Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 90-90 of 24 January 1990 modified in relation to the special status of professional agricultural high school teachers;
Vu le Decree No. 2010-311 of 22 March 2010 concerning the modalities of recruitment and reception of nationals of the Member States of the European Union or of another State Party to the agreement on the European Economic Area in a body, employment framework or employment of the French public service;
Considering the advice of the Department of Food, Agriculture and Fisheries Technical Committee dated 27 October 2010;
The State Council (Section of Administration) heard,
Decrete:
At the 1st and 2nd of Article 5 of the above-mentioned Decree of January 24, 1990, the words: "the closing date of registration records" are replaced by the words: "the publication date of eligibility results".
Article 6 of the same decree is amended as follows:
1° At 2°, the words: "related to the Minister responsible for agriculture" are replaced by the words: "or private under contract" and the words: "the closing date of registration" are replaced by the words: "the date of publication of eligibility results".
2° The 3rd of the same article shall be replaced by the following provisions:
« 3° To the educational assistants recruited under section L. 916-1 of the Education Code, to the boarding schoolmasters and external supervisors of the public educational institutions under the Minister for Agriculture and to the candidates having had one of these qualities throughout or part of the period between 1 September of one of the last six school years and the date of publication of the results of the competitions
3° After the 3°, it is inserted a 4° as follows:
« 4° Candidates who have performed services in an administration, organization or institution under the conditions set out in the third paragraph of the second paragraph of Article 19 of the law of 11 January 1984 referred to above and who justify, according to the legal nature of the link between them and their employer in their Member State of origin, as defined by the Decree No. 2010-311 of 22 March 2010 relating to the modalities of recruitment and reception of nationals of the Member States of the European Union or of another State Party to the agreement on the European Economic Area in a body, employment framework or employment of the French public service, the conditions set out in 2° of this article. »
In the first paragraph of article 6-1 of the same decree, after the word: "justifying" are inserted the words: "the date of publication of the results of competition eligibility".
After article 6-1 of the same decree, an article 6-2 is inserted as follows:
"Art. 6-2.-To be appointed interns, candidates mentioned in 1 and 2 of Article 5 who have successfully undergone the examinations of the external examination must justify a certificate of language skills of higher education and a certificate of computer and internet skills.
"To be held, the other candidates for the external competition and the candidates for the internal competition and the third contest having successfully undergone the examinations must justify a certificate of competence in the languages of higher education and a certificate of competence in computer and internet.
"The conditions for the award of the Certificate of Competence in Languages of Higher Education and the Certificate of Competence in Computer Science and the Internet are defined by order of the Minister for Higher Education.
"The list of titles, diplomas, certificates, certificates or equivalent qualifications attesting to the above-mentioned competencies is determined by order of the Minister for Agriculture. »
In section 7 of the same decree, the words: "appreciate at the closing date of registration records" are replaced by the words: "appreciate at the date of publication of the eligibility results".
In article 17-2 of the same decree, the words "five years" are replaced by the words "three years".
Article 20 of the same decree is amended as follows:
1° The second sentence of the second paragraph is deleted;
2° After the second preambular paragraph, a sub-item reads as follows:
"The maximum number of professional agricultural high school teachers who can be promoted each year to the off-class is determined in accordance with the provisions of Decree No. 2005-1090 of 1 September 2005 relative to the advancement of rank in the bodies of state administrations. »
Article 24 of the same decree is amended as follows:
1° After the first paragraph, two sub-items are inserted:
"With the exception of those classified under Article 11-2 of the decree of 5 December 1951 referred to above, the professors of professional agricultural high school benefit, during their classification, from a bonus of seniority of one year. Agents under Article 11-5 of the above-mentioned Decree of 5 December 1951 shall be entitled, in the course of their classification, to this kind of enhancement before the provisions in the last paragraph of the same Article apply.
"The application of the classification rules cannot in any case lead to a classification below the 3rd step of the normal class. »
2° In the sixth and seventh preambular paragraphs, the word "second" is replaced by the word "fourth".
In the first paragraph of Article 25 of the same decree, the word "above" is replaced by the words "and at 2° and 4° of Article 6".
In Article 29 of the same Decree, the first seven paragraphs are replaced by the following:
"For the purposes of article 13 bis of the law of 13 July 1983 referred to above, candidates for detachment in the body of professional agricultural high school teachers must justify one of the titles or diplomas required for the appointment of the winners of the external competition.
"The officials allowed to continue their detachment beyond a two-year period are offered integration into the body of professional agricultural high school teachers. Integration can take place before this deadline upon request of the interested party and after agreement of the administration.
"The services performed in the body, or the framework of original jobs, are assimilated to services performed in the body of professional agricultural high school teachers. »
After Article 29 of the same decree, an article 30 is reinstated as follows:
"Art. 30.-By derogation from the provisions of section 29, for specialties other than those mentioned in the 4th and 5th of the I of section 5, personnel belonging to a teaching or education body, for the access to which the detention of the same titles or diplomas is required for the appointment of the winners of the external contest, may be detached into the body of the professors of agricultural professional high school when they are at least holders of a degree or »
I. ― The provisions of this Order relating to the Certificate of Competency in Languages of Higher Education and the Computer and Internet Certificate apply to candidates received from the 2012 session.
II. - By derogation provisions of the first paragraph of Article 29 of the Decree of 24 January 1990 referred to above in its writing from article 10 of this decree, staff belonging to other teachers or education bodies as mentioned in article 30 of the same decree in its writing from this decree and fulfilling the same conditions of title or diploma may be detached into the body of professional agricultural high school teachers until September 1, 2016.
III. - The deadline for the filing of registration records for the recruitment examinations of agricultural vocational high school teachers, organized for the year 2011, initially set at 22 November 2010, is extended to a date fixed to the 12th day after the date of publication of this decree.
The provisions of Article 8 of this Decree come into force on 1 September 2010.
