Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, including article 20, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 98-325 of 30 April 1998 providing occupational hazard compensation to certain categories of technical staff of the Ministry of Equipment, Transport and Housing;
Vu le Decree No. 2001-1148 of 5 December 2001 amended to provide a special hardship allowance for departmental office staff;
Vu le Decree No. 2003-799 of 25 August 2003 amended on the specific service allowance allocated to bridge engineers, and pavements and officials of the technical units of the equipment;
Vu le Decree No. 2009-1106 of 10 September 2009 bearing special status of the corps of bridge, water and forest engineers,
Decrete:
Members of the deck, water and forest engineers are entitled to performance and functions in the conditions set out in this decree.
The performance and function allowance includes two parts:
– a performance-related portion, taking into account the results of the individual assessment procedure provided for in the existing regulations and how to serve;
– a share of functions, taking into account responsibilities, level of expertise and special hardships related to the functions performed.
The individual amounts corresponding to the share related to the functions are allocated taking into account the ministerial policy organizing the professional courses.
A joint order of the Minister for Sustainable Development, the Minister for Agriculture, the Minister for Public Service and the Minister for Fixed Budget for each grade, within a ceiling:
– the annual reference amounts for the share related to performance;
― and the annual reference amounts for the share related to functions.
The individual performance and function-related share amounts are determined as follows:
I. ― For the share of performance, the reference amount is modulable by applying a coefficient included in a range of 0 to 6.
An annual review of the individual amount awarded under this Part is based on the results of the individual assessment procedure referred to in section 2 and how to serve.
All or part of this part may be allocated for one year in the form of an exceptional annual payment, not automatically re-conducted from one year to another.
II. ― With respect to the share of functions, the individual assignment is determined by the application to the reference amount of a multiplier included in a range of 1 to 6 with respect to the responsibilities, level of expertise and special hardships related to the functions performed.
Agents housed by absolute necessity of service receive a share related to the assigned functions of a coefficient included in a range of 0 to 3.
The performance and duties allowance is paid on a monthly basis.
The performance and duty allowance is exclusive of any other allowance related to the duties and manner of service.
However, this premium may be accumulated with the special hardship allowance of departmental cabinet staff established by the decree of 5 December 2001 referred to above and compensation for professional risks established by the Decree of 30 April 1998.
The bridge, water and forest engineers maintain the compensation regime they received before they were integrated into the body of bridge, water and forest engineers, until they receive the performance and function allowance.
Deck, water and forest engineers receive the performance and function allowance, on the date fixed by an order of the Minister for Sustainable Development and the Minister for Agriculture, taking into account the responsibilities and hardships related to the assignment service, and no later than January 1, 2015.
However, the engineers of bridges, waters and forests, as well as the engineer-students in the body of the engineers of bridges, waters and forests after the date of entry into force of this decree, receive compensation for performance and functions regardless of their assignment.
The balance due to the date fixed by the order mentioned in the previous article under the specific service allowance established by the decree of 25 August 2003 referred to above is paid at the effective departure of the agent concerned when the employee's employment authority ceases to pay or is detached on a functional job.
The Minister of Ecology, Sustainable Development, Transport and Housing, the Minister of Budget, Public Accounts, Public Service and State Reform, spokesperson for the Government, and the Minister of Agriculture, Food, Fisheries, Rurality and Land Management are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Gazette of the French Republic.
