Order dated 12 May 2009 with the withdrawal of the SENAO brand radio terminal equipment market pursuant to Article R. 20-21 of the Post and Electronic Communications Code

Minister of Economy, Industry and Employment,
Having regard to Directive No. 1999 / 5 / EC of the European Parliament and of the Council of 9 March 1999 concerning hertzian equipment and telecommunications terminal equipment and mutual recognition of their compliance, including Article 9;
Given the Post and Electronic Communications Code, including its articles L. 34-9, L. 40, L. 43, R. 20-1, R. 20-4, R. 20-7, R. 20-11, R. 20-21 and R. 20-44-11 ;
See?arrested on 8 October 2003 relating to consumer information on radio terminal equipment under section R. 20-10 of the Post and Telecommunications Code;
Considering the decision of 8 October 2003 setting technical specifications for radio terminal equipment;
In view of the March 21, 2005 decision on the marketing of radio equipment using frequency bands whose use is not harmonized throughout the European Community, pursuant to Article R. 20-11 of the Post and Electronic Communications Code;
In view of the decision of 6 June 2006 on the marking of radio and electronic communications terminal equipment pursuant to Article R. 20-10 of the Post and Electronic Communications Code;
Having regard to the decision of 6 June 2006 on declarations of conformity referred to in articles R. 20-6 and R. 20-10 of the Post and Electronic Communications Code;
Based on the record prepared by the National Frequency Agency dated February 18, 2009, completed on March 16, 2009, mentioning the operation of the aircraft in the frequency bands assigned to the Department of Defence and identifying various non-compliances, including:
- for the SENAO SN 258 plus, in the offence report dated January 28, 2009;
- for the SENAO SN 258 plus new aircraft, in the offence report dated March 10, 2009;
- for the SENAO SN 358 aircraft, in the offence report dated November 14, 2007;
- for the SENAO SN 358 plus, in the offence report dated January 28, 2009;
- for the SENAO SN 1258 aircraft, in the offence report dated January 8, 2009,

Are removed from the market, in any place where they are located, for non-compliance with at least one of the essential requirements mentioned in section R. 20-1 of the Post and Electronic Communications Code, non-compliance with the provisions of section R. 20-10 of the same code relating to the marking of equipment, information and declaration to accompany them, and omission of the declaration provided for in section R. 20-11 of the same code, the following
- SN 258 plus;
― SN 258 plus new;
― SN 358;
― SN 358 plus;
― SN 1258.

The Director General of Competitiveness, Industry and Services is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
