In light of Directive 2010/26/EU of 31 March 2010 amending Directive 97/68/EC of the European Parliament and the Council on the approximation of the legislation of member States on measures against the emissions of gas and particulate pollutants from internal combustion engines for non-road mobile machinery;
Considering the environmental code, including articles R. 224-7 to R. 224-14 and R. 226-7;
In view of the decision of 22 September 2005 on the reception of engines intended to be installed on non-road mobile machinery with regard to emissions of gas and particulate pollutants,
Stop:
Section 2 of the above-mentioned Order of September 22, 2005 is amended to read:
I. ― In the second and third paragraphs of Article 2, after the words: "Guideline 97/68/EC referred to above" are inserted the words: ", as amended by Directive 2010/26/EU,".
II ― In the second paragraph of section 2, the words ", section 4.1," are replaced by the words ", sections 4.1 and 8."
In the first paragraph of Article 5 of the above-mentioned Decree of 22 September 2005, after the words: "Guideline 97/68/ CE susvised" are inserted the words: "as amended by Directive 2010/26/EU".
In section 6 of the above-mentioned decision of 22 September 2005, a new paragraph is inserted before the last paragraph, as follows:
"Without prejudice to the previous paragraph, an extension of the derogation period is granted until July 31, 2013, in the category of machines equipped with a handle at their top, for the portable size-haies and portable chainsaws intended for the maintenance of trees with a handle at their top, for professional use and operating in multiple positions, equipped with engines of the SH:2 and SH:3. »
In the last paragraph of Article 8 of the above-mentioned decision of 22 September 2005, the words: "Guideline 97/68/ CE susvised. are replaced by the words: "Guideline 97/68/ CE referred to above, as amended by Directive 2010/26/EU."
The Director General of Energy and Climate, the Director General of Infrastructure, Transport and the Sea, and the Director General of Competitiveness, Industry and Services are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
