Having regard to the decrees of 12 February 1991 and 15 December 1992 extending the national collective agreement of the workers employed by the construction companies of 8 October 1990 referred to in the decree of 1 March 1962 (i.e. occupying up to ten employees) and to texts amending or supplementing it;
In view of the decree of 8 February 1991 extending the national collective agreement of the workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than ten employees) of 8 October 1990;
Having regard to the regional agreement (Franche-Comté) of 21 December 2009 (two annexes), relating to minimum wages, concluded under the aforementioned national collective agreements;
Considering the request for extension submitted by signatory organizations;
Considering the opinion published in the Official Journal of 15 June 2010;
Considering the opinions collected during the investigation;
In view of the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), collected in accordance with the procedure provided for in theArticle R. 2261-5 of the Labour Code,
Stop:
Acts made mandatory, for all employers and all employees included in the field of professional application of the national collective agreement of workers employed by the enterprises of the building of 8 October 1990 referred to in the decree of 1 March 1962 (i.e. occupying up to ten employees) as supplemented by the decree of 17 March 1992, and in that of the collective agreement of workers employed by the enterprises of the building not covered by the decree of 1962
Article 4 concerning workers employed by the enterprises of the building occupying up to ten employees is extended, excluding the terms "as defined in thearticle 24 of Order No. 82-41 of 16 January 1982 ", only the reference to public policy provisions relating to the application of the SMIC contained in articles L. 3231-1 et seq. of the Labour Code being relevant.
Article 4 concerning workers employed by the construction companies occupying more than ten employees is extended, excluding the terms "as defined in thearticle 24 of Order No. 82-41 of 16 January 1982 ", only the reference to public policy provisions relating to the application of the SMIC contained in articles L. 3231-1 et seq. of the Labour Code being relevant.
The extension of the effects and sanctions of the above-mentioned agreement shall take effect from the date of publication of this Order for the remaining period and the conditions provided for in that Agreement.
The Director General of Labour and the Director of Financial, Social and Logistics Affairs are responsible, each with regard to the execution of this Order, which will be published in the Official Journal of the French Republic.
