Judgment of February 12, 2009 to extend amendments and an agreement entered into under the national collective agreement of travel and tourism agency staff (No. 1710)

Minister of Labour, Social Relations, Family, Solidarity and the City,

Considering the Labour Code, including its article L. 2261-15;

In view of the decree of 21 July 1993 and the successive decrees, including the decree of 8 December 2005, extending the national collective agreement of the staff of the travel and tourism agencies of 12 March 1993 and of texts amending or supplementing it;

Having regard to Act No. 1 of 16 June 2008 on the classification of employment to the aforementioned collective agreement;

Having regard to Act No. 2 of 16 June 2008 on the revalorization of minimum wages to the aforementioned collective agreement;

Having regard to Act No. 3 of 16 June 2008 revising the articles of the aforementioned collective agreement;

Having regard to the agreement of 7 July 2008 on wages entered into under the aforementioned national collective agreement;

Considering the request for extension submitted by signatory organizations;

Having regard to the announcements published in the Official Journal of 6 September 2008 and 7 October 2008;

Considering the opinions collected during the investigation;

In view of the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), rendered at the meeting on 6 February 2009,

For all employers and employees included in the field of professional application of the national collective agreement of travel and tourism agency staff of 12 March 1993 and in its own territorial field, the following provisions shall be made:
―Act No. 1 of June 16, 2008 on the classification of employment to the collective agreement referred to above subject to the application of provisions of Article L. 2241-9 of the Labour Code under which the mandatory annual wage negotiations and five-year classifications also aim to define and program at the branch level the measures to eliminate the pay gap between women and men by 31 December 2010.
The previous paragraph of Article 2. 1 is extended subject to the application of the provisions of articles L. 6325-9 and D. 6325-18 of the Labour Code under which the holder of a professionalization contract of at least 26 years of age receives, during the term of the fixed-term contract or the professionalization of the indefinite-term contract, a remuneration that cannot be less than the minimum wage of growth or 85% of the minimum remuneration provided for by the provisions of the agreement or the collective agreement of the business;
- Act No. 2 of 16 June 2008 on the revalorization of minimum wages to the collective agreement referred to above subject to the application of the provisions of Article L. 2241-9 of the Labour Code under which the mandatory annual bargaining on wages also aims to define and program at the branch level the measures to eliminate the pay gap between women and men before 31 December 2010;
- Act No. 3 of June 16, 2008 revising the articles of the aforementioned collective agreement.
The first paragraphs of articles 16 (a) and 16 (b) are extended subject to the application of provisions of Article L. 1221-25 of the Labour Code from Act No. 2008-596 of 25 June 2008 on the modernization of the labour market.
The second paragraphs of articles 16 (a) and 16 (b) are extended subject to the application of the provisions of articles L. 1221-25 and L. 1221-26 of the Labour Code of Act No. 2008-596 of 25 June 2008 on the modernization of the labour market.
The second paragraph of Article 16 (c) is extended subject to the application of the provisions of Article L. 1221-25 of the Labour Code of Act No. 2008-596 of 25 June 2008 on the modernization of the labour market.
The fifth paragraph of section 16 (c) is extended subject to the application of provisions of Article L. 1221-26 of the Labour Code from Act No. 2008-596 of 25 June 2008 on the modernization of the labour market.
The first two paragraphs of Article 18 (b) are extended subject to the principle "equal work, equal pay" as a result of the provisions of Articles L. 2261-22 10, L. 2271-1 (8°) and L. 3221-2 of the Labour Code.
Section 20 is extended subject to the application of provisions of Article L. 1234-9 of the Labour Code Act No. 2008-596 of 25 June 2008 on the modernization of the labour market;
―the agreement of 7 July 2008 on wages entered into under the above-mentioned national collective agreement subject to the application of the provisions of Article L. 2241-9 of the Labour Code under which the mandatory annual wage bargaining is also intended to define and program at the level of the measures to eliminate the pay gap between women and men before 31 December 2010.

Article 2


The extension of the effects and sanctions of the above-mentioned amendments and agreements shall be made on the date of the publication of this order for the remaining period of time and the conditions provided for by such amendments and agreements.

The Director General of Labour is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
