On the report of the Prime Minister and the Minister for Foreign and European Affairs,
Seen them Articles 52 to 55 of the Constitution ;
Vu le Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments undertaken by France,
Decrete:

Article 1


The agreement in the form of an exchange of letters between the Government of the French Republic and the Swiss Federal Council amending Schedule I to the Regulation respecting imports in Switzerland of the products of the free zones, signed in Paris on 28 April 2008 and in Bern on 1 May 2008, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign and European Affairs are responsible for the execution of this decree, which will be published in the Official Journal of the French Republic.

    SUSTAINABLE AGREEMENT OF LETTERS AGAINST THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE FEDRAL COUNCIL AMENDING MODIFICATION OF THE ANNEX I OF THE REGULATION CONCERNING IMPORTATIONS IN SWITZERLAND PRODUCTS, SIGN UP TO PARISED 1

    For several years the French and Swiss operators, involved in the production and distribution of the butter produced in the free zones of Haute-Savoie and the country of Gex, wished, in order to meet the demand, the increase of the milk quota set out in Annex I to the Regulation concerning the imports in Switzerland of the products of the free zones established by the arbitral award of 1 December 1933 of the Permanent Court of International Justice concerning the imports in Switzerland of the goods of the Swiss
    As a result of the exchanges between our services with respect to this amendment to Schedule I to the Regulations, I have the honour of my Government to propose to you the following measure: "Transformation of the butter export quota, currently set at 65,000 kilos per year in a free-of-charge quota of 800,000 kilos of milk per year for 776,700 litres of milk or 2,128 litres (2,19 kilos) The new daily milk quota, comprising the historical milk contingent and this contingent from the transformation of the historical butter quota, will therefore increase from 60,000 to 62,128 litres (63,992 kilos) per day. »
    I should be grateful if you would let me know if this proposal is a source of your government's approval. If so, this letter and your letter of reply will constitute an agreement between our two governments amending Schedule I to the Regulation respecting imports in Switzerland of the products of the free zones, which will come into force on the date of your response.

    Referring to your letter of 28 April 2008, I have the honour to confirm to you the acceptance of the Swiss government, taken at the meeting of the Federal Council of 14 March 2008, with the proposed amendment requested by all the French and Swiss operators, of the quota of butter as set out in Schedule I of the Regulation respecting the imports in Switzerland of the products of the free zones, established by the Swiss arbitral award of 1 December 1933 of the Permanent Court
    "Translation of the butter export quota, currently set at 65,000 kilos per year, in a quota of 800,000 kilos of milk per year, at a rate of 776,700 litres of milk or 2,128 litres (2,19 kg) per day. The new daily milk quota, comprising the historical milk contingent and this contingent from the transformation of the historical butter quota, will therefore increase from 60,000 to 62,128 litres (63,992 kilos) per day. »
    The Federal Council also confirmed at the same meeting the validity of the agricultural quotas currently in force in accordance with Article 4 of the Regulation respecting imports in Switzerland of the products of the free zones.
    Your letter dated 28 April 2008 and this response constitute an agreement between our two governments amending Schedule I to the Regulation respecting imports to Switzerland of products from free zones, which comes into force on the date of this letter.
