into the supervision and enforcement of the prison administration supervisors governed by the decree of 14 April 2006 mentioned above. This integration is carried out in the rank of first supervisor, at the first step, without seniority.
The integrations referred to in the two paragraphs above have an automatic character and are not subject to the advice of the competent parity administrative board for the supervisory and enforcement personnel. »
In the same decree, an article 7-1 is created as follows:
"Art. 7-1.-The superintendents and first superintendents of the State for the administration of Mayotte, classified on a scale with a index corresponding to a monthly net salary less than the monthly net amount of the Mahorais SMIG calculated under articles L. 141-2, L. 212-2 and R. 141-2 of the Labour Code applicable to Mayotte, are reclassified in their body and grade at the level This calculation is performed on the basis of a full-time work quotity.
The provisions of this Article, which may, if any, be implemented on the occasion of each increase in the Mahorian SMIG, shall take effect on the date of this increase. »
