Considering Commission Regulation (EC) No. 70/2001 of 12 January 2001 concerning the application of Articles 87 and 88 of the EC Treaty to State aids for small and medium-sized enterprises, as amended by Commission Regulation (EC) No. 364/2004 of 25 February 2004 and by Commission Regulation (EC) No. 1976/2006 of 20 December 2006;
Having regard to Commission Regulation (EC) No. 1628/2006 of 24 October 2006 concerning the application of Articles 87 and 88 of the Treaty on National Assistance for Regional Purpose Investment;
In view of the Commission's communication of 4 March 2006 on the guidelines for regionally-finished State aids for the period 2007-2013, together with Commission decision C (2007) 651 of 7 March 2007 on the French map of regional end aids for the period 2007-2013 and Commission decision C (2008) 2261 of 4 June 2008 on the modification of the French map of regional end aids for the period 2007-2013;
Vu la Act No. 95-115 of 4 February 1995 modified orientation for the development and development of the territory;
Vu la Act No. 96-987 of 14 November 1996 amended to implement the City Revitalization Pact;
Vu le Decree No. 2007-732 of 7 May 2007 relating to regional end aid zones and small and medium-sized enterprise investment assistance areas;
The State Council (section of public works) heard,
Decrete:
The municipalities or parts of municipalities listed in the annex to this Order are included in the list of permanent regional end-use assistance zones (2007-2013) as defined in Appendix 1 (A, a) of the Decree No. 2007-732 of 7 May 2007 related to regional end aid areas and small and medium-sized business investment assistance areas.
In Appendix 1 (A, a) Decree No. 2007-732 of 7 May 2007 the reference to the municipality of Saint-Etienne: « 42218 Saint-Etienne (P : Saint-Etienne Sud-Ouest) » is replaced by the following terms: « 42218 Saint-Etienne (P : Saint-Etienne Sud-Ouest 1).The reference to the regional end-use assistance zones and the small and medium-sized enterprises (SMEs).
The 2° of Article 4 of Decree No. 2007-732 of 7 May 2007 for regional end-use assistance areas and small and medium-sized enterprise investment assistance areas is replaced by the following:
« 2° Grants to large companies in the case of productive investment projects exceeding 100 million euros and when their total amount is considered equal to or greater than one of the following amounts:
(a) 7 500 000 €, in an area where large companies can receive regional end aid within a 10 per cent rate;
(b) €11,250,000, in an area where large companies can receive regional end aid within a 15 per cent rate;
(c) €37,500,000, in an area where large companies can receive regional end aid within a 50% rate;
(d) €45,000, in an area where large companies can receive regional end aid within a 60 per cent rate. »
The Minister of State, Minister of Ecology, Energy, Sustainable Development and Land Management, the Minister of Economy, Industry and Employment and the Secretary of State for Land Management are responsible, each with regard to the implementation of this decree, to be published in the Official Journal of the French Republic.
