Judgment of 11 February 2009 to extend an avender and an agreement entered into under the national collective agreement for the mechanical work of wood and sawmills, trade and import of wood (brush industry) (No. 158)

Minister of Labour, Social Relations, Family, Solidarity and the City,
Given the Labour Code, including its article L. 2261-15 ;
In view of the Order of 28 March 1956 and the subsequent Orders, including the Order of 23 January 2008, extending the National Collective Agreement for the Mechanical Work of Timber and sawmills, the Trade and Import of Woods of 28 November 1955 and the amendments or additions to it;
Considering the decision of 18 September 1986 to extend the employment classification agreement in the brushwork industry of 1 March 1986 as part of the aforementioned collective agreement;
Having regard to Act No. 4 of 28 October 2008 to the above-mentioned Agreement of 1 March 1986;
Having regard to the agreement of 28 October 2008 on minimum wages, concluded under the agreement of 1 March 1986 referred to above;
Considering the request for extension submitted by signatory organizations;
Having regard to the announcements published in the Official Journal of 1 and 6 January 2009;
Considering the opinions collected during the investigation;
In view of the reasoned opinions of the National Collective Bargaining Commission (subcommission of agreements and agreements) collected in accordance with the procedure provided for in theArticle R. 2261-5 of the Labour Code during the meeting of 6 February 2009,

For all employers and employees included in the scope of the employment classification agreement in the brushwork industry of March 1, 1986, as amended by Act No. 4, entered into within the framework of the national collective agreement for the mechanical work of wood and sawmills, the trade and import of timber of November 28, 1955, and in its own scope, the provisions of:
―Act No. 4 of October 28, 2008 to the agreement of March 1, 1986 referred to above;
Avender No. 4 is extended provided that, on the one hand, staff bound by a contract of apprenticeship benefit from the provisions of Avender No. 4 as long as they meet the terms and conditions of assignment in accordance with the provisions of articles L. 6222-23, L. 6222-27 and D. 6222-26 of the Labour Code and, on the other hand, the application of provisions of Article L. 2241-9 of the Labour Code which provides that the annual wage bargaining is also intended to define and programme measures to eliminate the pay gap between women and men by 31 December 2010;
― the October 28, 2008 Minimum Wage Agreement, entered into under the above-mentioned March 1, 1986 Agreement, subject to the application of the provisions of Article L. 2241-9 of the Labour Code that provide that the annual wage bargaining is also intended to define and program measures to eliminate the pay gap between women and men before December 31, 2010.

Article 2


The extension of the effects and sanctions of the actor and the agreement referred to above shall be made on the date of the publication of this order for the remaining period and the conditions provided for by the said actor and the said agreement.

Article 3


The Director General of Labour is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
