Definitions, object, application field
and competent authorities

For the purposes of this Order, all definitions given in Article 3 of the above-mentioned Directive 2007/46/EC and thearticle R. 321-6 of the road code are applicable and:
"EC acceptance by type" means the act by which a Member State certifies that a type of vehicle, system or equipment meets the administrative provisions of the above-mentioned Directive 2007/46/EC and the technical requirements listed in Annex IV or Annex XI to this Directive and applicable in accordance with the provisions set out in Annex 1 to this Order;
"EC Receipt by Type of Small Series" or "KS Receipt": a CE Receipt by Type for a vehicle type produced within the quantitative limits set out in Appendix XII, Part A, Section 1, of the above-mentioned Directive 2007/46/EC and meeting at least the requirements set out in Appendix IV to this Directive;
"National Reception by Type of Small Series" or "NKS Receipt": a Type Receipt for a vehicle type produced within the quantitative limits set out in Appendix 2 to this Order and meeting at least the requirements set out in Annex 3 to this Order;
"individual reception": the act by which a Member State certifies that a particular vehicle, whether unique or not, complies with the applicable administrative provisions and technical requirements;
• "System": any system of a vehicle, such as brakes, pollution control devices caused by exhaust gases, interior fittings, etc., to meet the requirements of a regulatory act;
"Equipment": any device to meet the requirements of a regulatory act intended to be part of a vehicle as a component or technical entity or to ensure the protection of its occupants;
"Component": any device, such as a lamp, to meet the requirements of a regulatory act and intended to be part of a vehicle, which may be received separately when expressly provided by the regulatory act;
"Technical entity": any device, such as an anti-recessing bar, to meet the requirements of a regulatory act and intended to be part of a vehicle, which may be received separately but only in connection with one or more specific types of vehicles, where the regulatory act expressly provides;
"Hybrid motor vehicle": a vehicle equipped with at least two different energy converters and two different energy storage systems (packed) for propulsion purposes;
"A hybrid electric vehicle": a hybrid vehicle that, for the purpose of mechanical propulsion, generates energy from the following two sources of energy/power stored on the vehicle:
- a consumable fuel;
– an energy/power storage device (e.g. battery, condenser, inertia/generator steering wheel, etc.);
― "Maximum weight" targeted toR. 311-1 road code :
For a tractor vehicle designed to be connected to a semi-trailer or to a central axle trailer:
- mass of the tractor vehicle in order of operation, increased by the mass corresponding to the maximum vertical static load transferred to the tractor vehicle by the semi-trailer or the central axle trailer, and, if applicable, increased by the maximum mass of the load of the tractor vehicle itself;
For a semi-trailer or a central axle trailer:
- corresponds to the vertical static load transmitted to the ground by the axle or axles of the semi-trailer or the central axle trailer coupled to the tractor vehicle and carrying their maximum load;
In other cases:
• technically permissible maximum load mass.

This Order sets out the conditions under which CE receptions by type, CE receptions by type of small series, national receptions by type of small series and individual receptions are delivered in France to vehicles of categories M, N or O, defined at theR. 311-1 road codedesigned and constructed in one or more stages, as well as at the CE reception by type of systems and equipment and built for these vehicles, in accordance with the requirements of the above-mentioned Directive 2007/46/EC.
When the receipt of the vehicles referred to in paragraphs 3 and 4 of Article 2 of the above-mentioned Directive 2007/46/EC is requested, the applicable rules are those defined for the type of reception requested and the corresponding international category.
All technical texts related to the special character of the received vehicle, in specific characteristics or because of its use, are applicable in addition to the requirements applied to the basic vehicle.
This Order also sets out the terms and conditions for the establishment of conformity certificates issued by the manufacturers for the registration in France of vehicles that have been the subject of a CE reception or a national reception by type of small series according to the aforementioned Directive 2007/46/EC.

In application of thearticle R. 321-7 of the road code and in accordance with Article 4.2.2 of the above-mentioned Order of 9 July 2008, the sub-direction of vehicle safety and emissions shall, by delegation, exercise the function of competent authority in respect of receipt within the meaning of Article 3, paragraphs 29 and 30, of the above-mentioned Directive 2007/46/EC.
As such, she:
― animates and coordinates the activity of administrative and technical services in charge of the reception of motor vehicles, their trailers and systems and equipment for these vehicles;
- organizes the examination of reception records and the issuance of receptions of motor vehicles, their trailers and systems and equipment for these vehicles;
- delivers CE receipts by type of components and equipment other than the technical entities referred to in Schedule IV of the above-mentioned Directive 2007/46/EC, or which are subject to registration according to regulations annexed to the above-mentioned Geneva Agreement of 20 March 1958;
― means the regional management of Ile-de-France's industry, research and environment as a responsible administrative department:
- to manage the issue of national reception numbers by type of small series;
- to issue CE receptions by type:
- vehicles of categories M, N or O;
- small series of vehicles of categories M, N or O;
- systems and technical entities of vehicles of categories M, N or O covered by the regulatory acts listed in Annex IV to the above-mentioned Directive 2007/46/EC;
- to deliver national receptions by type of small series of passenger cars;
- to deliver individual receptions of the original passenger cars;
- to communicate to the Member States the information, and in accordance with the terms set out in Article 6 of the above-mentioned Directive 2007/46/EC;
- to receive and instruct for their recognition at the national level the NKS reception records transmitted by the other competent authorities in the field of EC reception pursuant to the provisions of Article 6 of Article 23 of the aforementioned Directive 2007/46/EC;
- to receive and instruct, in conjunction with the competent receiving authority, the recalls of vehicles notified by the manufacturers and other member States in accordance with the provisions of Article 32 of the aforementioned Directive 2007/46/EC;
― means the regional directorates of industry, research and the environment (DRIRE) and the regional directorates of the environment, development and housing (DREAL) as administrative departments to review the application files submitted by manufacturers and to:
- to issue national receptions by type of small series of vehicles of categories M (excluding passenger cars), N or O;
― issuing individual receptions of new vehicles of categories M (excluding original passenger cars), N or O;
― communicate to applicants the information provided, and in accordance with the terms set out in section 23, paragraph 7, of the above-mentioned Directive 2007/46/EC;
- to instruct, for the purpose of their individual recognition at the national level, the records of NKS reception or individual receipt transmitted by an applicant pursuant to the provisions of Article 7 of Article 23 or Article 24, paragraph 6 of Directive 2007/46/EC referred to above;
- to conduct, in particular at the request of the competent receiving authority, monitoring visits to the NKS receptionists;
― means the laboratory of the Technical Union of the Automobile, Motorcycle and Cycle (UTAC), Autodrome of Linas, 91310 Montlhéry, as a technical service responsible for carrying out:
- the tests and inspections planned in respect of the receipt of vehicles, systems and equipment referred to in the above-mentioned directive 2007/46/EC, by all regulatory acts specified in annexes IV and XI of the above-mentioned directive 2007/46/EC, by the regulations annexed to the above-mentioned Geneva Agreement and by the decrees set out in Annex 3 to this Order, in accordance with the provisions of Articles 41 and 42 of Directive 2007/46/EC referred to above;
- operations for conformity of production control set out in Annex X of Directive 2007/46/EC and Article 12 of this Order;
― means the central technical body (CTO) covered by the decree of 4 October 1991 referred to above to carry out all operations related to the attribution of the national type identification code (NCC) issued to vehicles received by type, their communication to the authorities in charge of registration, the constitution and maintenance of the receiving data bank of the types of these vehicles, and the monitoring of the evolution of the technical characteristics and performance of these vehicles.

Tests, verifications and inspections for the inspection of the requirements for receipts issued under this Order shall be borne by the applicants.



CE reception by type

CE receptions by type of vehicles, systems or equipment and communications relating to such receptions shall be carried out in accordance with the provisions of Articles 6 to 16 and the corresponding annexes to the above-mentioned Directive 2007/46/EC.

The applicant or the holder of a CE reception by type shall, upon request, provide to the competent receiving authority the elements allowing to continuously verify compliance with the provisions of Article 12 of the above-mentioned Directive 2007/46/EC.

Where a CE receipt by type of vehicle loses its validity as a result of the provisions provided for in Article 17, paragraph 1, of the above-mentioned Directive 2007/46/EC, the manufacturer shall notify the competent authority in respect of receipt, which shall inform the authorities of the other Member States under the conditions provided for in that Article.



Marking

The manufacturer of equipment that is either part of an application system, in accordance with Article 19 of the above-mentioned Directive 2007/46/EC, on each equipment manufactured in accordance with the received type, the CE acceptance mark by type required by the applicable regulatory act and in accordance with the requirements of Appendix VII to the above-mentioned Directive 2007/46/EC.
When a CE acceptance mark is not required by type, the manufacturer shall apply at least its trademark or trade mark and the type number and/or identification number.



Derogations for technologies
or new concepts

Manufacturers who wish to benefit from one of the provisions provided for in Article 20 of the above-mentioned Directive 2007/46/EC shall submit a request in accordance with the specifications of this Article to the competent receiving authority.



CE receptions by type of small series

Receipts by type of small series of vehicles shall be carried out in accordance with the provisions of Article 22 of the above-mentioned Directive 2007/46/EC and the relevant provisions of Articles 5 to 9 of this Order.



National receptions by small series type

The national receipt by type of small series shall be granted, subject to compliance with the provisions of Article 12, pursuant to Article 23 of the above-mentioned Directive 2007/46/EC, to vehicles produced within the quantitative limits set out in Annex 2 to this Order and meeting for each regulatory area the requirements set out in Annex 3 to this Order.
For each regulatory area, the level of requirement prescribed by this Schedule may be replaced by the level prescribed in Appendix IV, or Annex XI for special-use vehicles, of the above-mentioned Directive 2007/46/EC.

The national receipt by type of small series is granted to the manufacturers complying with either the conformity of production procedures referred to in Annex X of the above-mentioned Directive 2007/46/EC, or the terms of the technical specifications defined by the above-mentioned decision of 18 November 2005.
The initial assessment or initial control of compliance shall be carried out by the technical service designated in Article 3 of this Order.
The verification conducted to ensure conformity of production to the type received shall be carried out in accordance with the provisions set out in Chapter 3 of Annex X of the above-mentioned Directive 2007/46/EC and in the regulatory areas resulting from the provisions of Article 11 of this Order. For this purpose, the Receiving Service shall conduct all checks that have allowed the receipt referred to in Article 11 of this Order.
When the Receiving Service finds that the measures to ensure compliance of vehicles produced to the received type are not applied, are significantly different from the approved control measures and plans, or have ceased to be applied, although the production has not ended, it proposes to the Receiving Authority the necessary measures under the conditions established by the Receiving Authorityarticle R. 321-10 of the road code.

The national reception by type of small series is a reception leading to the production of vehicles:
- complete (ready to employment);
― incomplete (not ready for employment, requires at least one step to be complete);
completed (last stage leading to full vehicles).
For multi-stage vehicles, the requirements for consistency between the steps are set out in Annex 4 to this Order.

The National Receipt Application File by Small Series Type contains at least:
Parts I and II of Schedule III of the above-mentioned Directive 2007/46/EC;
― all supporting documents for each regulatory area concerned by the application for receipt, as defined in section 11 of this Order. All of these supporting documents are preceded by a summary table including at least, by regulatory domain:
the nature of the evidence;
the quality of the signatory of the evidence;
the date of the evidence;
― variants and versions covered by supporting documentation;
- the list of types/variants/versions corresponding to the reception, or a table to reconstitute the list;
a supporting document showing compliance with the provisions of Article 12 of this Order.

The manufacturer shall apply to the reception service designated in Article 3 of this Order.
A single application is filed for a particular vehicle type and a separate application is filed for each type to be received.
The reception service may, by a reasoned request, invite the manufacturer to provide any additional information necessary to make a decision on the required tests or to facilitate the completion of such tests.
The manufacturer shall provide the service in charge of the receipts as many vehicles as necessary to enable the proper operation of the type-approval procedure.

The national receipt slips by type of small series are prepared by the reception service in accordance with the models set out in Annex VI to the above-mentioned Directive 2007/46/EC, with the exception of the titles that are replaced by "National Receipt Sheet by Type of Small Series". They specify the nature of the exemptions granted pursuant to paragraphs 1 and 2 of Article 23 of the above-mentioned Directive 2007/46/EC.

The national reception sheets by type of small series are numbered as follows:
e2 * NKS * reception number * extension number,
where the receipt number corresponds to a sequential number of four digits, starting if necessary by zeros, and the extension number corresponds to a sequential number of two digits, starting if necessary by zeros.
For example:
e2 * NKS * 0004 * 02,
for a second extension of a fourth reception awarded by France, of vehicles produced in small national series.
The number shall be issued in accordance with Article 3 of this Order.

The manufacturer shall inform the service in charge of receipts of any changes to the information recorded in the receipt file.
An amendment is considered an "extension" of the reception when:
– new inspections or tests are required;
a record of the type receipt form, with the exception of its annexes, has been amended;
– new requirements come into force under one of the regulatory acts applicable to the vehicle received.
In such cases, the manufacturer shall provide the reception service with all of the elements related to this amendment, the supporting documentation and the updated receipt file.
The reception service assigns to the update reception card an extension number, which increases according to the number of successive extensions already granted. The receipt form clearly indicates the reason for the extension and the date of the new publication.
The service in charge of the receptions, after registration, gives the applicant the updated indexed file.

When a national receipt by type of small series of a vehicle loses its validity as a result of the provisions provided for in Article 17, paragraph 1, of the above-mentioned Directive 2007/46/EC, the manufacturer shall notify the vehicle to the service in charge of receipts informing the DRIRE Ile-de-France. The latter shall inform, if necessary, the authorities of the other member States under the conditions provided for in the same article.

1. If the manufacturer wishes to acknowledge a national receipt by type of small series by other Member States, the service designated in Article 3 of this Order shall send a copy of the receipt form and its annexes to the competent authorities of the Member States designated by the manufacturer, by registered mail or by e-mail;
2. The service referred to in Article 3 of this Order shall be provided with the receipt forms and annexes of the national receptions by type of small series carried out in the other Member States, sent by registered mail or by electronic mail by the competent authority in the matter of receipt of that Member State. This service shall have a period of sixty days from the date on which the record was received to disclose its decision of acceptance or refusal to the competent receiving authority that transmitted the record.
3. The NKS reception issued by another Member State is recognized in France provided that the technical provisions for receipt and conformity of production under which it was issued are at least equivalent to those provided for in articles 11 and 12 of this Order. The tests shall have been carried out, for the areas concerned, by technical services notified by a member State.



Individual receptions

The provisions applicable for the individual reception of new vehicles are those applicable in a national insulated reception and provided for in the relevant application orders.
However, the vehicles referred to in paragraph 4 of Article 2 of the above-mentioned Directive 2007/46/EC shall be subject, according to their category, to the requirements set out in Part 1 of Annex IV to this Directive.
The individual receipt form is based on the model in annex 5 to this Order.
In the light of the registration, the minutes of Schedule 3 to the above-mentioned Order dated 18 November 2005 are due to the receipt of Appendix 5 to this Order.



Certificate of Compliance

For the registration of vehicles whose type has been the subject of a CE reception by type or a CE reception by type of small series, the certificate of conformity issued by the manufacturer to any vehicle conforming to a type, variant and specific version shall be established according to the provisions of Article 18 and according to the model defined in Annex IX of the above-mentioned Directive 2007/46/EC and written in French.
For the registration of vehicles whose type has been the subject of a national receipt by type of small series, the conformity certificate issued by the manufacturer to any vehicle conforming to a specified type, variant and version shall be determined according to the model in Annex 6 or Annex 7 to this Order.
The certificate of conformity is designed to exclude any falsification. For this purpose, the paper used is protected either by color graphic representations or by a watermark corresponding to the manufacturer's identification mark.



Registration, sale and commissioning

In order to facilitate the issuance of vehicle registration certificates, the certificate of conformity referred to in the first paragraph of the previous article is supplemented by the national vehicle type identification code and, as appropriate, by the necessary and sufficient data for registration in France grouped at the end of the Community conformity certificate. This certificate of conformity may be replaced, under special conditions, by the document "3 in 1" and the certificate of identification to a community type defined in Schedule 1 to the above-mentioned Order of February 9, 2009.

The verification, for the types, variants and versions of the complete or completed vehicles, of the necessary and sufficient data for their registration which are indicated on the certificate of conformity is carried out on the basis of the receipt forms (and their annexes) communicated to the CTA by DRIRE Ile-de-France or the competent authorities of the Member States that have issued the receipts.
During this verification, at least one national type identification code with fifteen alphanumeric characters is assigned to each type, variant and vehicle version. For national receptions of small series issued by a DRIRE or DREAL, the identification code is assigned on the basis of the data provided by the reception service.
In order to facilitate the issuance of national type identification codes, manufacturers shall transmit to the central technical body, electronically, the data of the receipt records required for the treatments referred to in the preceding paragraphs for the registration of vehicles. In the case of national small-series receptions, the manufacturer transmits these data to the reception service that communicates them after validation to the CTA.
The national type identification codes and information referred to in the first paragraph, updated on the basis of the DRIRE, DREAL and the competent authorities of the Member States relating to new receptions and modifications and withdrawals of existing receptions, are communicated to the manufacturers of the corresponding vehicles and to the services of the Minister of Interior in charge of the registration of vehicles.

The central technical body:
― establish and manage the means necessary to collect and exploit the data relating to receptions by type;
∙ defines the protocol used for the transmission by manufacturers of data from reception records, as well as for the issuance of the national type identification code to manufacturers. This protocol includes the list of data, organization, format, consistency rules and the electronic transmission mode retained by the CTA to ensure the confidentiality of the information collected and the lack of deformation of the initial data.



Registration, sale and commissioning
of end-of-series vehicles

The manufacturer who wishes to benefit from the provisions of Article 27, paragraph 1, of the above-mentioned Directive 2007/46/EC shall apply to the competent authority for receipt. In the case of national small-series receptions, the request is addressed to the reception service.
The application must indicate the technical or economic reasons that prevent these vehicles from complying with the new technical requirements and specify the number of vehicles involved, as well as the number of vehicles of all types involved in the operation in France during the previous year.

The manufacturer who has obtained the authorization to put in service the vehicles referred to in the preceding article shall make available to the competent receiving authority the list of the identification numbers of the vehicles concerned. In the case of small series national receptions, this list is made available to the reception service.

For the application of the requirements ofArticle R. 321-14-1 of the Road Codethe provisions defined by Article 32 of the above-mentioned Directive 2007/46/EC shall apply. The notification to the competent authorities is made in accordance with the model in Appendix 8.



Application dates

At the request of the manufacturer, the provisions of the above-mentioned Directive 2007/46/EC may be applied for the type-approval of new types of vehicles, as defined in paragraph B of Annex II of the above-mentioned Directive 2007/46/EC as of 29 April 2009.
The CE reception by type, the CE reception by type of small series or the national reception of small series is mandatory from the dates in the following table:

The application of this Order does not cancel any CE reception by type issued before 29 April 2009 for vehicles of category M1, systems or equipment, and does not hinder the extension of these receptions.

Pursuant to Article 44 of the above-mentioned Directive 2007/46/EC, national receptions continue to be granted for:
- vehicles that are not yet within the scope of the above-mentioned Directive 2007/46/EC;
- vehicles of another category than M1 products in small series;
- vehicles for which a request for an insulated reception is submitted.

The following orders are repealed as of 29 April 2009:
16 September 1994 relating to the community reception (EC) of the types of vehicles, systems or equipment;
16 September 1994 the designation of the regional directorates of the research and environment industry responsible for issuing community receptions (CE) of vehicle types.

The Delegate for Road Safety and Traffic and the Director General of Energy and Climate are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
