Judgment of January 30, 2009 setting the balances for fiscal year 2007 and the instalments for fiscal year 2008 for compensation for occupational accidents and occupational diseases covered by sections L. 134-7 to L. 134-11 of the Social Security Code

The Minister of Labour, Social Relations, Family, Solidarity and the City, the Minister of Agriculture and Fisheries and the Minister of Budget, Public Accounts and Public Service,
Given the Social Security Code, including its articles L. 134-7 to L. 134-11 and D. 134-42 to D. 134-46 ;
Considering the rural code, including chapter I of Book VII title V;
Having regard to the March 12, 2008 order setting the balances for the 2006 fiscal year and the advances for the 2007 fiscal year for compensation in respect of insurance against occupational accidents and diseases referred to in sections L. 134-7 to L. 134-11 of the Social Security Code;
Considering the opinion of the Industrial Accidents and Occupational Diseases Commission of 14 January 2009,

For the year 2007, the compensation amounts referred to in sections L. 134-7 to L. 134-11 of the Social Security Code are determined as follows:
― positive balance in the general regime: 115,631,199 euros
― negative balance due to the agricultural wage system: 110,910,905 euros;
― negative balance due to the regime of agricultural workers in Lower Rhine, Upper Rhine and Moselle: 4,720,294 euros.

Taking into account the deposits of 108,676,972 euros and 4,637,568 euros respectively paid to the agricultural workers' regime and to the agricultural workers' regime of Bas-Rhin, Haut-Rhin and Moselle by the general regime, for the year 2007, pursuant to theArticle D. 134-44 of the Social Security Codethe National Health Insurance Fund of Employees pays:
2 233 933 euros at the central bank of the agricultural social mutuality;
82,726 euros in the diet of the agricultural workers of Bas-Rhin, Haut-Rhin and Moselle.

Article 3


As part of the compensation for the 2008 fiscal year, the general regime pays, at the beginning of each quarter of 2009, a total of 27,727,726 euros and a total of 1,180,073 euros for the agricultural workers of Lower Rhine, Upper Rhine and Moselle.

Article 4


The Director of Financial, Social and Logistics Affairs, the Director of Social Security and the Director of the Budget are responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
