Professional examination of recruitment in the Clerks of Judicial Services, provided by the Decree of 30 May 2003, includes a written eligibility test and an oral admission test.
Applicants must undergo the following tests:
Written test No. 1 (duration: three hours); coefficient 4)
This test consists of two sets of questions:
- issues related to the judicial organization;
― questions that, at the option of the candidate when he or she is enrolled in the examination, have one of the following three options:
Option 1: Civil procedure;
option 2: criminal procedure;
Option #3: prud'homal procedure.
Oral test 2 (total duration of the test: twenty minutes,
with a maximum of ten minutes; coefficient 3)
This trial consists of an interview with the jury on the basis of a dossier on the recognition of the achievements of the professional experience.
This file reveals the candidate's career path, his professional and personal motivations for the performance of the functions of Registrar of Judicial Services.
The interview focuses exclusively on the applicant's file.
The RAEP file and the guide for the constitution of the file are available on the intranet site (HRS of officials – competition) of the Ministry of Justice and Freedoms. The candidate must first complete the RAEP file with a copy of which he/she will then address it by mail in the event of eligibility for the competition organizing service, at a mandatory date set out in the opening of the professional examination. This file will be forwarded to the jury by the organizing service of the contests.
Test number 1:
The program of the written test No. 1 provided for in Article 2 is as follows:
1° The judicial organization:
the Court of Cassation;
the court of appeal;
the court of siege;
― the court of large instance, the court of proceedings, the courts of proximity;
- the council of prud'hommes;
the commercial court;
- Juvenile courts: juvenile courts, juvenile court, juvenile court, juvenile judge.
2° Civil procedure.
The guiding principles of the trial:
- action;
- competence;
- the demand for justice;
– the means of defence;
conciliation;
the judicial administration of evidence;
- intervention;
the hearing of the child in court;
- forbearance, recusal and dismissal;
- the incidents of proceeding;
representation and assistance in justice;
- Public ministry;
• judgment: generalities, different forms of judgments and orders;
the execution of judgments;
- remedies;
– deadlines, judicial officer acts and notifications.
3° Criminal procedure:
public action and civil action;
- Public ministry;
police investigations: preliminary investigation and flogging investigation;
- alternatives to prosecution;
- the phases of instruction;
- appearance on prior guilt recognition;
the judge of freedom and detention;
- judicial review;
- pre-trial detention;
– the mandates of justice;
- Judgment courts;
- juvenile courts in criminal matters;

4° The prud'homal procedure:
― the attribution competence;
territorial jurisdiction;
the referral of the council of prud'hommes;

- the referee prud'homal;
the execution of judgments;

Test 2:
No special program.
A rating of 0 to 20 is assigned to each test. Any rating below 5 is eliminated. Each rating is multiplied by the coefficient applicable to the test.
Only candidates who have obtained at least 40 points in the written test can be admitted to oral examination.
The jury shall determine, in alphabetical order, the list of eligible candidates and, in order of merit, the list of eligible candidates.
If several candidates obtain the same number of points at the end of the written and oral examinations, the priority for admission is given to the candidate who obtained the best score in Test No.
The jury of the Professional Examination of Recruitment in the Clerks of Judicial Services includes at least three category A officials. Qualified reviewers, with advisory voice, may be deputy to the jury.
Members of the jury and deputy examiners are appointed by the Minister of State, the Minister of Justice and Freedoms.
In the event of the President's incapacity, the oldest Category A official in the highest grade is the chair.
The provisions of the Judgment of 18 July 2003 establishing the general organization, the nature of the trials and the programme of the professional recruitment examination for access to the body of the Registrars of Judicial Services are repealed.
The provisions of the Judiciary of 18 July 2003 relating to the terms and conditions of the professional recruitment examination for access to the body of the Registrars of Judicial Services and the composition of the jury are repealed.
The present order will be issued in the Official Journal of the French Republic.
