Judgment of November 12, 2009 on recognition of qualification prior to registration in the table of order of expert geometers

Considering Directive 2005/36/EC of the European Parliament and the Council of 7 September 2005 on recognition of professional qualifications;
Vu la Act No. 46-942 of 7 May 1946 Amending the order of the expert geometers, including 4° (b) of Article 3;
Vu le Decree No. 96-478 of 31 May 1996 amended to regulate the profession of expert geometer and code of professional duties, including articles 7 to 15;
In the light of the opinion of the Higher Council of the Order of Experts dated 2 June 2009,

A national of a Member State of the European Union or a party to the agreement on the European Economic Area that wishes to be recognized under the provisions of articles 7 to 15 of the decree of 31 May 1996 referred to in the request to the Minister responsible for urban planning. This application is accompanied by a duplicate file containing the following documents:
1° A civil registration form and a certificate of nationality or any document justifying identity and nationality issued by the competent authority of the State of origin of the applicant. These parts must not have more than three months of date during their production;
2° A curriculum vitae;
3° A copy of the diplomas, certificates or titles attesting to the training received and an analysis of the content of the studies and the courses carried out during the training with the corresponding number of hours;
4° Where applicable, a statement of knowledge acquired by the applicant during his or her professional experience;
5° Depending on the case:
- the indication that the certificate of competence or the title of training are those that a State, a member of the European Union or a party to the agreement on the European Economic Area and other than France, prescribed to access the profession of expert geometer in its territory or to practise it;
- the justification that the applicant has legally exercised full-time for two years in the last ten years the profession of expert geometer in a Member State of the European Union or a party to the agreement on the European Economic Area that does not regulate this profession;
- the indication that the applicant's training is regulated.
The application is in French. The documents mentioned in 1° to 5° are accompanied, as necessary, of their translation into the French language prepared by a translator registered on the national list of judicial experts or on one of the lists of judicial experts drawn up by the course of appeal or by a translator authorized to intervene with the judicial or administrative authorities of another Member State of the European Union or party to the agreement on the European Economic Area.

When the application is received complete, the Minister responsible for urban planning shall acknowledge receipt to the applicant within one month of receipt.
When the application is received incomplete, the Minister for Planning shall inform the applicant within one month of receipt. To this information is attached the list of missing items.
The full application is forwarded by the Minister responsible for urban planning to the Higher Council of the Order of Expert Geometers.

For the review of the application by the commission under thearticle 8 of the decree of 31 May 1996 referred to above, the president of the Superior Council designates a rapporteur among the representatives of the order of the expert geometers sitting on this commission.
The rapporteur prepares a report which is communicated to each of the members of the commission prior to the meeting.

The adaptation course provided for in sections 7-1 (III) and 11 to 14 of the decree of 31 May 1996 referred to above is organized by the Conseil Supérieur de l'ordre.
The Superior Council shall decide on the place(s) of internship taking into account the duration and content set out in the ministerial decision provided for in thearticle 11 of the decree of 31 May 1996 referred to above.
The follow-up of the trainee is provided by the Regional Board of Order in accordance with the provisions of its rules of procedure.
When deciding on the validation of the completed internship, the Regional Council shall forward the trainee's file to the Senior Council.
The Council shall inform the Minister responsible for urban planning of the decision of the Regional Council.

The suitability test provided for in sections 7-1 (III), 11 to 13 and 15 of the decree of 31 May 1996 referred to above is organized at the same time as the sessions of the DPLG Property Expert Geometer Diploma. It consists of the presentation and discussion of a dossier on the subjects of the oral examination program of the DPLG Property Expert Geometer Diploma, the list of which was determined by the ministerial decision provided for in Article 11 of the Decree of 31 May 1996. The file is given to the interested person an hour before the presentation and discussion before the jury. During the discussion of the file, the jury, in particular, ensures the knowledge of the ethics applicable to the expert geometer profession.
The Jury of the aptitude test, composed under the same conditions as the jury of the DPLG Property Expert Geometer Diploma, is designated by an order of the Minister responsible for higher education.
The jury made the results of the suitability test known to the Minister responsible for urban planning.

The decision of 9 September 1996 on the recognition of qualification for the exercise of the expert geometer profession is repealed.

The Director General of Planning, Housing and Nature and the Director General for Higher Education and Vocational Integration are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
