In light of Act No. 78-17 of 6 January 1978 amended on computers, files and freedoms, including its article 23 ;
Vu le Decree No. 2005-850 of 27 July 2005 concerning delegations of signature of members of the Government;
Considering the receipt of N° 1282399 of the National Commission on Informatics and Freedoms dated 5 January 2009,

It is created at the Ministry of Defence, the sub-direction of professional support and reclassification of the Human Resources Directorate of the Ministry of Defence, an automated personal data processing called "AGIR" and the main purpose of which is the implementation of the military personnel conversion system and the professional integration of the staff spouses of the Ministry of Defence.

The categories of recorded personal information and data are those relating to:
- identity: name(s), first name(s), civility, sex, date and place of birth, alliance identifier, defense ID, personal address, telephone and personal fax numbers, personal email address;
- in the family situation: family situation of the agent and identity of the spouse [name(s), first name(s), date of birth, number of registered defence (if defensive)], number of children;
- in the military situation: situation with regard to the national service [degag, oversit or exempted], position under the flags, service duration, army, weapon, body, grades, speciality(s) possible;
- training, diplomas and distinctions: level of study, diploma(s), certificate(s), initial training, professional training(s), personal training(s), foreign language(s), professional examination(s);
― in professional life: recruitment mode [courses, examinations, direct recruitment], army, weapon, body, grade, assignments [places, dates], professional address, telephone and facsimile professional numbers, e-mail professional address, date of entry into service, delisting date, actual services, starting position, pension entitlements, orientation session, orientation maintenance, competency balance;
― to reclassify and reconversion professional: contact details of the training agency [number SIRET or IBAN, name, address, telephone and fax numbers, internet address], training language, ROME training code, date and duration of training, place of training, support of training (past or not according to appropriate procedure), cost of training (devis), competitive quotation
― to support spouses to employment: characteristics of the spouse seeking employment [study level, diploma(s), certificate(s), initial training, professional training(s), personal training(s), contact(s)
The retention period of personal information and data thus recorded is four years after the conversion period.

The recipients of recorded personal information and data are, depending on their respective responsibilities and the need to know:
– managers of reclassification, conversion and support actions to the employment of the human resources of the Ministry of Defence;
- the superiors of the concerned;
– the Department of Defence Staff, Branches and Services.

The right of opposition provided forArticle 38 of the Act of 6 January 1978 referred to above cannot be invoked as part of this treatment.

The rights of access and rectification provided to articles 39 et seq. of the aforementioned law operates with the Human Resources Directorate of the Ministry of Defence, sub-direction of professional support and reclassification, 28, boulevard Victor, 00460 Armées.

The Director of Human Resources of the Ministry of Defence is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
