Decree of 30 January 2009 amending the decision of 10 April 2008 concerning the a posteriori installation of rear-view mirrors on certain heavy vehicles

Minister of State, Minister of Ecology, Energy, Sustainable Development and Land Management,
Having regard to Directive 70 / 156 / EEC of the European Parliament and of the Council of 6 February 1970 concerning the approximation of the legislation of the Member States concerning the receipt of motor vehicles and their trailers, last amended by Directive 2007 / 37 / EC of 21 June 2007;
Having regard to Directive 2003 / 97 / EC of the European Parliament and of the Council of 10 November 2003 on the approximation of the legislation of the Member States relating to the reception or approval of devices for indirect vision and vehicles equipped with these devices, last amended by Directive 2005 / 27 / EC of 29 March 2005;
Having regard to Directive 2007 / 38 / EC of the European Parliament and of the Council of 11 July 2007 concerning the a posteriori assembly of mirrors on heavy weights registered in the Community;
Given the road code, including Articles R. 316-1 and R. 323-2 ;
See?10 April 2008 the a posteriori assembly of mirrors on certain heavy vehicles;
On the proposal of the prefect, delegated to road safety and traffic,

Article 6 of the above-mentioned decision of 10 April 2008:
I.-The first paragraph is replaced by the following paragraph:
"For vehicles requiring compliance under sections 3, 4 or 5 of this Order, the solutions corresponding to the technical entity to be installed and the corresponding retrovision field shall be determined by the manufacturer, its accredited representative or the manufacturer of the technical entity to be installed. »
II.-The fourth preambular paragraph is replaced by the following paragraph:
"The installation on the vehicle of the technical entity corresponding to the selected solution and the realization of all the settings necessary for the respect of the retrovision field, for its compliance with sections 3, 4 or 5, shall be carried out by the manufacturer, its authorized representative or any installer with the capacity to perform this compliance. »
III.-The sixth preambular paragraph is replaced by the following paragraph:
"The conformity certificate models are listed in Appendices 1, 2, 3 and 4 to this Order. »

The provisions of section 8 of the above-mentioned decision of 10 April 2008 are replaced by the following provisions:
"In order to communicate to the Commission a list of the technical solutions selected for compliance with the provisions of sections 3, 4 and 5 of this Order, the manufacturer, the manufacturer's accredited representative or the manufacturer of the technical entity shall send to the Minister, for each range of vehicles, an attestation provided for the party that corresponds to the range of vehicles. »

Annexes A and B to this Order constitute Annexes 3 and 4 to the above-mentioned Order of 10 April 2008.

The prefect, delegated to road safety and traffic, is responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.

    A N N E X E 3: ALTERNATATION MODEL IN CONFORMITY BY VEHICLE GAME, REVIEW OFFICE
    Compliance with Directive 2007 / 38 / CE of 11 July 2007 concerning the a posteriori installation of rear-view mirrors on heavy loads.


    A.- Vehicle compliance models

    Equipment, passenger side, large angle mirror (class IV) and accosting (class V) conforming to the requirements set by Directive 2003 / 97 / CE.
    (Explicative on mounting, references of technical entities...)
    Editorial possibility 2: Compliance with Article 3-2 of Directive 2007 / 38 / CE:
    (Technical solution: change of class IV and / or V mirrors, and references of plans, calculations, tests...)
    Editorial Possibility 3: Compliance with Article 3-3 of Directive 2007 / 38 / CE:
    (Technical solution: installation of an additional device..., plan references, calculations, tests...)
    Date and signature: manufacturer of the technical entity


    B.-Engagement of vehicle compliance

    A N N E X E 4 : MODEL OF AMENDMENTS IN INDIVIDUAL CONFORMITY RELATED HORSES
    Compliance with Directive 2007 / 38 / CE of 11 July 2007 concerning the a posteriori installation of rear-view mirrors on heavy loads.
    We undersigned, (name, first name, installer address)
    the following vehicle:
    D. 1: Brand (to be systematically informed):
    D. 2: Type-variant-version or mine type:
    D. 3: Trade name (if available):
    J: International category (to be systematically informed):
    B: Date of first registration (to be systematically provided):

    has been brought into compliance with Directive 2007 / 38 / EC following the process provided by (1):

    the accredited representative of the manufacturer;

    Editorial Possibility 1: Compliance with Article 3-1 of Directive 2007 / 38 / CE:
    Equipment, passenger side, large-angle mirror (class IV) and accosting (class V) conforming to the requirements set by Directive 2003 / 97 / CE.
    I certify that the fields of vision of each of these mirrors (class IV and V), as defined in points 5. 4 and 5. 5 of Appendix III of Directive 2003 / 97 / EC, as amended by Directive 2005 / 27 / EC, are 100% covered.
    Editorial possibility 2: Compliance with Article 3-2 of Directive 2007 / 38 / CE:
    Equipment, passenger side, large-angle mirror (class IV) and accosting (class V) conforming to the requirements set by Directive 2003 / 97 / CE.
    I certify that the fields of vision of each of these mirrors (classes IV and V), as defined in points 5. 4 and 5. 5 of Appendix III of Directive 2003 / 97 / EC, as amended by Directive 2005 / 27 / EC, are covered at least 95% for Class IV mirror and at least 85% for Class V mirror.
    Editorial Possibility 3: Compliance with Article 3-3 of Directive 2007 / 38 / CE:
    In the absence of an economically viable technical solution for compliance under sections 3. 1 or 3. 2 of Directive 2007 / 38 / CE, I certify that the field of vision of all additional mirrors and/or other devices of indirect vision cover at least 95% of the field of vision at the level of the Class IV mirror floor and at least 85% of the field of vision at the level of the Class V mirror floor, as defined at 5. 4 and 5. 5 of Appendix III of Directive 2003 / 97 / EC, as amended by Directive 2005 / 27 / EC.
