Order of 25 August 2009 establishing an automated personal data processing for the management of recruitment applications

Minister of Defence,
In light of Act No. 78-17 of 6 January 1978 amended on computers, files and freedoms, including its article 23 ;
Vu le Decree No. 2005-850 of 27 July 2005 bearing delegation of signature of members of the Government;
In view of the receipt No. 673348 (version 1) of the National Commission on Informatics and Freedoms dated 4 February 2009,

It is established at the Ministry of Defence, the General Delegation for Arming, an automated processing of personal data called "Management of applications" implemented by the Human Resources Directorate and whose purpose is to monitor recruitment applications.

The categories of recorded personal information and data are those relating to:
- identity (name, first name, quality, date and place of birth, address and personal telephone number, photograph);
- training and diplomas (schools, options, diplomas, technical skills, qualifications and exams held, experience, foreign languages practiced);
– in professional life (statut, function, sector, current society, current situation and wishes [post, gross remuneration, location area], date of availability);
– in the progress of the file (references of the application letter, nature, possible assignment, references to the assignment proposals, status of the file [process steps, date of application satisfaction]).
The retention period of recorded personal information and data cannot exceed two years from the date of application.

The recipients of recorded personal information and data are, depending on their respective responsibilities and the need to know:
– Human resources management services;
- hierarchical authorities.

The right of opposition provided forArticle 38 of the Act of 6 January 1978 referred to above cannot be invoked as part of this treatment.

The rights of access and rectification provided for in sections 39 et seq. of the law of 6 January 1978 referred to above shall be exercised with the General Delegation for Arms, Human Resources Directorate, 26, boulevard Victor, 00457 Armées.

The decision of 27 December 1999 to establish an automated treatment of nominal information relating to the management of recruitment applications by the General Delegation for Arming is repealed.

The Director of Human Resources is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
