Any road public transport company of travellers domiciled in France, in a Member State of the European Union or the European Economic Area, or in the Swiss Confederation may apply for authorization to operate a regular domestic service of national interest on the occasion of a scheduled international road transport service.
Article 1 companies wishing to operate a regular domestic service of national interest on the occasion of a scheduled international road passenger transport service must:
(a) be licensed as a valid community public road passenger licence;
(b) Hold a valid international regular transport permit for travellers, in the context of which the operation of the domestic service(s) is envisaged;
(c) To apply to the Minister for Transport with a request for authorization and a file in five copies including:
1° Copy of the valid Community Public Road Passenger Transport Licence;
2° Copy of the authorization of scheduled international road transport service in the course of validity issued by the competent authorities in accordance with Regulation (EC) No 1073/2009 of the European Parliament and of the Council of 21 October 2009 establishing common rules for access to the international market of bus and bus transport services, and amending Regulation (EC) No 561/2006;
3° List of regular domestic desserts of national interest by origin and intended destination on the occasion of the scheduled international road transport service of passengers and subject to the request for authorization;
4° A document specifying, for each inland service, times and frequency, distinguishing, where applicable, operating periods;
5° A document explaining the number of vehicles that are intended to be used for the performance of the internal service(s);
6° An explanation of the estimated number of travellers and the planned rates for each domestic service, and the forecasted turnover by distinguishing the share of domestic service and the share of international service;
7° A document explaining the organization put in place by the company to provide an annual report on operating data regarding the number of passengers and turnover.
The application for authorization is set out in CERFA document No. 14322.
The transport authorities concerned are consulted by the State on the basis of the elements provided in the file referred to in 2° to 5° of the c of Article 2 above. The other elements of the file are communicated to the transport organizing authorities who request it, except opposition from the applicant company.
The authorisation to operate one or more domestic regular domestic desserts of national interest is granted by the State to the company that has applied for it, for a period that cannot exceed the one remaining to be run for the authorization of regular international travellers to which it is attached.
This authorization is issued in an original copy and as many copies as there are of vehicles corresponding to the number provided pursuant to the 6° of c of Article 2.
The authorization is consistent with the model set out in the Appendix to this Order.
Each year, the company communicates to the State an operating report covering the past year.
This report is transmitted for the first time no later than three months after the month of issuance of the authorization, and then annually at the same time.
It includes, in the form of one or more tables, the following information:
1. For each authorized domestic service, the number of passengers on international routes and the number of passengers on national routes.
2. Revenue from all domestic desserts as well as revenue from international service.
A copy of the annual operational report is communicated to the transport operator authorities upon request.
The Director of Transport Services is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
