Order of 20 March 2009 setting for the year 2009 the contribution of health insurance plans, the objective of expenditure and the total annual expenditure for establishments and services under the National Solidarity Fund for Self-Government referred to in Article L. 314-3 of the Code of Social Action and Families and setting the amount referred to in Article L. 314-3-4 of the same Code

The Minister of Labour, Social Relations, the Family, Solidarity and the City, the Minister of Health and Sports and the Minister of Budget, Public Accounts and the Public Service,
Given the Social Security Code, including its OL 111-3 and LO 111-4 ;
Considering the code of social action and families, including its articles L. 14-10-4, L. 314-3, L. 314-3-1 and L. 314-3-4 ;
In light of Act No. 2008-1330 of 17 December 2008 on the financing of social security for 2009, article 71,
Stop:

Article 1

The contribution of the health insurance plans referred to in I of Article L. 314-3 of the Code of Social Action and Families is set at 14 144 million euros for the year 2009, of which 6,417 million euros for the establishments and services mentioned in the 3rd of Article L. 314-3-1 of the Code of Social Action and Families and 7,727 million euros for the establishments and services mentioned in the 1st of the same

Article 2

The objective of expenditure referred to in I of Article L. 314-3 above is set at 15,602 million euros for the year 2009, of which 7,592 million euros for the establishments and services mentioned in 3° of Article L. 314-3-1 of the code of social action and families and 8,010 million euros for the establishments and services mentioned in 1° of the same article.
The setting of the above-mentioned expenditure objective is, on the one hand, dependent on the contribution mentioned in Article 1 and, on the other, on a forecast amount of 1,458 million euros corresponding to the products mentioned in 1° and 2° of Article L. 14-10-4 of the code of social action and of the families assigned to the financing of the social and mediocial institutions or services referred to in Article L.

Article 3

The total annual amount of expenditure taken into account for the calculation of the aggregate, package, day price and rates for the benefits of the facilities and services referred to in Article L. 314-3-1 above is fixed on the basis of the expenditure objective referred to in Article 2, to 15,860 million euros for 2009.

Article 4

The amount taken under the above-mentioned section L. 314-3-4 is as follows:
1° For establishments and services referred to in 1° of Article L. 314-3-1 of the Code of Social Action and Families, 85 million euros, 82 million euros and 16 million euros for forecasting operating credits related respectively to the fiscal years 2010, 2011 and 2012;
2° For the establishments mentioned in 3° of the same article, 52 million euros, 62 million euros and 20 million euros for the forecasting operating credits for the fiscal years 2010, 2011 and 2012.

Article 5

The Director of Social Security and the Director General of Social Action are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.
