See?Order No. 58-696 of 6 August 1958 amended in relation to the special status of personnel of the external services of the prison administration;
Vu la Act No. 83-634 of 13 July 1983 amendments to the rights and obligations of civil servants, including article 20, together with Act No. 84-16 of 11 January 1984 amended with statutory provisions relating to the public service of the State;
Vu le Decree No. 66-874 of 21 November 1966 amended on the special status of officials of the external services of the prison administration;
Vu le Decree No. 67-624 of 23 July 1967 setting out the allocation terms and rates of compensation for hazardous, unhealthy, inconvenient or salient work;
Vu le Decree No. 2007-1776 of 17 December 2007 creating an allowance for duties and objectives attributed to various personnel within the prison administration;
Considering the advice of the Central Joint Technical Committee of the Prison Administration dated 16 September 2008,
Decrete:
Article 1 of the above-mentioned decree of 17 December 2007 is replaced by the following provisions:
"Within the limits of the appropriations for this purpose and under the conditions set out in this decree, an allowance of functions and objectives may be awarded to interregional directors of the penitentiary services, functional directors of the penitentiary services, directors of the penitentiary services, administrative advisers, technical directors, technicians and members of the prison supervisory personnel's corps. »
Article 6 of the same decree is replaced by the following provisions:
"The allowance of duties and objectives is not paid during the theoretical teaching periods to the National School of Prison Administration.
Staffing students and interns may receive the allowance of duties and objectives under the same conditions as the corresponding officials, during the practical internship periods that they perform outside the National School of Prison Administration, subject to the effective exercise of the duties of these grades. »
By derogation from the provisions of the first paragraph of this article, officials of the deconcentrated services of the penitentiary administration, promoted after registration on a fitness list, shall be entitled to the allowance of function and objectives during the theoretical periods of education at the National School of Prison Administration.
In article 8 of the same decree, a paragraph shall be inserted before the last paragraph:
"any compensation for hazardous, unhealthy, uncomfortable or salient work; "
The title: "Chapter IV. ― Provisions applicable to members of the Correctional Service Supervisory Personnel Command Corps and to members of the Correctional Service Supervisory and Enforcement Corps performing the functions of Chief of Institution or Assistant to the Chief of Correctional Institution" is replaced by the following title: "Chapter IV. - Provisions applicable to members of the Correctional Service Supervisory Personnel Command Corps."
After Article 11 of the same decree, the chapters and articles are inserted as follows:
“Chapter V
“ Provisions applicable to technical directors
and Prison Service Technicians
"Art. 11-1.-The annual reference amount for this allowance shall be assigned a coefficient of variation from 1 to 8 for public servants who do not benefit from a public concession housing and a coefficient of 1 to 4 for employees housed by public concession.
“Chapter VI
" Provisions applicable to members of the Correctional Service Supervisory and Enforcement Corps performing the functions of Chief of Institution and Assistant to the Chief of Corrections
"Art. 11-2.-The annual reference amount for this allowance shall be assigned a coefficient of variation from 1 to 8 for public servants who do not benefit from a public concession housing and a coefficient of 1 to 4 for employees housed by public concession. »
The title: "Chapter V. ― Final Provisions" is replaced by the title: "Chapter VII. - Final provisions.
The provisions of this Decree come into force on the first day of the month following its publication in the Official Gazette.
The guard of the seals, the Minister of Justice, the Minister of Budget, Public Accounts and the Public Service and the Secretary of State responsible for the Public Service are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
