Order of 30 October 2009 establishing an automated personal data processing for the monitoring of civilian personnel in the organizations involved in restructuring operations

Minister of Defence,
In light of Act No. 78-17 of 6 January 1978 amended on computers, files and freedoms, including its article 23 ;
Vu la Act No. 2009-928 of 29 July 2009 relating to military programming for the years 2009 to 2014 and covering various defence provisions;
Vu le Decree No. 2005-850 of 27 July 2005 concerning delegations of signature of members of the Government;
In light of receipt No. 1381481 of the National Commission on Informatics and Freedoms dated 25 August 2009,

It is created in the Ministry of Defence, in the Human Resources Directorate of the Ministry of Defence, an automated personal data processing called "SAR" implemented by the reorganization support mission and whose purpose is to monitor civilian personnel within the organizations involved in the restructuring operations of the Ministry of Defence during the period 2009-2014.

The categories of recorded personal information and data are those relating to:
―at identity: surname, surname, surname, date of birth;
- in the family situation: family situation, number of children;
- training, diplomas and distinctions: training, duration of training;
― to professional life: category status, body, grade, professional family, date of entry into service, assignment (direction and employment establishment), restructured institution (O/N), type of restructuring, position of activity;
- in the economic and financial situation: year of management, allowances, allowances, allowances and supplements of salary, costs taken into account, voluntary severance allowance (IDV), imputation programme, programme operational budget, operational units;
– at departures and mobility: reason and departure date, date of the decision (mobility, voluntary severance allowance), date of the order, state of progress of the procedure, date of premutation, locality of reception (region, department), hospitality authority (direction, institution), type of public reception service.
The retention period of personal information and data thus recorded is not more than 10 years.

The recipients of recorded personal information and data are, depending on their respective responsibilities and the need to know:
– the mobility antennas reclassified;
– regional mobility cells reclassification;
- the mission of accompaniment to reorganizations;
- the central departments of the Ministry of Defence concerned with the monitoring of restructuring (for the consultation of information and data).

The right of opposition provided forArticle 38 of the Act of 6 January 1978 referred to above cannot be invoked as part of this treatment.

The rights of access and rectification provided to articles 39 et seq. of the aforementioned law practiced with the mission of accompaniment of the reorganizations, 8, boulevard Victor, 00463 Armées.
