Decree No. 2009-1178 of 5 October 2009 organizing the central administration of the Ministry of Defence

The Prime Minister,
On the report of the Minister of Defence,
Vu le Defence code ;
Vu la Act No. 2009-971 of 3 August 2009 relating to the national gendarmerie;
Vu le Decree No. 87-389 of 15 June 1987 modified for the organization of central administration services;
Vu le Decree No. 97-464 of 9 May 1997 amended on the establishment and organization of services with national jurisdiction;
Vu le Decree No. 2009-869 of 15 July 2009 the duties of the Minister of Defence, the Chief of Staff of the Armed Forces and the Chiefs of Staff of the Land, Navy and Air Force;
Vu le Decree No. 2009-870 of 15 July 2009 relating to the responsibilities of the Delegate General for Arms and the Secretary General for the administration of the Ministry of Defence,
Decrete:

I. ― The central administration of the Ministry of Defence consists of:
1° From the military headquarters;
2° Military agencies and joint services attached to the Chief of Staff of the Armed Forces;
3° Staffs of the Army, the Navy and the Air Force;
4° General direction of arms;
5° General Secretariat for Administration;
6° Directions and services.
II. ∙ The directions and services mentioned in 6° I are:
1° The delegation to strategic affairs;
2° General direction of information and communication systems;
3° The delegation to the information and communication of the defence;
4° The General Officers ' Office;
5° The sub-direction of firm offices;
6° The General Directorate of External Security and the Directorate of Defence Protection and Security;
7° The Central Directorate of the Armed Health Service, for the exercise of the powers of the Minister of Defence regarding the contribution of the armed health service to the public health policy.
III. ― In respect of inspection, control, audit, study, advice and evaluation, the Minister of Defence has authority over the general control of the armies to assist him in the direction of the department.
In their area of attribution, the Chief of Staff of the Armed Forces, the Chief Military Officer, the Secretary General for Administration may propose to the Minister that investigations be carried out by the general control of the armed forces.
In addition, the Minister has authority over the Inspectors General of the Armed Forces and the Inspector General of the Armed Health Service.
IV. ― The Minister has authority over the general direction of the National Gendarmerie for the exercise of the duties of the Minister.

In addition to the bodies mentioned in the 4th and 6th of the II and in the III of Article 1 of this Decree, the military bodies being part of the central administration of the Ministry of Defence are:
I. ― The staff:
1° The Military Staff, under the authority of the Chief of Staff of the Armed Forces. In addition to the inspection of the armies, the following organizations are responsible for:
(a) Military Intelligence Directorate;
(b) The central direction of the military health service;
(c) The central direction of the service of the military essences;
(d) Joint management of infrastructure networks and defence information systems;
(e) The central direction of the military police station;
2° The army headquarters, under the authority of the Chief of Staff of the Army. In addition to the inspection of the Army, the following bodies are responsible for the inspection of the Army:
(a) The human resources management of the army of land;
(b) The central direction of the equipment of the army of land;
(c) The treasury service to the armies;
(d) The central direction of the army police station;
3° The Marine Staff, under the authority of the Chief of the Navy Staff. In addition to the inspection of the national navy, the following organizations are responsible for:
(a) The direction of the military personnel of the navy;
(b) The central direction of the fleet support service;
(c) The central direction of the Marine Police Station;
4° The Air Force Staff, under the authority of the Air Force Chief of Staff. In addition to the inspection of the air force, the following organizations are responsible for the inspection:
(a) The human resources management of the air force;
(b) The central direction of the integrated operational maintenance structure of the Department of Defence aircraft equipment;
(c) The central direction of the industrial aeronautics service;
(d) The headquarters of the General Administration and Finance Department of the Air Force.
II. ― The general control of the armies.
III. ― The service of the Joint Post, a nationally competent service, under the Chief of Staff of the Armed Forces.
IV. ― The Office of Investigations of Ground Transport Accidents, the Office of Investigations of Marine Accidents and the Office of Investigations of Air Accidents, National Services, placed respectively with the General Officers of the Land Army, the National Navy and the Air Force, General Inspectors of the Armed Forces.

In addition to the bodies mentioned at 1°, 2°, 3° and 5° of II of Article 1st of this Decree, the civil bodies forming part of the central administration of the Ministry of Defence are:
I. ― The General Directorate of Arming, under the authority of the General Delegate for Arming.
It has authority over the following organizations:
(a) Management of operations;
(b) The direction of the strategy;
(c) The direction of international development;
(d) Technical direction;
(e) Management of plans, programmes and budget;
(f) Human resources management;
(g) The central service of modernization and quality;
(h) Arms inspection.
II. ― The General Secretariat for Administration, under the authority of the Secretary General for Administration.
It has authority over the following organizations:
(a) Financial affairs management;
(b) The Human Resources Directorate of the Ministry of Defence and the Defence Reversion Agency, a national authority department, which is attached to it;
(c) The Directorate of Legal Affairs;
(d) The direction of memory, heritage and archives and the historical service of defence, a service of national jurisdiction attached to it;
(e) National service management;
(f) The leadership of the statutes, pensions and social reintegration;
(g) Central Directorate of Defence Infrastructure Service;
(h) Paris' support service of the central administration;
(i) The sub-direction of budgetary programs.

The Minister responsible for the reform of the State contravenes the texts setting out the powers and organization of the bodies cited at 1°, 2°, 3° and 5° of II of Article 1, III and IV of Article 2 and Article 3 of this Decree.

The provisions of amended Decree No. 2000-1178 of 4 December 2000 organizing the central administration of the Ministry of Defence are repealed. However, the first paragraph and II of Article 2 of this Decree will be repealed as of the publication of the decree that will amend the decree Decree No. 85-1057 of 2 October 1985 modified for the organization of the central administration of the Ministry of Interior and Decentralization, following the Act No. 2009-971 of 3 August 2009 on the National Gendarmerie, and no later than 31 December 2009.

This decree comes into force on the day after its publication. However, the provisions in the e of 1° I of Article 2 come into force on 1 January 2010. The provisions of the d of 2°, c of 3° and d of 4° of I of section 2 are repealed on the same date.

The Minister of Budget, Public Accounts, Public Service and State Reform and the Minister of Defence are responsible, each with respect to him, for the execution of this decree, which will be published in the Official Journal of the French Republic.
