Decree No. 2010-869 of 23 July 2010 on the publication of the Memorandum of Understanding between the Government of the French Republic and the Government of the State of the United Arab Emirates on Cooperation in Respect of Diplomatic and Consular Representation, signed at Abu Dhabi on 26 May 2009 (1)

President of the Republic,
On the report of the Prime Minister and the Minister for Foreign and European Affairs,
Considering articles 52 to 55 of the Constitution;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France;
Vu le Decree No. 71-284 of 29 March 1971 publishing the Vienna Convention on Diplomatic Relations and the Optional Protocol on the Mandatory Settlement of Disputes, open for signature at Vienna on 18 April 1961;
Vu le Decree No. 71-288 of 29 March 1971 publication of the Vienna Convention on Consular Relations and the Optional Protocol on the Mandatory Settlement of Disputes, open for signature at Vienna on 24 April 1963,
Decrete:

Article 1


The Memorandum of Understanding between the Government of the French Republic and the Government of the State of the United Arab Emirates on Cooperation in Respect of Diplomatic and Consular Representation, signed in Abu Dhabi on 26 May 2009, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign and European Affairs are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.

    P R O T O C O L E


    OF AGREEMENT BETWEEN THE GOVERNMENT OF THE FRANÇAISE REPUBLIC AND THE GOVERNMENT OF THE UNITED ARAB EMERGENCY ON COOPERATION IN DIPLOMATIC AND CONSULAR REPRESENTATION
    The Government of the French Republic and the Government of the State of the United Arab Emirates, hereafter referred to as the "Parties",
    Based on the close links that bind them;
    Desirous of developing and promoting effective cooperation between the two countries based on the principle of common interests;
    Enlisted by the provisions of the Vienna Convention of 18 April 1961 on Diplomatic Relations and the Vienna Convention of 24 April 1963 on Consular Relations;
    And taking into account the laws and regulations applicable to each party,
    The following agreed:


    Article 1


    A Party may, at the request of the other Party, ensure the diplomatic and/or consular representation of the latter to the State or States to which the other Party has no diplomatic or consular mission, subject to the agreement of the State to which the diplomatic or consular mission is accredited, in accordance with the relevant provisions of the Vienna Convention of 18 April 1961 on Diplomatic Relations and the Vienna Convention of 24 April 1961.


    Article 2


    When one of the Parties ensures the diplomatic representation of the other in accordance with Article 1 of this Memorandum of Understanding, diplomatic agents of the other Party may be assigned to diplomatic missions providing representation. The Affecting Party shall bear all costs related to the assignment of its agents in diplomatic missions of the other Party. The two Parties shall agree with a separate agreement on the practical terms and conditions of assignment, on a case-by-case basis, of officers, including security.


    Article 3


    The consular functions that the diplomatic or consular mission may exercise in favour of the nationals of the Party whose consular representation is provided in accordance with Article 1 of this Memorandum of Understanding shall be the subject of a separate agreement between the Parties.


    Article 4


    Any dispute over the interpretation or application of this Memorandum of Understanding shall be resolved through consultations between the Parties.


    Article 5


    This Memorandum of Understanding may be amended by mutual agreement between the Parties. Any amendment shall take effect once the two Parties have notified each other their consent to be bound by that amendment.


    Article 6


    This Memorandum of Understanding shall enter into force for an indefinite period on the date of its signature. Each Party may denounce it, in writing, through diplomatic channels, on a six (6)-month notice.
    Done at Abu Dhabi on 26 May 2009, in two original Arabic and French copies, both being equally authentic.
