Judgment of 9 June 2009 amending the Order of 15 December 2000 concerning the organization and programme of recruitment examinations of labour inspectors

Vu le Decree No. 2003-532 of 18 June 2003 relating to the establishment and use of the supplementary lists of admission to the public service bodies of the State;
Vu le Decree No. 2003-770 of 20 August 2003 amended with special status of labour inspection;
Vu le Decree No. 2004-1105 of 19 October 2004 concerning the opening of recruitment procedures in the public service of the State;
Vu le Decree No. 2007-196 of 13 February 2007 relating to the equivalences of diplomas required to present themselves to the public service access competitions and employment frameworks;

Section 1 of the above-mentioned Order of 15 December 2000 is amended as follows:
"Art. 1st.-The two contests instituted by theArticle 5 of Decree No. 2003-770 of 20 August 2003 bearing special status of the labour inspection body for the recruitment of labour inspectors shall be authorized by joint order of the ministers responsible for labour and employment after the Minister responsible for the public service, in accordance with provisions of Article 2 of Decree No. 2004-1105 of 19 October 2004 concerning the opening of recruitment procedures in the public service of the State and announced by publication in the Official Journal of the French Republic. »

In article 2 of the above-mentioned decree of 15 December 2000, after the words "by telematic" of the first sentence, the words are added: "in the conditions fixed by the Decree No. 95-681 of 9 May 1995 fixing the conditions for the registration of candidates to the public service competitions of the State by telematic means".

Section 3 of the above-mentioned Order of 15 December 2000 is repealed.

Article 4 becomes Article 3and reads:
"Art. 3.-The external and internal competitions established by theArticle 5 of Decree No. 2003-770 of 20 August 2003 bearing the particular status of the body of the labour inspection shall include the following tests:



1. Written proof of eligibility
External Competition
(These four tests are mandatory)


1. A composition on general, political, economic and social developments since 1945 (duration: five hours); coefficient 3).
2. A composition of labour law or European social law (duration: four hours); coefficient 4).
3. At the selection of the candidate, made at the time of registration, a composition covering one or more subjects in one of the following four optional subjects (duration: four hours); coefficient 2)
public law;
private law;
– business economy, employment policies and social policies;
- the sciences of matter or life.
4. A case-by-case test on working conditions, involving knowledge of occupational health and safety, ergonomics and organization of work, basic notions of physics, chemistry or biology (duration: four hours; coefficient 3).


Internal competition
(These four tests are mandatory)


1. Drafting, on the basis of a record relating to work, employment and vocational training, a note to verify the candidate's writing, analysis and synthesis qualities and his ability to identify appropriate solutions (duration: four hours; coefficient 3).
2. A composition of labour law or European social law (duration: four hours); coefficient 4).
3. At the selection of the candidate, made at the time of registration, a composition covering one or more subjects in one of the following four optional subjects (duration: four hours); coefficient 2)
public law;
private law;
– business economy, employment policies and social policies;
– the sciences of matter and life.
4. A case-by-case test on working conditions, involving knowledge of occupational health and safety, ergonomics and organization of work and elementary concepts in the sciences of matter or life (duration: four hours; coefficient 3).


2. Oral admission tests
External Competition
(These three tests are mandatory)


1. At the selection of the candidate, made at the time of registration, an interrogation on one of the following optional materials (duration: fifteen minutes; coefficient 2; preparation: fifteen minutes:
public law;
private law;
– business economy, employment policies and social policies;
- the sciences of matter or life.
The chosen option material must be different from the one on which the candidate composed for the third eligibility test.
2. An interview with the jury to assess the candidate's abilities, motivation and relational abilities to be a labour inspector (duration: forty-five minutes); coefficient 4).
3. A conversation in the language chosen at the time of registration: English, Spanish, Portuguese, German, Italian or Polish, based on a text written in this language (duration: fifteen minutes; coefficient 1 ; preparation : fifteen minutes).


Internal competition
(The first and the second test are mandatory)


1. At the selection of the candidate, made at the time of registration, an interrogation on one of the following optional materials (duration: fifteen minutes; coefficient 2; preparation: fifteen minutes:
public law;
private law;
– business economy, employment policies and social policies;
– the sciences of matter and life.
The chosen option material must be different from the one on which the candidate composed for the third eligibility test.
2. An interview with the jury to assess the candidate's abilities, motivation and relational abilities to be a labour inspector (duration: forty-five minutes); coefficient 4).
To conduct this interview, which has as its starting point a candidate's presentation on his or her professional experience, for a period of not more than ten minutes, the jury has the candidate's file for recognition of the achievements of the professional experience.
For the purpose of this interview, the candidate shall prepare a record for recognition of the achievements of his or her professional experience with the entries listed in the appendix to this order that he or she shall give to the organizing service at a date fixed in the opening of the contest.
3. Applicants to the internal contest may, if requested at the time of registration, undergo an optional foreign language test consisting of an interview from a short text written in one of the following languages: German, English, Spanish, Italian, Portuguese or Polish (duration: fifteen minutes, preceded by a preparation of fifteen minutes; coefficient 1), the candidate's choice being expressed at the time of the examination.
The notes obtained at the optional foreign living language test of the internal competition are taken into account only for their part exceeding the score of 10 of 20. The additional points obtained in the optional test are added to the total of the points obtained in the mandatory tests for the establishment of the admission list. »
The programs of the external and internal competition examinations and the contents of the professional experience presentation file are set by joint decree of the ministers responsible for labour and employment. »

Sections 5 to 8 of the Order of 15 December 2000 become sections 4 to 7.

Articles 9 to 12 become articles 8 to 11 as follows:
"Art. 8.-The jury of each contest includes:
"– the Director of General Administration and Service Modernization, President, or his representative;
“—a Inspector General of Social Affairs;
"– the general delegate for employment and vocational training or his representative;
“– the Director General of Labour or his representative;
"– the Director of Research, Studies and Statistics or his representative;
“– an assistant director of work;
"One or more directors of work;
"one or more civil administrators or heads of office in the central departments of the ministries responsible for labour or employment;
"a civil administrator or head of office in the central services of another department;
“– one or more qualified personalities.
"Can be referred to as specialized corrective and examiners. Specialized reviewers may participate in the jury's deliberations, with an advisory voice for the award of notes related to the trials they have assessed.
"Each jury is chaired by the Director of General Administration and Service Modernization or, if not, by the Inspector General of Social Affairs.
"The members of the jury are appointed by order of the Minister of Labour. They can be common to different competitions.
"Art. 9.-The tests are recorded from 0 to 20.
"No one can be declared admitted if he did not participate in all the mandatory tests or if he obtained, at the second qualifying test of each contest, a score less than 6 out of 20, and a total of points at the eligibility and admission tests less than 190 for the external competition and 180 for the internal competition.
"Art. 10.-In case of equal sharing of votes in the proceedings of the jury, the president's debate is preponderant.
"Art. 11.-For each contest, following the examinations of eligibility, the jury sets out the list of candidates authorized to take part in the examinations, if applicable after the equalization of the grades assigned to the candidates for the various examinations of eligibility.
"In the same conditions, at the end of the admission tests, the jury sets out the list of admissions, if applicable after the equalization of the notes attributed to the candidates for oral examinations.
"He establishes, in the same order, a supplementary list. This supplementary list remains valid until the beginning of the tuition immediately following the results of the session concerned.
"If several candidates have obtained the same number of points, they are departed as follows when the admission list is established:
"—priority is given to those who have obtained the highest rating in the written test of labour law and European social law;
"– in the event of equal points to this test, the priority is given to the candidate who obtained the best grade in the second admission test. »

The provisions of this Order come into force for the competitions organized for the year 2009.

The Director of General Administration and Modernization of Services at the Ministry of Labour, Social Relations, Family, Solidarity and the City is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
