Decrete:
I. ― Article D. 7234-4 of the Labour Code is supplemented by a second paragraph, as follows:
"It ensures compliance with decisions taken. »
II. ― Section D. 7234-7 of the same code is amended to read:
1° In the second paragraph (1°), after the words: " board of directors" are added the words: "and the executive office";
2° It is supplemented by a seventh preambular paragraph:
« 6° Calls the executive office. »
I. ― Section D. 7234-8 of the Labour Code is replaced by the following provisions:
"Art. D. 7234-8. - The National Human Services Agency is administered by a board of forty-nine members that includes:
« 1° Fifteen representatives of the State:
– the Director General of Competitiveness, Industry and Services or his representative;
– the Budget Director or his representative;
- the general delegate for employment and vocational training or his representative;
– the Director General of School Education or his representative;
the Director General of Social Cohesion or his representative;
the Director General of Competition, Consumption and Suppression of Frauds or his representative;
– the Director General of the Treasury or his representative;
the Director General of Public Finance or his representative;
the director of social security or his representative;
the Director General of Labour or his representative;
the Director General of Local Government or his representative;
the Director General of Health or his representative;
– the Director General of Agricultural, Agri-Food and Territories Policy or his representative;
– the Director of Research, Studies and Statistics Animation of the Ministry of Economy, Industry and Employment and the Ministry of Labour, Solidarity and the Public Service or its representative;
– the Director of Modernization and Territorial Action of the Ministry of Interior, Overseas and Territorial Communities or its representative.
2° Five representatives of the local authorities and their groups: two representatives of the mayors appointed by the Association of Mayors of France, two representatives of the presidents of general councils appointed by the Assembly of the departments of France and a representative of the presidents of regional councils appointed by the Association of Regions of France;
3° Seven representatives of service employers to the person;
4° Five representatives of professional or consular organizations;
5° Five representatives of employee union organizations;
6° Directors of the National Employees' Old Age Insurance Fund, the National Family Allowance Fund and the Central Social Security Agency or their representatives;
7° A representative of the universal employment-service cheque issuers;
8° A representative of service distributors;
9° The Director of Employment or his representative;
10° The Director of the National Solidarity Fund for Autonomy or his representative;
11° Five qualified personalities, including at least one parliamentarian and one local elected. »
II. ― The first sentence of Article D. 7234-9 of the same code is replaced by a sentence as follows:
"The members of the board of directors shall be appointed for a period of three years, renewable, by order of the Minister responsible for employment for the members listed in 2°, 3°, 4°, 5°, 7°, 8° and 11° of Article D. 7234-8. »
III. ― The first paragraph of section D. 7234-10 of the same code is replaced by a paragraph as follows:
"The loss of quality in respect of which a member under 2°, 3°, 4°, 5°, 7° and 8° of Article D. 7234-8 was appointed shall result in his resignation of the board of directors in full right. »
I. ― The title of sub-section 3 of section 2 of chapter IV of title III of Book II of Part VII of the Labour Code is replaced by the following title: "Executive Bureau".
II. ― Section D. 7234-20 of the same code is replaced by the following:
"Art.D. 7234-20.-The Executive Office:
(a) Can be consulted on the preparation of the boards of directors and on all subjects of the agency's policy on services to the person;
(b) Validates the staffing table and the salary policy proposed by the Director General;
(c) Provides agency grants for job creation and innovation in services to the person, within the limits of the credits voted by the board of directors;
(d) In the event of an emergency, make the necessary decisions, which are subject to the validation of the next first board of directors.
It meets at least twice a year, as well as upon written request from the Minister of Trustee. »
III. ― Section D. 7234-21 of the same code is replaced by the following:
"Art.D. 7234-21.-The Executive Office is chaired by the Director General of the National Human Services Agency.
It is composed of the following board members:
(a) The Director General of Competitiveness, Industry and Services or his Representative;
(b) The Budget Director or his representative;
(c) The General Delegate for Employment and Vocational Training or his Representative;
(d) The Director General of Social Cohesion or his representative;
(e) Two representatives of representative professional organizations. »
IV. ― Section D. 7234-22 of the same code is replaced by the following:
"Art.D. 7234-22.-The deliberations of the Executive Office shall be taken by a majority of the votes of the members present. In case of equal sharing of votes, the President's voice is preponderant.
Representatives of representative professional organizations do not participate in the deliberations on items b and c of Article D. 7234-20.
The Commissioner of Government, the financial controller and the accounting officer attend the sessions with an advisory voice. »
V. ― Section D. 7234-23 of the same code is repealed.
Amendments Articles D. 7234-8 and D. 7234-9 of the Labour Code by Article 2 of this Decree come into force three months after its publication.
