Decree No. 2009-1182 of 5 October 2009 on the High Council for Road Education (CSER)

The Prime Minister,
On the report of the Minister of State, Minister of Ecology, Energy, Sustainable Development and the Sea, in charge of green technologies and climate negotiations,
Vu le road code ;
Vu le Decree No. 2006-672 of 8 June 2006 modified on the establishment, composition and functioning of administrative advisory commissions;
Considering the opinions of the permanent interdepartmental road safety group dated 16 April and 18 June 2009;
Having regard to the advice of the Higher Council for the Teaching of Automobile Conduct and the Organization of the Profession dated 4 May 2009,
Decrete:

    It is inserted after chapter III of Book II title I of the Highway Code (regulatory part), a chapter IV, which reads as follows:


    “Chapter IV



    "Senior Council of Road Education (CSER)


    "Art.D. 214-1.-The Higher Council for Road Education is placed with the Minister responsible for Transport, who may take it into account any questions relating to road education, including the learning of driving, driving licence and the organization of professions.
    "The Higher Council for Road Education may present any proposals to the Minister responsible for transport in the field of road education.
    "Art.D. 214-2.-The High Council for Road Education is composed of five colleges. It comprises twenty-eight members:
    « 1° Five State representatives:
    "the delegate to road safety and traffic and the vice-president of the General Council of the Environment and Sustainable Development as representatives of the Minister for Transport;
    "the Director of Modernization and Territorial Action, as the representative of the Minister of Interior;
    "the Director General of School Education, as a representative of the Minister for National Education;
    “– the Director General of Labour, as a representative of the Minister of Labour;
    « 2° Three representatives of the local authorities:
    "a representative designated by the Association of Regions of France;
    "a representative appointed by the Assembly of the Departments of France;
    "a representative designated by the Association of Mayors of France;
    « 3° Twelve elected representatives of professionals working in the field of road safety training, including six representatives of establishment managers and six representatives of employees;
    « 4° Three representatives of civil society:
    "a consumer representative appointed on the proposal of consumer organizations and after the advice of the minister responsible for consumption;
    "a representative of road safety associations designated by the Minister for Transport;
    "a member of the National Youth Council designated by the National Youth Council;
    « 5° Five qualified personalities chosen because of their professional activities or road education work designated by the Minister responsible for transport.
    "The members of the Higher Council referred to in 2°, 3°, 4° and 5° shall be appointed by order of the Minister for Transport for a period of five years.
    "An order by the Minister for Transport, taken after notice by the Minister of the Interior, sets out the modalities for the organization of the elections of the members of the Superior Council mentioned in the 3rd.
    "Art.D. 214-3.-The President of the High Council for Road Education shall be appointed by order of the Minister for Transport, among the members of the Board.
    "Art.D. 214-4.-The High Council for Road Education shall sit at least twice a year. It may be convened at any time by the chair of the board or at the request of at least half of its members.
    "The Higher Council for Road Education establishes its rules of procedure, which is approved by order of the Minister for Transport.
    "Art.D. 214-5.-The secretariat of the High Council for Road Education is provided by the delegation to road safety and traffic. »

    Until the proclamation of the results of the elections of the representatives of the profession to the High Council of Road Education, the representatives of these professions are appointed as a transitional measure by the Minister responsible for Transport, taking into account the results of the elections organized by the decree of 2 February 2004 concerning the organization of the elections of the representatives of the profession to the High Council of the Teaching of Motor Vehicle Conduct and the organization of the profession.

    The Minister of State, Minister of Ecology, Energy, Sustainable Development and the Sea, in charge of green technologies and climate negotiations, the Minister of the Interior, Overseas and Territorial Authorities and the Secretary of State for Transport are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
