Judgment of July 20, 2010 amending the April 25, 2003 decision on the organization of the management of the general administration and the modernization of services in sub-directions

The Minister of Labour, Solidarity and the Public Service,
Vu le Decree No. 87-389 of 15 June 1987 modified for the organization of central administration services;
Vu le Decree No. 90-665 of 30 July 1990 amended on the organization of the central administration of the Ministry of Labour, Employment and Vocational Training and the Ministry of Solidarity, Health and Social Welfare;
Vu le Decree No. 2010-352 of 1 April 2010 the duties of the Minister of Labour, Solidarity and the Public Service;
In view of the decision of 25 April 2003 on the organization of the management of the general administration and the modernization of services in sub-directions;
In view of the advice of the Central Joint Technical Committee of the Ministry of Labour and Social Affairs, which is competent for labour, employment and vocational training services on 29 June 2010,

In section 1 of the above-mentioned decision of 25 April 2003, the second and sixth paragraphs are deleted.

Section 6 is amended to read:
1° The penultimate paragraph of 1° is amended to read:
"It prepares and follows the meetings of the ministerial and central technical committees; it is kept informed of the activity of special and deconcentrated technical committees. »
2° 2° is thus written:
« 2° Implement the national management of officials and agents of the State of the interdepartmental bodies of the labour inspection, of particular bodies and of non-employed personnel of the Ministry of Labour, Employment and Vocational Training.
To this effect:
―it is responsible for the application of the general status of public servants and specific statutes;
― it provides the secretariat of the Joint Administrative Committees of the Civil Servants, placed with the Director of General Administration and Modernization of Services;
- it participates in the management of common bodies whose statutory management is provided by the human resources management of ministries responsible for health, social affairs, social protection, sports, youth and associative life;
― it manages, in conjunction with the human resources management of ministries responsible for health, social affairs, social protection, sports, youth and social life, non-staff personnel Decree No. 78-457 of 17 March 1978 serving in the departments of the ministries responsible for social affairs and providing the secretariat of the joint parity advisory committee of these contractual agents;
― it manages non-registrant personnel Act No. 84-16 of 11 January 1984 and shall serve as the secretariat of the relevant Joint Advisory Committee at the ministerial level, in liaison with the Human Resources Directorate of the Ministries of Health, Social Affairs, Social Welfare, Sports, Youth and Associative Life;
―it organizes the recruitment operations of the staff of which it is responsible. »
3° It is inserted a 3° as follows:
« 3° To manage central administration personnel.
To this effect:
― it pays the main remuneration and accessories;
― it ensures the management and payment of social equity benefits and prepares and follows the central hygiene and security committee of the Ministry of Labour, Employment and Vocational Training;
- it participates in the establishment of the training of agents;
― it ensures the operation of the medical prevention service. »

In article 8, it is added a paragraph as follows:
« 4° Implement the services of proximity to the central administration in the field of telephone and office automation. »

Section 9 is amended to read:
1° In the fourth paragraph of the first paragraph, the words: "and the numbers" are deleted;
2° The last paragraph of the 2° is deleted;
3° All the constitutive paragraphs of the 3° shall be deleted;
4° In the third paragraph of the 4th, the words "especially in the field of telephone, office automation" are replaced by the words "in the field of telephone".

The Director of General Administration and Modernization of Services is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
