On the report of the Prime Minister and the Minister for Foreign and European Affairs,
Seen them Articles 52 to 55 of the Constitution ;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The framework agreement between the Government of the French Republic, the Government of the Republic of Mali and the Government of the Socialist Republic of Vietnam to support the implementation of the Yélimané Sustainable Development Support Programme (PADDY), signed in Montreuil on 22 October 2007, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign and European Affairs are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.

    BETWEEN THE GOVERNMENT OF THE FRANÇAISE REPUBLIC, THE GOVERNMENT OF THE MALI REPUBLIC AND THE GOVERNMENT OF THE VIETNAM SOCIALIST REPUBLIC FOR THE IMPLEMENTATION FOR THE IMPLEMENTATION OF THE APPROACH PROGRAMME ON SUSTAINABLE DEVELOPMENT OF YÉLIMANÉ (PADDY)
    Between the Government of the French Republic, the Government of the Republic of Mali and the Government of the Socialist Republic of Vietnam referred to as the Parties,
    Considering that, within the framework of the strategic objectives of the Government of Mali to combat poverty and improve food security and the living conditions of rural people, on the one hand, and the strengthening of the process of decentralization under way, on the other hand, the city of Montreuil has committed itself to participating in the development of the Yéliman Circle (Kayes region, Republic of Mali);
    Bearing in mind that, for this purpose, the city of Montreuil, with nearly twenty years of experience in cooperation with Mali, has supported its Vietnamese partners (Government of the Socialist Republic of Vietnam and province of Hai Duong) wishing to develop new cooperation with Africa in general and Mali in particular. This approach has been undertaken in close consultation with the populations of the region concerned (Cercle de Yélimané and Kayes region), their institutional representatives, both locally and nationally, and the associations of migrants present in France;
    Recalling that, requested by the City of Montreuil, the United Nations Food and Agriculture Organization (OAA), whose expertise in South-South cooperation is recognized, including through its Special Programme for Food Security (PSSA), is likely to provide technical support to the implementation of a programme entitled Yélimané Sustainable Development Support Programme (PADDY);
    Recalling that, for its part, the French Government, which has been accompanying and supporting the efforts made since 1985 by the city of Montreuil in favour of the development of the Cercle de Yélimané, sees in this project a concrete translation of the imperative of solidarity that inspires the external action of France and whose main objective is to encourage the emergence of societies capable of meeting the needs of their populations;
    Recalling that, at the invitation of the Government of Mali, a joint mission, composed of representatives of the OAA, the City of Montreuil, the Government of Viet Nam and the Province of Hai Duong, enabled the development of this programme of action for the development of the Yélimané Circle in the spring of 2003;
    Recognizing that the programme aims to strengthen the technical and operational capacities of the population and to enhance the territories, to combat poverty and to promote food security. It also responds to the needs of the ongoing decentralization process and provides for coordination, management and funding mechanisms with, in particular, the creation of a development association responsible for its implementation;
    Bearing in mind that, under a letter of intent signed on May 12, 2004, in Montreuil, representatives of the Malian and Vietnamese governments, the Vietnamese province of Hai Duong, the Yélimané Circle, the Association for the Development of the Yélimané Circle, the City of Montreuil and the OAA, agreed on the general terms and conditions of their collaboration for the implementation of the PADD;
    Considering that, in this context, the Government of the Republic of Mali has committed itself to supporting the implementation of the programme. He has already signed an implementing agreement with the development association for the implementation of the program, created in the form of an Malian law association and known as the Yélimané Sustainable Development Agency (ADDY);
    Considering that the Government of the Socialist Republic of Vietnam has committed itself to participating in the PADDY within the framework of South-South cooperation, making available its experts and technicians;
    Recalling that the OAA has proposed to provide technical assistance in relations with local, national and international authorities and in coordination with other projects implemented on the same sector, including the Special Programme for Food Security, in accordance with the terms of the letter of intent signed on 12 May 2004 in Montreuil above mentioned;
    Recalling that the Government of the French Republic has made known the interest of France in the programme of cooperation as defined and intends to support it in the implementation phase of the Strategic Orientation Council;
    Considering the need to devote, in a framework agreement, their commitment to support the implementation of the Yélimané Sustainable Development Support Programme;
    Convinced of the need to create the most favourable conditions for the implementation of the programme;
    Desirous of setting up a body for the follow-up and guidance of the Yélimané Sustainable Development Support Program,
    have agreed on the following provisions:


    Article 1


    The Parties to this Agreement confirm their commitments to support the Yélimané Sustainable Development Support Program, respectively.


    Article 2


    The Parties to this Agreement decide to establish a body for the follow-up and guidance of the Yélimané Sustainable Development Support Program, known as the "PADDY Strategic Direction Council".


    Article 3


    The Strategic Orientation Council monitors the cooperation between Malian, Vietnamese and French parties. It ensures compliance with the commitments made by each party.


    Article 4


    The Strategic Direction Council consists of:
    two representatives of the Malian authorities;
    two representatives of the Vietnamese authorities;
    two representatives of the French authorities.
    The COS will be able to solicit advice from the OAA and any other partners that would like it.
    The Strategic Direction Council sets out the rules of its internal operation and considers, if necessary, the modalities for opening this body to other partners.


    Article 5


    The Strategic Direction Board deliberates on the general directions for the implementation of the program.
    It makes resolutions and recommendations to the Yélimané Sustainable Development Agency, responsible for the implementation of the program.
    It works according to the rules of consensus.
    It meets as many times as necessary and at least once a year in a place chosen by its members.
    The welcoming Party ensures the preparation and smooth running of the meeting.


    Article 6


    Parties will ensure that consensus-based approaches are sought to address all contentious issues that would require prior resolution of collaborative actions.


    Article 7


    This framework agreement shall be concluded for an initial period of four years and may be extended for a period of one year renewable by tacit renewal.
    This Agreement shall enter into force on the date of its signature.
    Made in Montreuil on 22 October 2007 in three (3) original copies, each in French and Vietnamese languages, both texts being equally authentic.
