President of the Republic,
On the report of the Prime Minister and the Minister for Foreign and European Affairs,
Seen them articles 52 to 55 of the Constitution;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The framework agreement for agricultural cooperation between the Government of the French Republic and the Government of the Republic of Madagascar, signed in Antananarivo on 20 October 2008, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign and European Affairs are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.

    A C C O R D-C A D R E

    AGRICOLE COOPERATION TO THE GOVERNMENT OF THE FRENCH REPUBLIC AND GOVERNMENT OF THE MADAGASCAR REPUBLIC
    The Government of the French Republic, represented by the President of the General Council of the Meeting, Ms. Nassimah Dindar,
    on the one hand,
    and
    The Government of the Republic of Madagascar, represented by the Minister of Agriculture, Livestock and Fisheries, Mr. Armand Panja Ramanoelina,
    on the other hand,
    The Parties shall,
    Considering the Constitution of the Republic of Madagascar;
    Having regard to French law no. 2000-1207 of 13 December 2000 for orientation to the Overseas;
    Considering the Madagascar-France partnership framework document (2006-2010) signed on 11 May 2006 in Antananarivo;
    Considering French law No. 2005-95 of 9 February 2005 on the international cooperation of local authorities and water agencies in the areas of water supply and sanitation;
    Vu le Decree No. 2006-530 of 9 May 2006 relating to the French Development Agency and amending the monetary and financial code (regulatory part) ;
    See?Article L. 1115-1 of the General Code of Territorial Communities introduced by Act No. 2004-758 of 29 July 2004 pursuant to Article 72-2 of the Constitution on the financial autonomy of territorial authorities;
    In view of Decree No. 2008-518 of 6 June 2008, establishing the powers of the Ministry of Agriculture, Livestock and Fisheries and the general organization of its ministry;
    Considering the Customs Code of the Republic of Madagascar, including its article 240 (L. No. 2005-029 of 29 December 2005) in respect of the total or partial duty-to-tax import;
    Having regard to Order No. 16152 / 2007 of 21 September 2007 of the Republic of Madagascar setting out the comprehensive list of materials, goods and/or equipment that are entitled to the exemption of duties and taxes, constituting in donations of a city and/or a twin community, and determining certain aids, pursuant to the provisions of Article 240(e) and (f), paragraph 1 of the Customs Code;
    Considering the importance of the historical and cultural ties that unite The Meeting and Madagascar and the relations of fraternity and solidarity arising therefrom;
    Considering the sense of belonging to the indianocean space shared by the people of La Réunion and Madagascar;
    Considering the essential place agriculture has in the meeting and Malagasy economy;
    Considering the willingness of the Reunion and Malagasy authorities to promote a bilateral cooperation policy that is part of a sustainable co-development approach at the service of La Réunion and Madagascar, taking in particular support of the valorization of their respective assets;
    Considering the strategy of the Malagasy government formalized in Madagascar Action Plan which sets out the policy directions of the State for the period 2007-2011.
    The following agreed:

    Article 1

    Purpose of the convention

    The purpose of this Convention is to define the principles and areas of cooperation with regard to agriculture and agro-industry, which both Parties consider as a priority and which should serve as a basis for the broad development of bilateral relations between La Réunion and Madagascar.

    Article 2

    Principles

    Parties are committed to promoting agricultural cooperation in the priority areas referred to in Article 3, ensuring that concerns related to environmental conservation and ecological balances are taken into account, and that projects identified and supported can be self-reported in the long term.In this regard, Parties promote decentralized international cooperation based on the principles of coherence, complementarity, mutual respect and sustainable co-development.

    Article 3

    Areas of cooperation

    Parties identified five priority areas of cooperation:

    3. 1.The organization of agriculture

    Parties are committed to promoting the exchange of information, expertise and know-how on the organization and operation of agricultural structures for development and extension, as well as the organization and operation of agricultural cooperatives.
    Support to producer groupings and the structuring of production, processing and marketing sectors will be encouraged and accompanied.

    3. 2. Organization, networking and standardization
    in the field of phytosanitary and animal health

    Parties are committed to promoting active cooperation in this area. This cooperation will be carried out in close coordination and complementarity with existing and developing plant and animal health programmes in the Indian Ocean.

    3. 3. Support for the structuring of agricultural sectors

    production, processing and marketing

    The Parties agree to support the structuring of agricultural production, processing and marketing industries as a strong focus of their cooperation, in a spirit of mutually win-win interest.
    Upstream of the production lines, Parties are committed to bringing together professionals and facilitating exchanges of know-how and good agricultural practices, particularly in terms of seeds, fertilization, mechanization, animal feed, irrigation and water management.
    Downstream, Parties agree to facilitate viable storage, packaging, processing, and marketing of agricultural products for domestic and/or international markets.
    In this regard, Parties agree to encourage approaches to standards and quality of products.

    3. 4. Exchanges in teaching

    and agricultural training

    As long as these exchanges initiate or support structured and supported projects by the parties, they provide all their support to the establishment of sustainable cooperation programmes, including twinning between the meeting and Malagasy agricultural educational institutions, as well as between local governments and NGOs involved in this area.
    These programs may include the strengthening of the capacity of the technicians and stakeholders involved in these sub-sectors, the provision of equipment, the provision of teaching materials and documentation, expert missions, teaching missions, internship grants for teachers and scholarships for students.

    3. 5. Research

    The Parties agree on the research and identification of new adoptable sectors in Madagascar and/or the Meeting for the expansion of markets and the improvement of the international marketing of products.

    Article 4
    Method of implementation

    4. 1. Programme of Action

    In order to facilitate the implementation of these areas of cooperation and their possible duplication, it was agreed between the Parties to establish an annual three-year action programme to be reviewed annually.

    4. 2. Follow-up to the action programme

    All actions carried out under this Framework Agreement will be subject to regular follow-up by the Parties, which will agree on the necessary adjustments.
    A steering committee will be established to monitor the implementation of this framework agreement through annual action plans and to ensure its effective implementation.
    Parties will jointly determine the organization and mode of operation of this committee, including the human, material and financial aspects.
    The Committee will meet once a year with all relevant public and private partners.At the end of a two-year period, a first evaluation of all actions will allow the parties to consider the extension of the devices.

    4. 3. Programme implementation

    This Framework Agreement is implemented within the limits of the budgetary availability of the parties.

    Article 5

    Duration of the framework agreement

    This Framework Agreement shall be concluded for a period of three years renewable by tacit renewal. It comes into force from its date of signature.
    Any dispute relating to the interpretation and implementation of this Agreement shall be settled by negotiation between the Parties.
    It may be denounced at any time by each Party with a written notice of three months from the notification.
    In the belief that the Representatives of the Parties, duly authorized to do so, have signed and affixed their seal to this Convention.
    Done at Antananarivo on 20 October 2008, in two French-language copies for each copy equally authentic.
