The Prime Minister,
On the report of the Minister of State, Minister of Defence and Veterans Affairs,
Vu le Defence code ;
Vu la Act No. 78-17 of 6 January 1978 modified in relation to information technology, files and freedoms, including article 27;
Considering the referral of the National Commission on Informatics and Freedoms dated 19 July 2010;
The State Council (Section of Administration) heard,
Decrete:

It is authorized to implement, by the management of the military personnel of the marine, an automated processing of personal data called "Rhapsodie".
The purpose of this treatment is to:
1° The administrative, financial and operational management of military personnel in the National Navy;
2° The identification and location of civilian personnel and military personnel of other armies in the National Navy trainings.

The data and information categories recorded in the processing are:
1° The registration number on the national directory for the identification of natural persons, for the only operations required for financial management;
2° Other categories of personal data and information listed in the Appendix to this Order.

For their constitution and management, they may access the personal data and information referred to in the annex to this decree, on the basis of their respective powers and the need to know them, the agents authorized by the administrative authority responsible for the processing:
1° Human Resources Administration Offices, as part of their mission to collect and manage data relating to the administrative and financial situation of staff and the registration number on the national directory for the identification of natural persons;
2° From the Rhapsodie Support Centre, as part of their monitoring, data correction and access rights management mission;
3° Marine managers and services, responsible for human resources management in their recruitment, training and career management missions, for the data mentioned:
(a) At 1° to 14° of A du I;
(b) B of I;
(c) In II;
(d) At 1° to 5° and 7° to 12° of III;
(e) At the 2nd of the IV,
the annex to this decree;
4° From the Office of the Armed Police Station, within their administrative and logistical functions, for the data mentioned:
(a) At 1° to 6° of A du I;
(b) At 1° of B of I;
(c) At 1° and 2° of B of II,
the annex to this decree;
5° From the Centre of Human Resources Expertise, as part of their mission of expertise and human resources management and balance, for the data mentioned:
(a) At 1° to 11° and at 15° of A of I;
(b) B of I;
(c) At 1° to 7° and 9° of A of II;
(d) At 1° to 8° and 12° to 14° of B of II;
(e) In the C of II;
(f) In III and IV,
the annex to this decree;
6° Financial agencies of the National Navy, as part of their financial management function, for the data mentioned:
(a) At 1° to 10° and at 15° of A of I;
(b) B of I;
(c) At 2° and 3° of A du II;
(e) At 1° to 3°, at 8° and at 13° and 14° of B of II;
(f) At 1° to 11° and at 13° of III,
the annex to this decree;
7° From the marine psychology department, as part of their assessment and psychological assistance mission, for the data mentioned:
(a) At 1° to 8° of A du I;
(b) At 1° of B of I;
(c) At 2° and 3° of A du II;
(d) At 1°, 2°, 4°, 5° and 9° of B of II;
(e) At the 2nd of the IV,
to this Order.

The personal data and information recorded in the processing are retained until any link to the defence administration is broken.
The retention of data relating to reasons of absence is limited to a period not exceeding two years, unless otherwise provided by law.
Sanctions information is kept for a maximum of five years.

As part of the purposes defined in Article 1, the "Rhapsodie" treatment may be related to the related treatment(s):
1° Human resources of the Ministry of Defence;
2° To conversion;
3° To pensions;
4° In the calculation of the balance and travel expenses;
5° To clothing expenses;
6° The National Military Social Security Fund;
7° At the Fund for Compensation for Family Benefits, Industrial Accidents and Employee Insurance in New Caledonia.

Any automated processing operation authorized by this Order shall be registered including the identification of the user, the date, time and nature of the intervention in the said automated processing. This information is maintained for a period of five years.

The right of opposition provided forArticle 38 of the Act of 6 January 1978 referred to above does not apply to the treatment authorized by this Order.

The rights of access and rectification provided to Articles 39 and 40 of the Act of 6 January 1978 referred to above to the direction of the military personnel of the marine.

The Minister of State, Minister of Defence and Veterans Affairs, is responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.
