    CONVENTION DE MISE À DISPOSITION D'UN APPRENTI TRAVAILLANT IN FRANCE AUPRÈS D'UNE ENTREPRISE D'ACCUEIL ÉTABLIE dans un AUTRE ÉTAT MEMBRE DE L'UNION EUROPÉENNE

    Preamble

    This Agreement shall be concluded in accordance with the following:
    ― labour code, including its article L. 6211-5 and articles R. 6223-17 and following ;
    rural code, book VII;
    ―European directive No. 94 / 33 of 22 June 1994 on the protection of young people at work (in particular article 1 on the age of admission, article 7. 3 on prohibitions of work and articles 8, 9 and 10 on working and rest periods);
    ― Regulation (EEC) No. 1408 / 71 concerning the application of social security schemes to employees, non-workers and members of their families travelling within the Community.

    Remarks:


    The term: "employer" means the organization that signed the apprenticeship contract in France in which the apprentice follows his training.
    The term "welcome company" is understood in the sense of economic unity or organization, regardless of its legal form, established in another Member State of the European Union and welcoming the apprentice in a working situation.


    Social protection:


    The apprentices who carry out part of their training in another Member State are entitled to the maintenance of the social protection regime of their country of origin under the provisions of Regulation (EEC) No. 1408 / 71. Form E101 certifies the employer's affiliation to a social security regime.
    This Convention does not allow for the derogation of national rules of entry, residence and access to the labour market of third-country nationals.


    Sharing of responsibilities between the employer and the host company:


    The employer remains subject to the obligations resulting from the signing of the apprenticeship contract, including, inter alia, compliance with the terms of the employment contract, maintenance of remuneration, payment of social expenses, liability for disciplinary power, occupational medicine and the management of paid leave.
    In the event of a difficulty, or a fault on the part of the apprentice, the host company immediately informs the employer who takes the appropriate measures.
    The host company is responsible for working conditions. This includes provisions for the duration of work, night work, weekly rest and holidays, rules of hygiene and security, conditions of employment of women and young workers.

    Article 1

    Subject

    This Agreement regulates the relationship between the signatories for the organization and conduct of the European apprenticeship (e) training period in a host company.
    As part of the training provided by the apprenticeship contract, the responsibility for further training is entrusted to a host company established in another EU country. The general objectives of this training are set out in the educational annex accompanying this Convention.


    Article 2

    Nature of the tasks entrusted to the apprentice

    The tasks to be performed in the host company are determined in the educational schedule.

    2. The duration of the work (including training) and the applicable schedules are those in effect in the host company for this category of employee, within 35 hours per week, without the possibility of additional hours.
    In addition to overtime, apprentices over the age of 18 are subject to the rules of common law, referred to in the administrative schedule, in terms of working hours (time amplitude, rest time, etc.). The protective provisions of minor apprentices for the duration of work are specified in the same annex.
    3. The parties agree on the apprentice's leave.The employer must ensure that the apprentice's leave entitlements are respected throughout the year.
    4. The host company undertakes to train the apprentice to security, to inform him of the specific risks that he will meet in the company during his mobility period, and must provide him with the necessary personal protective equipment.


    Article 5

    Remuneration

    The employer must at least maintain the apprentice's salary.
    The employer and the host company may, if they wish, agree on compensation for wages and expenses. If applicable, this agreement shall be annexed to this Convention.


    Article 6

    Accommodation, transportation and other fees

    A document annexed to this agreement specifies the conditions for the handling of transportation, accommodation and restoration costs (by the employer, the hospitality company, the apprentice, the regional council, the European Union or the professional branches, etc.).

    Article 7

    Disease cover and accident
    work / occupational disease

    The apprentice (e) has a social health and work/occupational illness insurance coverage under the apprenticeship contract and for the duration of application of this agreement.
    During the period of mobility carried out in another Member State of the European Union, the apprentice retains his status as subject to the social security regime, which he reports under the conditions laid down by European legislation (in particular Regulation [EEC] No. 1408 / 71) and French (in particular, Article 761-1 of the Social Security Code for apprentices under the general regime and Article 764-1 of the Rural Code for apprentices under the agricultural wage system).


    Article 8

    Civil liability insurance
    and professional

    1.The employer certifies that it is guaranteed in respect of civil liability (company and no police) for civil liability
    damage suffered or caused by the apprentice in the host company outside of any apprenticeship.
    2. The host company certifies to be guaranteed in respect of civil liability (company .............................................) regarding the police............
    damage incurred or caused by the apprentice during the work or benefits performed on the occasion of the apprenticeship.
    3. The apprentice (e) attests to be guaranteed (e) in respect of civil liability (company and no police) for the damage suffered or caused by him or her including abroad outside the host company in the course of the acts of daily life (art. 1382 and 1384 of the Civil Code). This insurance can be subscribed by the CFA on behalf of the apprentice.

    In the event of difficulty, the apprentice immediately informs him, so that appropriate measures are taken.


    Article 10

    Termination of the Convention

    The termination of the agreement may be effected on the express agreement of the co-signatories. It must be noted in writing and notified to the Director of the Training Centre, to the Service responsible for the registration of the contract, to the Departmental Director of Labour, Employment and Vocational Training (or to the Chief of Service assimilated), and, according to the reference pedagogical authority (to be specified), to the rector of academy, to the Regional Director of Agriculture and Forestry or to the Regional Director of Youth, Sports and Societies.
    This Agreement may be terminated by either party, in the event of serious misconduct, the risk of the apprentice or non-compliance with the commitments of this Agreement, duly recognized.
    This termination cannot result in compensation, and does not have a consequence, by itself, on the continuation of the learning contract.

    Article 11

    Entry into force of the Convention

    This Agreement shall be forwarded for advice to the Director of the CFA or, in the case of a Learning Section, to the Establishment Officer. The latter shall transmit it with his advice to the agency responsible for the registration of the contract, to the departmental Director of Labour, Employment and Vocational Training (or to the Chief of Service assimilated), and, according to the reference pedagogical authority (to be specified), to the rector of academy, to the Regional Director of Agriculture and Forestry or to the Regional Director of Youth, Sports and Associative Life.
    The agreement is applicable upon receipt by the employer of the agreement of the academy rector, the Regional Director of Agriculture and Forestry or the Regional Director of Youth, Sports and Associative Life. The absence of a response to the employer one month after receiving the agreement by the competent authority is agreed.

    Obligations of the apprentice


    The apprentice's obligations include:
    ∙ perform the tasks entrusted to it by the host company in accordance with the provisions of this Convention and its educational annex;
    ― regularly and spontaneously present the liaison tools to the host company;
    ∙ respect the rules of confidentiality and professional secrecy.

    Reception company obligations


    The obligations of the host company include:
    • provide individual protection equipment;
    ― present to the apprentice the risks specific to his business;
    ― directing and controlling the apprentice in his activities by the designation of a "guardian", presenting the teaching and professional skills as well as the necessary moral guarantees, responsible for following up;
    ― to make the apprentice perform the work that corresponds to both his abilities and the objectives of this mobility period (please fill this part of the schedule for each period):
    ― if this work includes the use of equipment, indicate the type of equipment, knowing that the person in charge of the host company has the obligation to make use of only equipment in accordance with the regulations, and used in the corresponding conditions of use (encadrement, port of personal protective equipment, training...);
    if this work includes the use of chemical agents covered by Directive 98 / 24 / EEC of the Council of 7 April 1998 concerning the protection of the health and safety of workers against the risks associated with chemical agents in the workplace, it will be provided in writing to the apprentice all information on the possible exposures provided for in Article 8 of this directive so that he can transmit them to the doctor of the work of his employer;
    ― if it is the execution of hazardous work or the use of dangerous machinery or products by young people under the age of 18, the hospitality company has certified that it has complied with the regulations it reports on derogation from the prohibition of certain work (directive 94 / 33 on the protection of young people at work, art. 7. 3 on labour prohibitions and art. 8, 9 and 10 on working and rest times; cf. administrative annex);
    ― in case of accommodation of the apprentice, provide accommodation in accordance with the hygiene and safety standards of the host country;
    ― allow the apprentice to complete his or her liaison tools or to prepare his or her report (if requested), giving him the time required.

    ADMINISTRATIVE ANNEX


    Disease cover and work accident /
    occupational disease


    Forms (also available at www. ameli. en and www. msa. en):
    ―the French employer must, prior to the departure of his apprentice, apply to the social security scheme to which he is responsible for issuing Form E101 (replaced in two copies) which attests to the continued affiliation of the apprentice with a social protection regime;
    - one of the copies issued by the social security fund is delivered to the apprentice;
    ― for sickness and injury to work / occupational disease, Community Regulation 1408 / 71 provides for the benefit of benefits in kind (access to care or reimbursement of care) according to the provisions of the legislation in force in the country of detachment. The presentation of the European health insurance card (ECAM), issued by the social security fund, which the apprentice reports, attests to the opening of the rights. Cash benefits are covered by French legislation alone.
    Simplified formalities are provided for detachments of less than or equal to three months.
    The obligations of the employer remain for the duration of the apprenticeship contract.
    In the event of an apprentice's work accident, either during the work or during the journey, the head of the host company undertakes to prepare the accident statement and to send it to the employer signatory to the contract that has forty-eight hours to send it by registered letter with acknowledgment of receipt to the social security plan credit union of which the employer reports (the SIRET number is the employer's statement). The accident report form (CERFA 60-3682) is available online at www. ameli. en.

    Common law applicable to major apprentices
    Working duration


    Apprentices are employees who have entered into a particular type of employment contract by which the employer undertakes, in addition to the payment of a salary, to provide the apprentice with a full professional training, provided for part in the company and for part in the apprenticeship training centre or learning section (Article 6221-1 of the Labour Code [1]).
    As a result, apprentices over the age of 18 are subject to the rules of common law, in particular with regard to their working hours (art.L. 3121-1 to L. 3134-15).
    Reminder of the national rules applicable during the period of mobility, except the provisions of the host country more favourable for the apprentice:
    - the legal duration is 35 hours per week, overtime trigger threshold (art.L. 3121-10), for maximum working hours per week of 48 hours (art.L. 3121-35). However, the possibility of overtime beyond the hours quota provided for by the apprenticeship contract is not open as part of a convention to make an apprentice available to a host company established in another EU Member State;
    ― maximum working time per day is 10 hours (art.L. 3121-34)
    ― any work performed between 21 hours and 6 hours, or in another conventionally determined interval (art.L. 3122-29), is considered as night work. The use of night work is exceptional and must have been put in place by a collective agreement (art.L. 3122-33)
    ― the minimum daily rest period is 11 consecutive hours (art.L. 3131-1)
    weekly rest (art.L. 3132-1 et seq.) : it is forbidden to make an employee work more than 6 days a week. The employee must also receive a minimum 24-hour rest, in addition to the daily rest mentioned below (total 35 hours); this weekly rest is given on Sunday except for derogation;
    leave with pay: articles L. 3141-1 et seq. (see also section 4. 3 of the agreement to be made available).

    (1) By agreement, and unless otherwise stated, all of the items listed in the Administrative Schedule fall under the Labour Code.

    Provisions specific to minor apprentices
    Working duration

    Reminder of the national provisions applicable during the period of mobility to minor apprentices (aged under the age of 18), except for the provisions of the country of more favourable reception for the minor apprentice:
    Special provisions for young workers: third part of the Labour Code, Book I, Title VI;
    Learning Provisions: Part VI of the Labour Code, Book II, Title II.

    Daily and weekly working hours

    Young workers cannot work more than eight hours a day or more than thirty-five hours a week (art.L. 3162-1 to L. 3162-3).

    Derogation from night work ban
    (art.L. 3163-1 to L. 3163-3 and R. 3163-1 to R. 3163-6)

    The law prohibits night work from under the age of 18, while admitting that there may be derogation in certain sectors for minors between the ages of 16 and 18 and when the business of the company justifies it.
    The areas in which it can be derogated from the prohibition of the use of minors at night are those of bakery, pastry, restoration, hotel, shows and horse races (R. 3163-1). In addition, strict hourly beaches are defined for the night employment of minors in each of the selected areas.
    Any derogation from this prohibition shall be issued by the Labour Inspector under the conditions established by thearticle R. 3163-5.


    Daily rest

    (art.L. 3164-1)

    The minimum daily rest of young workers may not be less than 12 consecutive hours. It is worn at 14 consecutive hours if they are under 16 years of age.


    Work on Sunday and holidays
    (art. L. 3132-3 et seq., L. 3164-2 to L. 3164-8
    and R. 3164-1 to R. 3164-2)

    Young workers are entitled to two consecutive days of rest per week (weekly stay).
    This weekly rest is given on Sundays, unless expressly stipulated in the Labour Code (art.L. 3132-3 et seq. et seq.) L. 3164-3).
    However, the prohibition of Sunday work is not applicable to minor apprentices employed in certain sectors for which the particular characteristics of the activity warrant. These areas, detailed to thearticle R. 3164-1, are those of the hotel industry, catering, caterers, cafes, tobacco, bakery, pastry, butchery, charcuterie, cheese shop-cream, fishery, sale of flowers, and other sectors as principally ensuring the manufacture of retail food products for immediate consumption (sale to take away) or whose exclusive activity is the sale of retail food (markets).
    In addition, holiday rest is mandatory for young workers, except in industrial establishments operating continuously (art.L. 3164-6 and 7).
    The employment of minors, workers or apprentices, is nevertheless possible on holidays in certain sectors and under the conditions of thearticle L. 3164-8. These areas, detailed to thearticle R. 3164-2, are those for which Sunday work is authorized (listed above), and that of the show (Decree No. 2008-889 of 2 September 2008).


    Provisions specific to minor apprentices
    hazardous work


    National rules
    (art.L. 4153-8, D. 4153-15
    to D. 4153-40)

    Minors constituting a vulnerable public, it is necessary to protect them by blocking the possibility of assigning them to work deemed dangerous. Article L. 4153-8 prohibits the use of workers under the age of 18 in certain categories of work that expose them to risks to their health, safety, morality or may exceed their forces. These prohibitions, specified in articles D. 4153-15 to D. 4153-40are for some exemptions.
    These are:
    - work that affects good morals and morality (art.D. 4153-15 and 16);
    work outside (art.D. 4153-17-19)
    uses of certain work equipment (art.D. 4153-20 to 24)
    - work exhibiting to hazardous chemical agents (art.D. 4153-25 to 28)
    - work exhibiting an electrical risk (art.D. 4153-29)
    ― work with pressure devices and hyperbaric works (art.D. 4153-30 to 32)
    ― exhibiting work with ionizing radiation (art.D. 4153-33 and 34)
    - works in contact with animals (slaughterhouses and ferocious or venomous animals); art.D. 4153-35)
    construction and public works (art.D. 4153-36)
    – glass work (art.D. 4153-37)
    ― works in contact with metal in fusion (art.D. 4153-38)
    – load handling (art.D. 4153-39 and 40).
    Derogations from these prohibitions may be granted to apprentices by the labour inspector, after favourable advice from the work doctor. Authorization from the teacher or workshop monitor is required for each job (art.D. 4153-41 to 49).
    These exemptions are valid, under conditions, for the duration of the contract, but are limited to the beneficiary employer in French territory, and are revocable at any time if the conditions justifying their grant cease to be met.



    Rule applicable as part of a disposition
    in another Member State


    The young apprentice in mobility may not be affected, in the host company, to work that is deemed to be hazardous, within the meaning of the provisions of Directive 94-33 on the protection of young people at work, unless the undertaking certifies that it has complied with the derogation procedure in force in its territory.
