Decree of 8 November 2010 on the procedure for marking whole flanks and crocodilian skins provided for in the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES)

In view of the amended European Council Regulation (EC) No. 338/97 of 9 December 1996 on the protection of wildlife species through the control of their trade;
Having regard to the amended European Commission Regulation (EC) No. 865/2006 of 4 May 2006 on the modalities for the application of the European Council Regulation of 9 December 1996;
Considering the environmental code, including articles L. 412-1 and R. 412-1 to R. 412-7;
In view of the decision of 30 June 1998 setting out the modalities for the application of the Convention on International Trade in Endangered Species of Wild Fauna and Flora and Regulations (EC) No. 338/97 of the European Council and (EC) No. 939/97 of the European Commission,

The identification of whole flanks and crocodilian skins tanned or finished, below referred to as "specimens", by means of a removable and legible individual marking loop is mandatory when re-exporting outside the European Union or the assignment within the European Union.
When an original loop affixed by the country of origin has been lost, damaged or missing as a result of the treatments applied to the specimen, the professional having carried out these treatments shall, prior to the re-export or transfer of the specimen, proceed to the withdrawal of the specimen by means of a replacement loop satisfying all the conditions indicated below.

The markup is made using Brooks loops of the SECUR HASP model manufactured by Precintia France 10, Doctor-Pernet Square, 39190 Beaufort.
Each loop is engraved with the FR-RE mention followed by a seven-digit order number. Each number is unique and cannot be reused.
The order number is assigned by the loop manufacturer and under its responsibility.
As a transitional measure, the Brooks loops of the SECUR HASP model acquired from the Fédération française de la maroquinerie, in accordance with the provisions of the November 22, 2000 decision on the marking of whole flanks and crocodilian skins, may be used until December 31, 2011, in accordance with the terms of this Order.

The CTC group professional body is responsible for the control, distribution and management of the loop stock. It addresses them to any professional skin user by applying.
No loops can be addressed directly by the manufacturer to any professional.
The terms of ordering, distribution and management of the stock of loops are specified by agreement between the department responsible for the protection of nature and the CTC group.

The replacement buckle is displayed on the specimen at the location of the original buckle or next to it if it is damaged.

Any person who has replacement loops and is in the process of their establishment must maintain a record of the model annexed to this Order, which is quoted and approved by the Prefect, the Mayor or the Commissioner of Police, where each specimen is identified by his care.
This register specifies, for each specimen that has been marked: the complete number and the date of the import permit corresponding to the introduction of the specimen in the European Union, the number of the original mark, the number of the replacement buckle affixed and the date of the marking. The numbers of unusable replacement loops should also be included in the registry, specifying the reason for their unavailability for marking.
The register is maintained by the professional concerned for ten years from the last mention in this register. The original buckles detached from a skin or flank are kept for three years by the professional concerned.

Any holder and loop user shall maintain his or her register and the original loops maintained at the disposal of the administrative authority responsible for issuing permits and certificates provided for the application of Regulation No. 338/97 of 9 December 1996 referred to above.

In the event of failure or non-compliance with the provisions of this Order found in the establishment of the loops or the maintenance of the register, the provision of loops to the professional in question shall be suspended, at the request of the administrative authority responsible for the application of Regulation No. 338/97 of 9 December 1996, for a period not less than one year.
During this period, the marking of specimens is carried out by a person mandated by the body responsible for the distribution and management of loops.

With respect to a re-export outside the European Union of specimens noticed in accordance with the provisions of this Order, the CITES re-export certificate specifies the number of the replacement loop instead of the original loop. The application for this certificate must be accompanied by a copy of the excerpt from the register on which the information relating to the specimens noted and a copy of the custody page of that register on which the identification of the professional who made the mark is shown.
In the case of a transfer to the European Union of specimens noticed in accordance with the provisions of this Order, the specimens considered shall be accompanied by a copy of the excerpt from the register concerning him and a copy of the custody page of that register on which the identification of the professional who made the mark is shown.

The decision of November 22, 2000 on the procedure for marking whole flanks and crocodilian skins is repealed.

The Director of Water and Biodiversity is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
