Having regard to the amended Act of 12 April 1941 establishing the Interprofessional Committee of Champagne Wine;
Considering the decree of October 5, 1945, recently amended by the decree of July 15, 1991, concerning the formalities of the certificate of origin for the exports of wines entitled to the controlled label of origin "Champagne" and wines originating from the winery Champagne,
Stop:
The above-mentioned decision of 5 October 1945 is thus amended:
I. ― Article 2 is as follows:
"The export of wine of controlled label of origin " Champagne is subordinate to the pre-issue of a certificate of origin issued by the interprofessional committee of Champagne wine and to the visa of the copy of this certificate by the customs and indirect rights services during the completion of the export formalities.
In the event of the issuance of the certificate of origin electronically, only the postponement of the certificate's issue number on the declaration of export is required.For this purpose, the interprofessional committee of the Champagne wine is able to prove at any time the existence of the certificate of origin referenced and to produce its content on request from the services of the General Directorate of Customs and Indirect Rights, within the limit of a period of three years to date of issue »
II. ― Article 3 is thus written:
"The certificate of origin is established by the interprofessional committee of Champagne wine upon request of the interested exporter. This application includes the following statements, which are certified by the applicant:
1° Social Reason and Head Office of its business and, where applicable, the category and number of its professional card;
2° Nature, brand and quality of the wines intended for export with indication of the quantities exported under each brand and type of container and, if applicable, of their vintage;
3° Destination location, name and address of the buyer.
For control purposes, the interprofessional committee of Champagne wine may request the exporter a copy of the invoice corresponding to the wines exported.
The validity of the certificate of origin is set at one hundred and eighty days from the date of its issuance by the interprofessional committee of Champagne wine. »
The Director General of Customs and Indirect Rights and the Director General of Agricultural, Agri-Food and Territories are responsible, each with respect to it, for the execution of this Order, to be published in the Official Journal of the French Republic.
