Purpose: Amend the rules for calculating increases in the calculation of the net rates of occupational accidents and occupational diseases.
Entry into force: immediate, for the 2011 pricing.
Notice: the annual payment of the occupational accidents and diseases industry to the sick branch for the sub-declaration of occupational accidents and diseases was fully borne by the increase, which also covered occupational rehabilitation costs and management expenses. To the extent that the sub-declaration of occupational accidents and occupational diseases is primarily concerned with occupational diseases and that half of the compensation expenses paid by the funds are charged to the special account which is covered by another majoration, the rules for calculating these two majorations known as M2 and M3 are amended in order to bear for half by each of them the burden related to the payment of the occupational disease branch

Vu le Decree No. 2010-753 of 5 July 2010 setting the rules for the pricing of occupational accidents and occupational diseases;
In the light of the opinion of the Board of Occupational Accidents and Diseases of the National Health Insurance Fund of Employees dated 10 November 2010,
Decrete:
Article D. 242-6-4 of the Social Security Code is amended as follows:
(a) At 2°, the words: "the annual payment referred to in Article L. 176-1" are replaced by the words: "50% of the annual payment amount referred to in Article L. 176-1",
(b) At 3°, the words: "the value of the risk comprised by the expenditures in the special account referred to in section D. 242-6-3" are replaced by the words: "the value of the risk constituted by the expenditures in the special account referred to in section D. 242-6-3 and 50% of the amount of the annual payment referred to in section L. 176-1."
In the forty-sixth paragraph of Article 1 of the above-mentioned Decree of 5 July 2010, after the words: "Permanent incapacity is classified", is added the word "in".
The Minister of Labour, Employment and Health and the Minister of Budget, Public Accounts, Public Service and State Reform, spokesman of the Government, are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
