See?Order No. 2008-727 of 24 July 2008 extension and adaptation Act No. 2007-1199 of 10 August 2007 relating to the freedoms and responsibilities of universities in New Caledonia and French Polynesia;
See?Order No. 2008-728 of 24 July 2008 adapting the provisions of the Education Code relating to higher education in the Wallis and Futuna Islands;
Vu le Decree No. 94-39 of 14 January 1994 amended on the budget and financial regime of public institutions of a scientific, cultural and professional character;
Vu le Decree No. 2008-618 of 27 June 2008 relating to the budget and financial regime of public institutions of a scientific, cultural and professional character with expanded responsibilities and competencies;
Having regard to the seizure of the Government of New Caledonia of 18 October 2010;
Considering the seizure of the French Polynesia government of 18 October 2010;
Considering the seizure of the territorial assembly of Wallis-et-Futuna on 18 October 2010;
The State Council (inland section) heard,
Decrete:
The above-mentioned decree of 14 January 1994 is amended:
1° In the sixth paragraph of Article 37, the words "other than those provided for in the preceding paragraph" are deleted;
2° The first paragraph of section 62 is replaced by the following provisions:
"The provisions of this decree are applicable in New Caledonia, French Polynesia and the Wallis and Futuna Islands in their drafting in force on the date of entry into force of Decree No. 2010-1652 of 28 December 2010as amended by this decree, subject to the following modifications:".
The above-mentioned decree of 27 June 2008 is amended:
1° In the last paragraph of Article 9, the words "the working capital" are replaced by the words "reservations";
2° The second part of Article 16 is supplemented by the words "or on reservations";
3° In the first paragraph of Article 21, the words: "University" are deleted;
4° The second paragraph of Article 64 is supplemented by the following sentence:
"The Senior Service Officer prepares the proposed service budget. If the service is provided with advice, it shall decide on the project before it is forwarded to the board of directors of the attachment establishment that determines the budget of each service. » ;
5° After the second paragraph of section 64, the following paragraph shall be inserted:
"The budget of the service is attached to the budget of the attachment establishment. » ;
6° After section 67, an article 67-1 is inserted as follows:
"Art. 67-1.-The provisions of this Decree shall apply in New Caledonia, French Polynesia and the Wallis and Futuna Islands in their drafting in force on the date of entry into force of the Decree No. 2010-1652 of 28 December 2010as amended by this decree, subject to the following modifications:
In article 12, the words: " fifteen days" are replaced by the words: " one month".
In article 21, the words: "the fifteen-day period" are replaced by the words: "the month".
The 1st of Article 52 is deleted. »
